ADVANCE FUNDING AGREEMENT
AMENDMENT #1
Off System
THIS AMENDMENT is made by and between the State of Texas, acting through the Texas
Department of Transportation, called the State and the City of Fort Worth, acting by and through its
duly authorized officials, called the Local Government.
WITNESSETH
WHEREAS, the State and the Local Government executed a contract on September 15, of 2010 to
effectuate their agreement to review plans for a 4-lane divided arterial street (Hemphill Street) from
Lancaster Avenue to Vickery Boulevard with storm drains, railroad bridge, and crossing under
existing IH 30 bridges; and,
WHEREAS, the scope of work has been expanded to include construction oversight with particular
concern to the street that crosses under State right of way that involves retaining walls within the
State right of way; and,
WHEREAS, it has become necessary to amend that contract;
NOW THEREFORE, in consideration of the premises and of the mutual covenants and agreements
of the parties, the State and the Local Government do agree as follows:
AGREEMENT
1. Description of Amended Items
The scope is amended to add construction oversight for the portion of the project where the
street crosses under State right of way and retaining walls are added within the State right of
way.
Attachment A, Payment Provision and Work Responsibilities, of the original agreement is
deleted in its entirety, and replaced with Attachment A-1, Payment Provision and Work
Responsibilities, which is attached to and made a part of this agreement.

Article 8. Inspection and Conduct of Work is revised to add the following. For projects on the
state highway system, the design shall, at a minimum conform to applicable State manuals.
For projects not on the state highway system, the design shall, at a minimum, conform to
applicable American Association of State Highway and Transportation Officials design
standards. In procuring professional services, the parties to this agreement must comply with
federal requirements cited in 23 CFR Part 172 if the project is federally funded and with Texas
Government Code 2254, Subchapter A, in all cases. Professional contracts for federally
funded projects must conform to federal requirements, spec'fically including the provision for
participation by Disadvantaged Business Enterprises (DBEs), ADA, and environmental
matters.
All other provisions of the original contract are unchanged and remain in full force and effect.
2 Signatory Warranty
Each signatory warrants that the signatory has necessary authority to execute this agreement on
behalf of the entity represented.

Payment Provision and Work Responsibilities
The Local Government will pay for the cost of plan review and construction oversight for a 4-lane
divided arterial street (Hemphill Street) at IH 30. Based on the funding category 3, the Local
Government's participation is 100% of the cost of this particular improvement. The Local
Government's estimated cost of this additional work is $2,020,000.00, including construction items,
and engineering and contingencies. The State has estimated the project to be as follows:
