ASSIGNMENT OF EASEMENT AND RIGHT-OF-WAY
WHEREAS, Martha Davis Harrison, individually; Martha Davis Harrison and
Republic National Bank of Dallas, Trustees of the Shannon Harrison Armstrong Trust;
Martha Davis Harrison, and Republic National Bank of Dallas, Trustees of the Carol
Harrison Holden Trust, as Grantor, executed an Easement and Right -of -Way (Easement)
to Trinity River Authority of Texas, a conservation and reclamation district created by
and functioning under Chapter 518, Acts of the 54th Legislature of the State of Texas,
Regular Session 1955, as amended, pursuant to Article XVI, Section 59 of the Texas
Constitution, with its principal office at 5300 South Collins Street, Arlington, Texas
76108, on March 4, 1980; and
WHEREAS, the Easement was filed May 5, 1980, in Volume 6930 at page 481 of
the Deed Records of Tarrant County, Texas; and
WHEREAS, the Easement granted to Trinity River Authority of Texas an
easement and right-of-way to lay, construct, maintain, operate, repair, replace, change,
add and/or remove a treated water line, or lines, with all incidental equipment and
appurtenances; and
WHEREAS, the Trinity River Authority of Texas desires to transfer a portion of
its right, title and interest in and to the above described Easement to the City of Fort
Worth, a municipal corporation ("City") and the City desires to accept such assignment.

NOW, THEREFORE, for and in consideration of Ten Dollars ($10.00) and other
good and valuable consideration, the receipt and sufficiency of which is acknowledged,
Trinity River Authority of Texas does hereby assign, transfer and convey to the City, its
successors and assigns, a portion of its right, title and interest in and to the Easement, as
described in Exhibit A, provided however, that the Trinity River Authority of Texas will
retain responsibility for indemnification of the Grantor as described in paragraph 6 of the
Easement filed in Volume 6930, Page 481 of the Deed Records of Tarrant County, Texas.

Being a portion of a tract of land described as Tract Five to HC LOBF Arlington, LLC as recorded under Document
Number D206323409, Deed Records, Tarrant County Texas (DRTCT), a portion of the 20 foot TRA easement as
recorded in Volume 6930, Page 487, also being a portion of an access easement as described to Texas Electric
Service Company as recorded in Volume 2231, Page 593, DRTCT, and being further described by metes and
bounds as follows:
Commencing at a 1/2 inch iron rod found for the Northwest corner of said Tract Five and the Northeast corner of
Block 1, Post Oak Village Addition, an addition to the City of Fort Worth Texas as recorded in Volume 388-144,
Page 66, Plat Records, Tarrant County, Texas (PRTCT), also being in the Southerly right-of-way line of Trinity
Boulevard, a variable width right-of-way;
Thence South 80°28'30"East, along the North line of said Tract Five, 68.87 feet to the Northwest corner of a 20 foot
waterline easement as recorded under Document No. 209043973;
Thence South 00°23'44"West, along the said west line, 971.00 feet to the POINT OF BEGINNING;
Thence South 89°36'16"East, 20.00 feet to the East line of the said 20 foot TRA easement;
Thence South 00°23'44"West, along the said East line, 867.12 feet to the North right-of-way of the THE Railroad as
described by deed to the Cities of Dallas and Fort Worth, as recorded in Volume 7726, Page 1848, DRTCT and a
non tangent curve to the left;
Thence 20.33 feet along said right-of-way and the arc of the said curve to the left through a central angle of
00°06'01", a radius of 11,609.16 feet and a long chord that bears South 80°03'44"West, 20.33 feet to the
Southwest corner of said 20 foot TRA easement;
