HomeMy WebLinkAboutOrdinance 6592ORDINANCE N0; - AN ORDINANCE FIXING THE BOUNDARY LIMITS OF THE CITY OF FORT WORTH; PROVIDING FOR ALTERATION OF THE BOUNDARY LIMITS OF THE CITY OF FORT WORTH; DISCONTINUING TERRITORY FROM.WITH- IN THE CORPORATE LIMITS OF THE CITY OF FORT WORTH; PROVIDING THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT HEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT; PROVIDING FOR SEVERABILITY AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS. SECTION I. THAT the hereinafter described territory within the corporate limits of the City of Fort Worth be and the same is hereby discontinued as a part of the City of Fort Worth; said territory being described by metes and bounds as follows: BEING portions of the A. J. Huitt Survey, Abstract No. 709 and the W. G. Matthews Survey, Abstract No. 1052, situated about 16 miles northeasterly from the Courthouse of Tarrant County, Texas and being more particularly described by metes and bounds as follows: BEGINNING at a point for corner in the Fort Worth and Euless common city limit line, said point for corner also being in the north line of the A. J. Huitt Survey, Abstract No. 709, a distance of 1,230 feet, more or less, from its northeast corner, said point for corner also being in the east line of pavement of a proposed arterial street as shown on Texas Highway Department Preliminary Plan dated May 26, 19700 THENCE South, along and with the.east line of pavement of said proposed arterial street 100 feet, more or less, to a point for corner at its intersection with the south right -of -way line of State Kighway. No. 183. THENCE West, along and with the south right -of -way line of State Highway No. 183 a distance of 1,050 feet, more or less, to a point for corner at its.intersection with the east right -of -way line of Huntington Drive. THENCE South and Southeasterly, along and with the east right -of -way line of Huntington Drive, 300 feet, more or less, to a point for corner at its intersection with the middle of a natural surface drain flowing southeasterly. THENCE in a generally southeasterly direction, down the middle of the natural surface drain with its meanders 1,350 feet, more or less, to a point for corner at its intersection with the northerly line of a 50 feet wide drainage and utility easement adjacent to Lots 10, 11 and 12 in Block 9, and Lots 18, 19, and 20 in Block 13 of Huntington Place Addition. THENCE Northeasterly to the northeast corner of said easement. THENCE Southeasterly, along and with the easterly line of said easement to its southeast corner. THENCE Westerly, along ng and with the southerly line of said ease- ment to a point for corner at its intersection with the middle of the natural surface drain flowing Southeasterly. THENCE in a generally southeasterly direction, down the middle of the natural surface drain, with its meanders, 800 feet, more or less, to its confluence with a natural surface drain running generally northwesterly-. THENCE up the middle of said natural surface drain, with its meanders, approximately 1,000 feet to a point for corner at its inter- section with the south line of Block 14 of Huntington Place Addition. THENCE West, along and with the south line of Block 14 of Huntington Place Addition 300 feet, more or less, to a point for corner in the east right -of -way line of Delphia Lane produced North. THENCE South, to and along the east right-of-way line of Delphia Lane 2,600 feet, more or less, to a point for* corner at its intersection with the northerly right-of-way line of Terminal Pipe Line Road (County Road No. 3005). THENCE Southwesterly and Westerly, along and with the northerly right -of -way line of Terminal Pipe Line Road (County Road No. 3005) to a point for corner at its intersection with the Fort Worth and Euless common city limit line, said point for corner being in the south line of Lot 6 of J. E. Whitner Estates Addition and 67 feet West from its southeast corner. THENCE, along and with. the Fort Worth and Euless common city limit line: North along and with a line parallel to and 67 feet west from the east lines of Lots 6 and 27 of.J.,E. Whitner Estates to a point for corner in the north line of Lot 27, in the south right-of-way line of Whittier Drive, and continuing north to a point for corner in the north right-of-way line of Whitner Drive, and continuing North and in all 2,650 feet to a point for corner in the North line of the W. G. Matthews Survey, Abstract No. 1052, and East, to and along the South line of Block 10 of Oak Crest Estates Addition to a point for corner at the Southwest corner of Lot 14-R in said Block 10, and Northeasterly, along and with the westerly line of Lot 14-R and along and with said line produced across Keon Lane to the southwest corner of Lot 16-R-1 in Block 9, and Northerly, along and with the westerly lines of Lot 16-R-1 and 5-R-1, and along said line produced across Atkerson Lanes to the south- east corner of Lot 19-R in Block 8, and Northwesterly along and with the Westerly lines of Lots 19-R and 8-R in Block 8 to the northwest corner of Lot 8-R, and Northerly, across Huitt Lane to the Southwest corner of Lot 18, in Block 7, and Northeasterly along and with the westerly lines of Lots 18 and 9 in Block 7 to the northwest corner of Lot 9, and Northerly across Slaughter Lane to the southwest corner of Lot 13 in Block 6, and Northwesterly, along and with the westerly line of Lot 13 to its- northwest corner, and Easterly along and with the northerly lines of Lot 13, 14, 15 and 1, in Block 6 to the north corner of Lot 1 in the westerly right -of -way line of John Vernon Lane, and Northwesterly along and with the right -of -way line of John Vernon Lane to the westerly line of Lot 20 -R in Block 5 produced southwesterly and Northeasterly to and along and with the westerly line of Lot 20 -R to its northwest corner in the south line of Lot 4 -R, and West, along and with the south line of Lot 4 -R to its south- west corner, and North along and with the west line of Lot 4 -R to its north - west corner in the south line of Martin Lane, and Northeasterly across Martin Lane to the southwest corner of Lot 21 -•R in Block 4, and North along and with the west line of Lot 21 -R to its north - west corner in the south line of Ldt 6, and West along and with the south line of Lot 6, to its south - west corner, and North along and with the west line of Lot 6 to its north - Ntrst corner to the south line of Alexander Lane, and Northerly across Alexander Lane to the southwest corner of Lot 6 -R in Block 1, and North along and with the west line of Lot 6 -R to its north- west corner in the north line of Block 1 of Oak Crest Estates Addition, and West 21 feet along and with the north line of Block 1 of Oak Crest Estates, and North 486.8 feet to a point for corner in the south right - of -way line of State Highway No. 183. THENCE east 2,075 feet, more or less, to the place of beginning and containing approximately 180 acres of land. SECTION II THAT this ordinance shall and does amend every prior ordinance in conflict herewith, but as to all other ordinances or sections of ordinances not in direct conflict herewith this ordinance shall be and is hereby made cumulative. SECTION III THAT if any section, subsection, clause, sentence, phrase or word of this ordinance is for any reason held void or unconstitutional, by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining sections, subsections, clauses, sentences, phrases or words except as the same are inseperable from and indis- pensable to the remaining portions of the ordinance. SECTION IV THAT this ordinance shall become effective and shall be in full force and effect from and after its passage and it is so ordained. The problem was compounded when Oak JCrest Estates and Huntington Place, both residential additions, began to develop with some lots in Fort Worth and some in Euless. Many letters from residents have been received requesting the area be deleted from Fort Worth. A preliminary agreement has been reached for a boundary ad- justment which includes the release of Oak Crest Estates and Huntington Place to Euless. Description of Boundary Adjustment It is proposed that Fort Worth release to Euless all of-the platted residen- tial area plus some expansion room,-along with some intervening acreage; and that Euless release right-of-way in the access road complex which will serve the Regional Airport, as shown on the-attached-map. The proposed boundary adjustment is believed to be equitable and desirable in view of the need for residents in the Euless service area to be in Euless and for the approaches to the Regional Airport to be in Fort Worth's jurisdic- tion. The areas involved are: 1. Fort Worth to release to Euless - approximately 180 acres. 2. Euless to release to Fort Worth - approximately 310 acres. Plan Commission Action The Fort Worth City Plan Commission reviewed this proposal at its meeting on Wednesday, November 3, 1971, and recommended that the Fort Worth City Council approve the proposed boundary adjustment. Euless City Council approved the adjustment in principle at its regular meeting of November 9, 1971. Recommendation It is recommended that the City Council 1) approve the proposed-bdund-axy adjustment; and 2) adopt an ordinance discontinuing from Fort Worth the area to be annexed by Euless.
