Home My WebLink AboutContract 41003-A1 (2)CJTV SECRETARY CONTRACT no... � 1 o n_ �- I AMFI MEN T N o . 1 TO CITY SECRETARY CONTRACT h':RE'AS, the City of Fort Worth (CITY) and Wade Trim, Inc., (ENGINEER) made and entered into City Secretary Contract No. 41003, (the CONTRACT) which was authorized by M&C C-24511 on the 5th day of October, 2010 in the amount of $70,117.00; and WHEREAS, the CONTRACT involves engineering services for the following project: Lochwood Court Drainage Improvements, Project No. 01069; and WHEREAS, it has become necessary to execute Amendment No. 1 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated December 13, 2011, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $20, 027 . 00 . 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $90,144.00. 3. We have identified the additional scope items necessary to complete this project. The additional work includes: • Task 10 1 - Obtain additional survey for areas now included within the project area. • Task 10.2 - Design of approximately 25 linear feet of a two (2) foot tall wall • Task 10.3 Design of approximately 210 linear feet of a two (2) foot tall berm • Task 10.4 - Design of a permanent alternate golf course tee box • Task 10.5 - Design of approximately 20,000 square feet grading plan • Task 10.6 - Coordination with golf course on construction issues and privately owned water system • Task 10.7 - Modification to specifications • Task 10.8 - Schedule, Meeting and Reports In accordance with our contract, Article V, Section K of the STANDARD AGREEMENT FOR ENGINEERING SERVICES, Wade Trim, Inc. requests an equitable adjustment to our contract to account for the additional cost and tiine required to perform the City's requested additional services. The proposed man hour breakdown for the additional services is attached. The proposed $20,027.00 fee for these services was determined based on the time estimated to complete the additional scope of services, utilizing the same hourly rates as our original contract. Wade Trim, Inc. respectfully requests an additional 60 days to complete the project. The ENGINEER shall be compensated a total lump sum fee of $20 027.00 as summarized in Exhibit "B-2" Payment of the total lump sum fee shall be considered full compensation for the services described in Attachment A for all labor materials, supplies, and equipment necessary to complete the project. b. The ENGINEER shall be paid monthly payments as described in Exhibit B-1 Section 1 - Method of Payment. 2. Schedule The schedule will be modified to allow an additional 60 day to complete the design services. ISO 9001:2000 Registered ATTACHMENT B-1 - Amendment No. 01 METHOD OF PAYMENT (Supplement to Attachment B) Design Services for Lochwood Court Drainage Improvements City Project No. 01069 Method of Payment P artial payment shall be made to the ENGINEER monthly upon City s approval of an invoice from the ENGINEER outlining the estimated current percent complete of the total project. The aggregate of such monthly partial fee payments shall not exceed the following: Until satisfactory completion of Conceptual Engineering plan submittal and approval by the City, a sum not to exceed 30 percent of the total lump sum fee less surveying and construction services. U ntil satisfactory completion of Preliminary Construction Plan submittal and approval by the City a sum not to exceed 60 percent of the total lump sum fee, less previous payments and less surveying and construction services. U ntil satisfactory completion of Final Construction plan submittal and approval by the City, a sum not to exceed 90 percent of the total lump sum fee, less previous payments and less surveying and construction services. The balance of the earnings, less previous payments and less surveying and construction services, shall be payable after Bid opening for the Project has been conducted. S urveying and construction services shall be paid after services are rendered. II. Progress Reports The ENGINEER shall submit to the designated representative of the Director of the Department of Transportation and Public Works monthly progress reports covering all phases of design in the format required by the City.
