AMENDMENT No. 1 TO CITY SECRETARY CONTRACT No. 41324 ©0TYSECR/Jt1 crRioUI45Zy1}l WHEREAS, the City of Fort Worth (CITY) and CP&Y, Inc, (ENGINEER) mace and entered into City Secretary Contract No. 41324, (the CONTRACT) which was authorized oy M&C C-24 653 on the 14th day of December, 2010 in the amount of $ 2 92 , 213 . 0 0 ; and WHEREAS, the CONTRACT involves engineering services for the following project: South Holly Hich Service Pump Station Motor and Switchgear Replacement Project; and WHEREAS, it has become necessary to execute Amendment No. 1 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services soecified in a proposal dated May 15, 2013, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $10, 072. 00. 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $ 302, 285. 00. 3. All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. EXECUTED and EFFECTIVE as of the date last written by a signatory, below. Due to unforeseen utility restrictions provided by Oncor towards the end of the design phase, CP&Y had to perform additional efforts during design and construction as described in the attached exhibit A. The fee associated with the additional effort is presented in exhibit Et. Should these arrangements be acceptable to the City, we would like to request a supplemental agreement for the work performed with fee not to exceed $ 10,072 00. B. Tasks and Requirements 1) Additional Design Phase Services. This task includes the efforts associated with additional design work beyond the onginal scope of the Motor and Switchgear Replacement and Electrical Improvements Project. a) Evaluation of the starting kVA of the new motors to assess if the motors started across the line would comply with the new starting requirements, b) Simulation (motor starting study) using SKM power tools to see what reduced voltage solution would be the most appropriate to meet the utility starting requirements. c) Report summarizing results of the above mentioned motor starting study. d) Additional coordination with manufacturers to determine footprints, costs and weights of the new selected equipment e) Modifications to one lines and site plans based on characteristics of new equipment. f) Additional structural design for new outdoor switchgear based on the fact that the new equipment could not fit in the existing electrical room Supplemental Agreement No. I Page 1 of 2 2) Construction Phase Services The scope for this task includes construction phase services related to the Additional Design Phase Services and services related to additional construction concerns. a) Structural review of outdoor switchgear submittal and modification to outdoor switchgear pad based on difference in dimensions b) Review of structural RFIs (qty 1) that were not included as part of the design services. The contractor noticed a low point in the driveway and requested a proposed solution to fix the problem.
