THIS FIRST AMENDMENT TO STORM WATER FACILITY MAINTENANCE
AGREEMENT (this "First Amendment") is made and entered into by and between D.R. HORTON -
TEXAS, LTD., a Texas limited partnership, acting by and through D.R. Horton, Inc., its authorized agent,
("Landowner") and the City of Fort Worth (the "City").
BACKGROUND
A. The Ranches East, L.P., acting by and through its Authorized Agent, Lost Spurs
Development, Inc., and the City entered into a Storm Water Facility Maintenance Agreement dated
February 19, 2010, recorded as Instrument Number 0210052901 in the Tarrant County Clerk's office (the
"Agreement") respecting obligations of The Ranches East, L.P. (and their successors and assigns) related to
Storm Water Maintenance Facilities to be installed and maintained on portions of the Property (as defined
in the Agreement).
B. D.R. HORTON -TEXAS, LTD., has acquired the Properly, recorded as
Instrument Number 0214177061 in the Tarrant County Clerk's office, and thus is now a party to
the Agreement as a Landowner.
C. The parties desire to modify the Agreement to address design modifications and/or
additional portions of the Facility to be constructed by the Landowner, and to be subject to the Agreement,
as set forth herein.
STATEMENT OF AGREEMENT
NOW, THEREFORE, in consideration of the foregoing premises, the mutual covenants contained
herein, and the following terms and conditions, the parties hereto agree as follows:
1. Defined Terms. All defined terms used herein and not separately defined herein shall
have the meaning set forth in the Agreement.
2. Amendment of Exhibit "B". Exhibit "B" of the original Agreement (the "Original
Plans") is hereby modified and amended to add the plans set forth on Exhibit "B" attached hereto (the
"Supplemental Plans"). To the extent the Original Plans are inconsistent with the Supplemental Plans, the
Original Plans are hereby modified. To the extent of any inconsistency, the Supplemental Plans will

rn 3. Agreement Ratified. Except as amended by this First Amendment, all of the terms,
C7 conditions and provisions of the Agreement shall remain in full force and effect and are ratified and
confirmed.

SUBJECT: Authorize the Execution of a Storm Water Facility Maintenance Agreement with The
Ranches East, L.P., for Property Located in the A.H. Hawkins Survey North of Haslet
Roanoke Road and West of Ridgetop Road at No Expense to the City of Fort Worth
(COUNCIL DISTRICT 2)
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to authorize the execution of a
Storm Water Facility Maintenance Agreement with The Ranches East, L.P., for property located in
the A.H. Hawkins Survey, north of Haslet Roanoke Road and west of Ridgetop Road, at no expense
to the City of Fort Worth.
DISCUSSION:
The Ranches East, L.P., is the owner of approximately 5.2 acres of property upon which it will
construct one detention pond facility (DOE No. 6214). The detention pond will serve the Lost Spurs
Apartments Addition. This facility is necessary to limit storm water run-off generated on the property
to pre -development levels. The facility is also limiting the public runoff from Westport Parkway
between Alta Vista Drive and Haslet Road.
The terms of the Maintenance Agreement assure the proper maintenance of one detention pond
facility by The Ranches East, L.P., at no cost to the City. The facility is located north of Haslet
Roanoke Road and west of Ridgetop Road.
The facility is located in COUNCIL DISTRICT 2, Mapsco 8P.
FISCAL INFORMATION/CERTIFICATION:
The Financial Management Services Director certifies that this action will have no material effect on
City funds.
