HomeMy WebLinkAboutContract 52483-A1 AMENDMENT No.1 CSC No. 52483-A1 TO CITY SECRETARY CONTRACT No. 52483 WHEREAS, the City of Fort Worth (CITY) and Halff Associates, Inc. , (ENGINEER) , made and entered into City Secretary Contract No. 52483, (the CONTRACT) , which was authorized by M&C No. C-29147 on the 11 day of June, 2019 in the amount of $ 930, 000. 00 (Nine hundred and Thirty Thousand Dollars) ; and WHEREAS, the CONTRACT involves engineering services for the following project: CentrePort Trail Phase I and Phase II Project; and WHEREAS, it has become necessary to execute Amendment No. 1 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1 . Article I of the CONTRACT is amended to include the additional engineering services specified in a scope of services proposal, a copy of which is attached hereto and incorporated herein (Attachment A) . The cost to City for the additional design services to be performed by Engineer totals $27,000. 00 (see attached Funding Breakdown Sheet, page 3) . 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $957,000. 00. 3. All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. EXECUTED and EFFECTIVE as of the date last written by a signatory, below. (214)346-6200 Fax(214)739-0095 ADDITIONAL SERVICES CONFIRMATION To: Jing Yang Date: June 11, 2020 From: Laura Johnson AVO: 34838.001 Email: LJohnson@halff.com Project: CentrePort Phase I VIA: email The City of Fort Worth (CLIENT) has asked Halff Associates (CONSULTANT) to prepare construction documentation services and design services for CentrePort Trail Phase I beyond the services provided in the agreement dated July 2, 2019. The scope of services provided below are a continuation of the scope of services stated in the Standard Form of Agreement dated July 2, 2019. The specific services provided as part of this amendment are as follows: Additional Services Regarding Phase I, an archeological survey is recommended and is not currently included in our scope. TxDOT Environmental has concurred with the recommendation of doing the archeological survey. Per our scope of work, Halff is tasked with completing an Archeological Background Study (ABS) in accordance with Section 106 of the National Historic Preservation Act,Texas Antiquities Code, and the Health and Safety Code. Before the ABS can be submitted to TxDOT, our licensed archeologist conducts the background study based on desktop resources and the proposed design, then presents a recommendation on any further work needed. The report is then submitted for TxDOT's review and comment/concurrence. Because this was submitted through the TxDOT Dropbox, I have attached the background study for your reference. A survey that includes shovel testing only was recommended in the areas as shown in the Archeological Background Study (see Figure 7) for the following reasons: • There are previously identified archeological sites within the project area. • Based on a review of FEMA floodplain and TxDOT Potential Archeological Liability data, Holocene-age deposits are likely to occur within the project area (see Figures 3 and 4 in the ABS). These are present where the project area intersects or parallels alluvial terraces of natural waterways. • A historically reliable water source, the West Fork Trinity River, is within 500 feet of the project area. Three associated tributaries cross the project area. • The USGS topographic map indicates the project area south of the Trinity Railway Express contains uplands overlooking a perennial waterway which is considered a landform with high potential for human occupation. • The areas of high potential have not been previously surveyed. • These portions proposed for surveying have either a high or moderate potential for Holocene-age deposits (see Figure 3 in the ABS). As mentioned, due to the nature of the construction activities taking place, only an evaluation for shallow deposits using shovel testing is recommended. The specific geotechnical services provided as part of this amendment are as follows: Additional Services I. Access to remaining borings A. All the Phase I borings have been drilled by Alliance Geotechnical Group (AGG)except for seven borings, RW-10 thru RW-16. Due to heavy spring rains,ATV tracking and multiple repairs to the rock dam creek crossing, borings RW-11 thru RW16 will require access through DART/TRE's parking lot and required a track mounted drilling rig. The path that AGG had been using for the other Phase I borings cannot be accessed even with a lightly loaded track due to very soft and wet conditions. AGG had to repair a rock dam creek crossing several times. To access to the remaining borings through the DART/TRE parking lot, AGG will remove one metal beam guard rail post and rail in order to gain access. They will temporarily hang the guard rail in place during the field work and when they are finished with their work, they will put the post and guard rail back in place. II. Stability Analyses A. When AGG developed the proposal for the CentrePort Phase I investigation, they knew about the short retaining walls but did not know about the steep embankment slopes beyond the short walls. Therefore, they did not include any direct shear and/or CU Triaxial testing (which are required for stability analyses). They did not include time for slope stability analyses in the original scope of services. Based upon the current plans, AGG recommends that slope stability analyses be performed for a few of the retaining wall conditions. To perform these additional services, Halff is requesting a lump sum fee of$13,000.00 for Halff's coordination with Alliance Geotechnical Services and the geotechnical work by AGG.
