AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE
WATER AND SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $693,138.00,
TRANSFERRED FROM AVAILABLE FUNDS IN THE WATER AND SEWER FUND, FOR
THE PURPOSE OF FUNDING THE WATER AND SANITARY SEWER REPLACEMENT
CONTRACT 2019, WSM-G LAKESIDE CCN PROJECT; PROVIDING FOR A
SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2019-2020 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water
and Sewer Capital Projects Fund in the amount of$693,138.00,transferred from available funds in the Water
and Sewer Fund, for the purpose of funding the Water and Sanitary Sewer Replacement Contract 2019,
WSM-G Lakeside CCN Project.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair
the remaining portions, sections, or parts of sections of this ordinance,which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 23835-09-2019 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Replacement Contract 2019,WSM-G Lakeside CCN Project and Adopt Appropriation Ordinance(COUNCIL DISTRICT 2)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached Appropriation Ordinance increasing receipts and appropriations in the Water and Sewer Capital Projects Fund in the
amount of$693,138.00 transferred from available funds within the Water&Sewer Fund;and
2. Authorize the execution of an Engineering Agreement with Burgess&Niple, Inc.,in the amount of$322,000.00 for Water and Sanitary Sewer
Replacement Contract 2019,WSM-G Lakeside CCN project(City Project No. 102303).
DISCUSSION:
On September 27,2016,(M&C L-15954),the City Council authorized the settlement of an annexation lawsuit entitled City of Fort Worth,Texas v.
Town of Lakeside.As part of this settlement agreement,certain areas presently within the Town of Lakeside's water Certificate of Convenience
and Necessity(CCN)will be transferred to the City of Fort Worth five years after execution of the settlement agreement,which occurred in October
2016.This M&C is to authorize the preparation of plans and specifications for the installation of water and/or sanitary sewer mains to provide
service to those water CCN areas subject to transfer to Fort Worth, including properties along the following streets:

In addition to the contract amount,$371,138.00(Water:$206,688.00;Sewer:$164,450.00)is required for project management, real property
acquisition,utility coordination and material testing.
This project will have no impact on the Water Department's operating budget when completed. Design is expected to start in April 2020 and be
completed by April 2021.

M/WBE OFFICE: Burgess&Niple, Inc.,is in compliance with the City's BDE Ordinance by committing to 32 percent SBE participation on this
project.The City's SBE goal on this project is 12 percent.
The project is located in COUNCIL DISTRICT 2.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance,funds
will be available in the Water and Capital Projects(W&S Capital Projects)Fund Contract 2019 WSM-G Lakeside CCN project. Prior to an
expenditure being incurred,the Water Department has the responsibility of verifying the availability of funds.
