HomeMy WebLinkAboutOrdinance 24146-04-2020 Ordinance No. 24146-04-2020 AN ORDINANCE INCREASING ESTIMATED RECEIPTS IN THE SOLID WASTE FUND, IN THE AMOUNT OF$21,464.00,AND DECREASING THE USE OF NET POSITION BY THE SAME AMOUNT, FOR THE INSTALLATION AND MAINTENANCE OF THE LAKE ARLINGTON SEWER LIFT STATION, FORCE MAIN,AND GRAVITY SEWER LINES 3.49 ACRES OF LAND AT THE CITY OF FORT WORTH SOUTHEAST LANDFILL ADDITION PROPERTY; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2019-2020 in the Budget of the City Manager, there shall also be increased estimated receipts in the Solid Waste Fund in the amount of$21,464.00, and a decrease in the use of net position by the same amount,for the purpose of the installation and maintenance of the Lake Arlington sewer lift station, force main, and gravity sewer lines on 3.49 acres of land at the City of Fort Worth Southeast Landfill Addition property. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 23392-09-2019 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. DISCUSSION: During wet weather events,the Village Creek wastewater collection system has experienced sanitary sewer overflows.Furthermore,the upstream population growth within the Cities of Fort Worth, Burleson,and Crowley will further exacerbate capacity limitations within the existing wastewater collection system.In response,the City has initiated numerous projects to install parallel relief sewer lines within the Village Creek basin. In order to increase the sewer system capacity along the west shore of Lake Arlington,the City proposes to install a sanitary sewer lift station,located at the city-owned Southeast Landfill Addition,and approximately 40,000 linear feet of force main that would convey peak flows to existing wastewater collection lines located north of Lake Arlington.This project is included in the City's Sanitary Sewer Overflow Agreement with the Texas Commission on Environmental Quality. On January 30,2018,(M&C C-28566),the City Council authorized an engineering agreement to prepare plans and specifications for the Lake Arlington Lift Station and Force Main.As part of that work,the Water Department staff met with staff from the Code Compliance Department to request permission to locate the proposed lift station on the Southeast Landfill Addition property,in an area of the property that would not interfere with existing or proposed waste disposal activities.In order to compensate the Solid Waste Fund for the use of the property,the original purchase price of the property on a per acre basis was escalated by 4%per year to arrive at a present worth price per acre of$6,150.00.The Water Department will need approximately 3.49 acres of land within the Southeast Landfill Addition to install and maintain the proposed lift station,force main,and gravity main necessary to increase the wastewater collection system capacity to meet existing and future wastewater flows.To compensate the Solid Waste Fund for the use of the property,$21,464.00 will be transferred from the Water&Sewer Capital Projects 2018 Fund to the Solid Waste Fund. This project is located in COUNCIL DISTRICT 5. A Form 1295 is not required because:This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that funds are available in the Water&Sewer Capital Projects 2018 Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance,funds will be available in the current operating budget in the Solid Waste Fund.
