AN ORDINANCE MAKING CERTAIN FINDINGS: PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 915.2 ACRES OF LAND, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS, PROVIDING THAT THE TERRITORY ANNEXED SHALL BEAR ITS PRO RATA PART OF TAXES; PROVIDING THAT THE INHABITANTS THEREOF SHALL HAVE ALL THE PRIVILEGES OF ALL THE CITIZENS OF FORT WORTH, TEXAS; PROVIDING THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT HEREWITH; PROVIDING THAT THIS ORDINANCE SHALL, BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT; PROVIDING A SEVERABILITY CLAUSE AND NAMING AN EFFECTIVE DATE. WHEREAS, a public hearing before the City Council of the City of Fort Worth, Texas, wherein all interested persons were provided with an opportunity to be heard on the proposed annexation of the territory hereinafter described, was held at the City Council Chamber in the City Hall of Fort Worth, Texas, on the 23rd day of December, 1968, which date is not more than twenty (20) nor less than ten (10) days prior to the institution of annexation proceedings; and WHEREAS, notice of such public hearing was published in a newspaper having general circulation in the City of Fort Worth, Texas, and in the hereinafter described territory on the 12th day of December, 1968, which date is not more than twenty (20) nor less than ten (10) days prior to the date of such public hearing; and, WHEREAS, the population of the City of Fort Worth, Texas, is in excess of 400,000 inhabitants; and WHEREAS, the corporate area of the City of Fort Worth, Texas, was 198.222 square miles on January 1, 1969, and WHEREAS, the hereinafter described territory lies within the extraterri- torial jurisdiction of the City of Fort Worth, Texas; and WHEREAS, the hereinafter described territory lies adjacent to and adjoins the City of Fort Worth, Texas; and WHEREAS, the territory hereinafter described contains approximately 915.2 acres; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. The following described land and territory lying adjacent to and adjoining the City of Fort Worth, Texas, is hereby added to and annexed to the City of Fort Worth, Texas, and said territory hereinafter described shall hereafter be included within the boundary limits of the City of Fort Worth, Texas, and the present boundary limits of said City, at the various points contiguous to the area within the corporate limits of the City of Fort Worth, Texas, to wit: Being a tract or parcel of land out of the Abraham Stallion Survey, Ab- stract No. 1396; T. 0. Moody Survey, Abstract No. 1069; J. W. Oxford Survey, Abstract No. 1201; B.B.B. & C. RR Survey, Abstract No. 219, and C. K. Gleason Survey, Abstract No. 559 and more particularly described as follows: BEGINNING at a point in the present City of Fort Worth City Limit Line said point being in the east line of Dr. Harris Road (County Road 1012) and the south line of Old (Weatherford Road (County Road 1022): THENCE west with the south line of Old Weatherford Road (County Road 1022) to a point, said point being at the intersection of said County Road 1022 and the west line of County Road 1041; THENCE at a bearing of north 300 west to a point in the north right - of -way line of County Road 1022; THENCE at a bearing of north 600 east to a point in the east line of the Nathaniel Holbrook Survey; THENCE north with the survey line said line also being the west line of the Abraham Stallions Survey and the east line of the J. D. Farmer and the J. McHorse Surveys to a Point, said point being the northeast corner of the J. McHorse Survey and the northwest corner of the Abraham Stallions Survey; THENCE east with said survey line and merging with the south right -of- way line of White Settlement Road to a point in the east line of Dr. Harris Road (County Road 1012) said point being in the present City of Fort Worth City Limit Line; THENCE south with said east line of Dr. Harris Road (County Road 1012) and the present City of Fort Worth City Limit Line to the point of beginning and containing approximately 1.43 square miles. SECTION 2. The above described territory and the area annexed shall be a part of the City of Fort Worth, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied by the City of Fort Worth, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Fort Worth, Texas. - 2 - SECTION 3. That this ordinance shall and does hereby amend every prior ordinance in conflict herewith, but as to all other ordinances or sections of ordinances not in direct conflict herewith this ordinance shall be and is hereby made cumulative. SECTION 4. If any section, subsection, clause, sentence, phrase, or word of this ordinance is for any reason held void or unconstitutional, by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining sections, subsections, clauses, sentences, phrases, or words except as the same are inseparable from and indispensable to the remaining portions of the ordinance. SECTION 5. This ordinance shall be in full force and effect from and after the date of its passage on first reading and publication and its passage on second reading as provided for in Section 40 of Chapter XXVIII of the Charter of the City of Fort Worth and it is so ordained.
