AGREEMENT
TO POSTPONE ANNEXATON
This Agreement to Postpo e Annexation (this "Agreement") is made and entered into
this day of , , 2010, by and between the City of
Fort Worth, a home rule municipal corporation situated in Tarrant, Denton, Wise and
Parker Counties, Texas (hereinafter referred to as "City") acting by and through its duly
authorized City Manager, and the property owners who have executed this Agreement as
identified below. ("Owners")
WHEREAS, Area Nine consists of approximately 145 acres of land located in
Tarrant County, located generally east of Willow Springs Road and south of Avondale -
Haslet Road as described in the attached Exhibit "A" (the "Area"); and
WHEREAS, the Area is situated within the extraterritorial jurisdiction of the City
of Fort Worth, completely surrounded by land previously annexed for full purposes and
currently contains single-family and agricultural uses, as well as one commercial use and
vacant land; and
WHEREAS, on February 22, 2005, (M&C G-14691) the City Council adopted
the 2005 Comprehensive Plan containing the annexation program which identified the
Area as an enclave to be considered for full -purpose annexation into the City of Fort
Worth; and
WHEREAS, on April 13, 2010, (M&C PZ-2879) the City Council approved the
timetable for the full -purpose annexation of the Area into the City of Fort Worth; and
WHEREAS, public hearings concerning the annexation request were held as
required by State law on June 8, 2010 and June 15, 2010; and
WHEREAS, on July 13, 2010, the City Council approved Mayor and Council
Communication PZ-2896 instituting the annexation of the Area, but delaying adoption of
an ordinance for final annexation in order to allow the City staff to continue to work with
property owners of the Area during this intervening period to determine the appropriate
timing of final annexation; and
WHEREAS, the Area is eligible for annexation by the City under State law and
the City has complied with all the requirements under State law to annex the area; and
and
WHEREAS, the Owners consists of the majority of the landowners of the Area;
WHEREAS, upon execution of this Agreement by the majority of the landowners
of the Property, the City agrees to postpone annexation of the Area until no earlier than
January 3, 2012 delaying the ad valorem taxes due for in the Area until the

WHEREAS, the Owners agree that if the Agreement is not executed by a
majority of the landowners in the Area, the City may annex the property on October 5,
2010; and
WHEREAS, the City and Owners agree that entering into this Agreement
addresses the goals and objectives of both parties
NOW THEREFORE, for and in consideration of the mutual covenants, promises
and agreements contained herein, the parties agree as follows:
Section 1. Recitals. The "Recitals' set forth in this Agreement are true and
correct, foam the basis upon which the parties have entered into this Agreement and are
incorporated as part of this Agreement for all purposes.
Section 2. Postponement of Annexation. The City agrees to postpone
annexation of the Area until no earlier than January 3, 2012. The City may annex all or
part of the Area at any time on or after January 3, 2012, in the City's sole discretion.
Section 3. Recording. This Agreement shall be recorded in the City
Secretary's Office and the City shall execute an Intent to Annex which shall provide
notice of the City's intent to annex the Area and shall be recorded in the applicable
county deed records.
Section 4. Waiver of Annexation. Owners hereby waive any claims or causes
of action to compel disannexation of the Area.
Section 5. Severability. Invalidation of any provision of this Agreement by
judgment or court order shall not invalidate any of the remaining provisions, which shall
remain in full force and effect unless such remaining provisions are part of the invalid
provisions or the invalid provision is necessary to give effect to the remaining provisions.
Section 6. Enforcement. This Agreement may be enforced by Owners or the
City by any proceeding at law or equity. Failure to do so shall not be deemed a waiver to
enforce the provisions of this Agreement thereafter.
Section 7. Applicable Law. No subsequent change in the law regarding
annexation shall affect the enforceability of the Agreement or the City's authority to
annex the Area.
Section 9. Venue THE PARTIES ACNOWLEDGE THAT THIS
AGREEMENT IS PERFORMABLE IN TARRANT COUNTY, TEXAS AND
THEREBY SUBMIT TO THE JURISDICTION OF THE COURT OF TARRANT
COUNTY, TEXAS AND AGREE THAT ANY SUCH COURTS SHALL BE A
PROPER FORUM FOR THE DETERMINATION OF ANY DISPUTE ARISING
HEREUNDER

Section 10. Execution. This Agreement will be separately executed in
individual counterparts, as signed by the City and the Owners identified below, and upon
execution shall constitute one and the same instrument.
Section 11. Amendment. This Agreement may only be amended in writing
upon mutual consent of the parties.
Section 12. Effective Date. This Agreement is effective on jsintr,ah,40apio,
2010.

A parcel of land situated in the C. Boyd Survey, Abstract Number 212, the W. Bramlett
Survey, Abstract Number 227, and the M.E.P.&P. RR Co. Survey#13, Abstract Number
1129, and bounded on the east, west, south, and partially on the north by the present City
Limits, according to that certain annexation of Parcel 2, as described in City of Fort
Worth, Ordinance Number 16704, and partially on the north by the present City Limits,
according to that certain annexation of Tract One, as described in City of Fort Worth,
Ordinance Number 16469, and being more particularly described by metes and bounds as
follows;
BEGINNING: in the present City limits, at the northeast comer of said Tract One, and
being the southeast corner of that certain annexation as described in City of Fort Worth,
Ordinance Number 14888;

RECOMMENDATION
It is recommended that the City Council authorize the City Manager to:
1. Execute an agreement to postpone annexation between the City and multiple property owners for
property located south of Avondale -Haslet Road and east of Willow Springs Road in unincorporated
Tarrant County; and
2. Execute an agreement to postpone annexation between the City and multiple property owners for
property located south of W.J. Boaz Road and west of Old Decatur Road in unincorporated Tarrant
County.
DISCUSSION:
The five-year annexation program identifies Area 9 (AX-10-002) and Area 29 (AX-10-003) for annexation
consideration in 2010. On July 13, 2010, the City Council took action to institute the annexation of these
two enclaves, but did not adopt the annexation ordinance (PZ-2896) The institution of an annexation
acts as a 90-day waiting period. Councilmember Burdette requested that City staff continue to work with
property owners of these areas during this intervening period to determine the appropriate timing of final
annexation.
The property owners in each enclave were offered an agreement to delay the annexation. The
agreement, signed by a majority of property owners, would delay the full -purpose annexation of the
enclaves until no earlier than January 3, 2012. The City may annex all or part of the area at any time on
or after January 3, 2012, at the City's discretion. The agreement to postpone annexation is to be recorded
in the City Secretary s Office The City will execute an Intent to Annex to provide notice of the City's intent
to annex the area and will record the notice in the Tarrant County deed records for each property.
Approximately 144 acres of land in Area 9, located south of Avondale -Haslet Road and east of Willow
Springs Road in Tarrant County, are covered under the agreement to postpone annexation, as shown on
Exhibit A. Thirty-one individual owners and one corporation own the acreage in Fort Worth's
extraterritorial jurisdiction near Avondale -Haslet Road and Willow Springs Road. As of August 31, 2010, a
majority of the property owners had signed their portion of the agreement to postpone annexation.
Also, approximately 152 acres of land in Area 29, located south of W.J. Boaz Road and west of Old
Decatur Road in Tarrant County, had property owners who were offered an agreement to postpone
annexation, as shown on Exhibit B. The land in the Old Decatur Road enclave, or Area 29, is owned by
42 individual owners and two corporations. A majority of the property owners had signed their portion of
the agreement to postpone annexation by the August 31, 2010 deadline.

The attached sample agreement to postpone annexation (Exhibit C) states annexation will be postponed
to no earlier than January 3, 2012, and the City may annex any or all of the area after this
date. Additionally, the owners consent to the jurisdiction of the Tarrant County courts.
All properties in both enclaves are adjacent to COUNCIL DISTRICT 7.
