AN ORDINANCE VACATING AND EXTINGUISHING NW FOURTH
STREET, SITUATED IN THE A. GOUHENANT SURVEY, ABSTRACT
NO. 582, CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, AS
RECORDED IN VOLUMES 63, PAGE 149, PLAT RECORDS, TARRANT
COUNTY, TEXAS, AND CONTAINING APPROXIMATELY 750 SQUARE
FEET OF LAND MORE OR LESS; PROVIDING FOR REVERSION OF
FEE IN SAID LAND; PROVIDING THAT THE CITY SHALL RETAIN
ALL EXISTING UTILITIES EASEMENTS; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a portion of NW Fourth Street situated in the A. Gouhenant Survey, Abstract No.
582, City of Fort Worth, Tarrant County, Texas, as recorded in Volumes 63, Page 149 of the Plat
Records of Tarrant County, Texas and containing 750 square feet of land more or less, and as
more specifically described in Exhibits A attached hereto and incorporated herein by reference
be and the same is vacated and extinguished.
SECTION 2.
That the easement to the land in the above-described vacated alley right-of-way is hereby
released and shall revert to the adjacent owner as provided by law.
SECTION 3.
All existing utility easements be shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.

That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

LEGAL DESCRIPTION
BEING a tract of land situated in the A. Gouhenant Survey, Abstract No. 582, City of Fort Worth, Tarrant
County, Texas and being part of Fourth Street, according to the plat of North Fort Worth Addition, an
addition to the City of Fort Worth, Texas recorded in Volume 63, Page 149, Plat Records of Tarrant
County, Texas and being more particularly described as follows:
BEGINNING at a 5/8" iron rod with plastic cap stamped "Transystems" found at the intersection of the
southwest right-of-way line of Main Street (a 100-foot wide right-of-way) and the southeast right-of-way line
of NW. Fourth Street (a 60-foot wide right-of-way);
THENCE with said southeast right-of-way line, South 59'58'03" West, a distance of 250.00 feet to a cotton
spindle found at the westernmost corner of a 3.446 acre tract of land described in Special Warranty Deed
to Tarrant Regional Water District, recorded in Instrument No. D214076713, Official Public Records of
Tarrant County, Texas;
THENCE departing said southeast right-of-way line, the following courses and distances to wit:
North 30'02'16" West, a distance of 3.00 feet to a 5/8" iron rod with plastic cap stamped "KHA" set for
corner;
North 59'58'03" East, a distance of 250.00 feet to a 5/8" iron rod with plastic cap stamped "KHA" set
for corner;
South 30004'36" East, a distance of 3.00 feet to the POINT OF BEGINNING and containing 750
square feet or 0.0172 acres of land.
Bearing system based on the Texas Coordinate System of 1983, North Central Zone (4202), North
American Datum of 1983.

SUBJECT
Adopt Ordinance Vacating a Portion of NW Fourth Street to be Replatted with the Adjoining Property for the Encore at Panther Island Multifamily
Development in Trinity Uptown(COUNCIL DISTRICT 9)
RECOMMENDATION:
It is recommended that the City Council:
1.Adopt the attached ordinance vacating a portion of NW Fourth Street to be replatted with the adjoining property for the Encore at Panther Island
multifamily development in Trinity Uptown;and
2.Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
Kimley-Horn and Associates,on behalf of Encore-Multifamily, LLC,has requested vacation of this street to be replatted with the adjoining property
for a multifamily development in Trinity Uptown.The City Plan Commission recommended approval of this request at its meeting on February 22,
2017.An acceptable final plat(FS-20-076)has been received in accordance with the Subdivision Ordinance.
The City of Fort Worth(City)originally obtained the above mentioned right-of-way through plat dedication.The City does not own any fee interest in
the rights-of-way or own any property adjacent to the right-of-way and did not expend any City funds to purchase the right-of-way easement.In
accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6,2007,Mayor and
Council Communication(M&C G-15624),staff recommends waiving the fair market value or any portion thereof of purchase price of this right-of-
way easement for the street.
This project is located in COUNCIL DISTRICT 9
A Form 1295 is not required because:This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no material effect on City funds.
