FIRST RENEWAL OF CITY SECRETARY CONTRACT NUMBER 40223 ADOPT -A -PARK AGREEMENT FOR MAINTENANCE AND LANDSCAPING SERVICES This FIRST RENEWAL OF CITY SECRETARY CONTRACT NO. 40223 ("Renewal") is made and entered into by and between the CITY OF FORT WORTH, a home -rule municipal corporation of the State of Texas (hereinafter referred to as "City"), acting by and through its duly authorized Assistant City Manager, and HOMEOWNER'S ASSOCIATION OF TWIN MILL FARMS, INC., a Texas non- profit corporation (hereinafter referred to as the "HOA"), acting by and through its duly authorized President". WHEREAS, on May 17, 2010, City and HOA entered in to an Adopt -A -Park Agreement for Maintenance and Landscaping Services, the same being Fort Worth City Secretary Contract Number 40223 ("Contract"); and WHEREAS, on October , 2010, City and HOA amended the Contract to correct an error and restructure the periods for performance; and WHEREAS, the Contract, as amended, has a two-year primary term from September 6, 2008, through September 5, 2010; and WHEREAS, the Contract provides that the term may be renewed for four additional two-year periods by mutual agreement between the HOA and the City; and WHEREAS, the HOA has notified the City of its desire to renew and extend said Contract for the first two-year renewal period under the same terms and conditions; NOW, THEREFORE, City and HOA agree to renew and extend the Contract as follows: All terms and provisions of the original Contract between the City and the HOA shall remain in full force and effect except as specifically amended herein. The renewal term of this Contract shall be for a period of two (2) years and twenty-five days, beginning September 6, 2010 and ending September 30, 2012. 3. The funding provided by the City pursuant to Sectio, i 2.04(c) for the period The funding provided by the City pursuant to Section 2.04(c) for the period October 1, 2011 through September 30, 2012 remains TO BE DETERMINED but shall be an amount equivalent to the funds authorized by the annual City budget adopted by the Fort Worth City Council for basic grounds maintenance in the Area as would ordinarily be conducted by the Parks and Community Services Department.
