HomeMy WebLinkAboutOrdinance 24138-04-2020 Ordinance No. 24138-04-2020 AN ORDINANCE ADJUSTING APPROPRIATIONS IN THE 2018 BOND FUND BY DECREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE 2018 BOND STREET CONSTRUCTION/RECONSTRUCTION/REHABILITATION PROJECT IN THE AMOUNT OF $1,552,670.13, AND INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE 2018 BOND STREET RECONSTRUCTION 1 PROJECT, BY THE SAME AMOUNT, FOR THE PURPOSE OF WATER AND SANITARY SEWER MAIN REPLACEMENTS; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2019-2020 in the Budget of the City Manager, there shall also be and adjustment in appropriations by decreased estimated receipts and appropriations 2018 Bond Street Construction/Reconstruction/Rehabilitation Project in the amount of$1,552,670.13, and increasing the estimated receipts and appropriations in the 2018 Bond Street Reconstruction 1 Project, by the same amount, for the purpose of water and sanitary sewer main replacements. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion orjudgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance,which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 23835-09-2019 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. City of Fort Worth,Texas Mayor and Council Communication DATE: 04/07/20 M&C FILE NUMBER: M&C 20-0227 LOG NAME: 202018CIPY1 C1 P2-MCCLENDON SUBJECT Authorize Execution of a Contract with McClendon Construction Company, Inc.,in the Amount of$2,488,458.13 for Combined Street Paving Improvements and Water and Sanitary Sewer Main Replacements for 2018 Bond Street Reconstruction Contract 1, Part 2 Project, Located on Kimbo Road, McComas Road and Alta View Street,Adopt Appropriation Ordinances,and Update the FY 2020-2024 CIP(COUNCIL DISTRICT 4) RECOMMENDATION: It is recommended that the City Council: 1. Adopt the attached appropriation ordinance increasing appropriations in the Water and Sewer Capital Projects Fund in the amount of $1,370,915.00 transferred from available funds within the Water&Sewer Fund; 2. Adopt the attached Appropriation Ordinance adjusting appropriations in the 2018 Bond Street Reconstruction Contract 1, Part 2 Project,in the amount of$1,552,670.13 and reducing appropriations in the Street Construction/Reconstruction/Rehabilitation Programmable Project (City Project No. P80001)by the same amount;and 3. Authorize execution of a contract with McClendon Construction Company, Inc., in the amount of$2,488,458.13 for Combined Street Paving Improvements and Water and Sanitary Sewer Main Replacements for 2018 Bond Street Reconstruction Contract 1, Part 2 project(City Project No. 101119). DISCUSSION: This Mayor and Council Communication(M&C)is to authorize a construction contract for water and/or sanitary sewer and paving improvements on approximately 1.24 lane miles for the 2018 Bond Street Reconstruction Contract 1, Part 2 on the following streets: Street From To Kimbo Road Mesquite Road NE Cul-De-Sac McComas Road Kimbo Road N. Beach Street Alta View Street Kimbo Road Premier Street The Transportation and Public Works Department's share on this contract is$1,308,613.13. Funds for this project are included in the 2018 Bond Program.Available resources within the General Fund will be used to provide interim financing until debt is issued.Once debt associated with the project is sold, bond proceeds will reimburse the General Fund in accordance with the statement expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election(Ordinance No.23209-05-2018)and subsequent actions taken by the Mayor and Council. The Water Department's share on this contract of$1,179,845.00 will be available in the Water and Sewer Capital Projects Fund of the project (City Project No. 101119). The project was advertised for bid on December 12,2019 and December 19,2019 in the Fort Worth Star—Telegram.On January 30,2020,the following bids were received: Bidder Amount Time of Completion McClendon Construction Company, Inc. $2,488,458.13 275 Calendar Days Stabile&Winn, Inc. $2,527,094.00] 7 i n n i FNH Construction, LLC $3,359,867.35 In addition to the contract amount,$310,704.00(Water:$71,740.00,Sewer:$60,338.00,TPW:$178,626.00)is required for project management, material testing and inspection and$124,423.00(Water:$32,081.00, Sewer:$26,911.00,TPW:$65,431.00)is provided for project contingencies. This project will have no impact on the Transportation&Public Works operating budget nor on the Water Department's operating budget when completed.Construction is expected to start in June 2020 and be completed by March 2021. The sanitary sewer component of this project is part of the Water Department's Sanitary Sewer Overflow Initiative Program. M/ BE OFFICE—McClendon Construction Company, Inc.is in compliance with the City's BDE Ordinance by committing to 5 percent MBE participation and documenting good faith effort. McClendon Construction Company, Inc.identified several subcontracting and supplier opportunities. However,the firms contacted in the areas identified did not respond or did not submit the lowest bids.The City's MBE goal on this project is 15 percent. The 2018 Bond Program funding was included in the 2020-2024 Capital Improvement Plan for project P130001. In order to administratively track the spending of all funding sources in one project,appropriation ordinances are needed to move appropriations from the programmable project to the jointly funded static project.This action will update the 2020-2024 Capital Improvement Plan. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that funds are available in the current operating budget of the Water&Sewer Fund,and upon approval of the above recommendations and adoption of the attached appropriation ordinances,funds will be available in the current capital budgets,as appropriated, in the Water and Sewer Capital Projects Fund and 2018 Bond Program Fund. Prior to any expenditure being incurred,the Transportation&Public Works and Water Department have the responsibility to validate the availability of funds.
