I TO COMMUNITY 1�'-} ACILITIES AGREEMENT CITY SECRETARY CONTRACT NO. `-1 I 3 2_% \ WHEREAS, the City of Fort Worth (City) and D.R. Horton - Texas, Ltd. (Developer) entered into Community Facility Agreement, City Secretary Contract No. 41328 wherein Developer is to make certain improvements to Beechwood Creek Phase 3A, 3B an addition within the City; and WHEREAS, it has become necessary to execute Amendment No. 1 to the CFA to reflect additional storm drain improvements at an estimated construction cost of $19,512.50 and as more fully described on Attachment No. 1. NOW THEREFORE, City and Developer, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CFA: A) 1. It must be recognized that any evaluation of work to be performed to construct this project must by necessity be speculative in nature until completion of its actual detailed design. In addition the engineer has no control over the cost of labor material or services to be furnished by others or over market conditions. Accordingly Goodwin & Marshall, Inc. can not guarantee that actual costs will not vary from the opinions expressed herein.
