INTERLOCAL AGREEMENT
BACKGROUND
This Interlocal Agreement is between County of Tarrant ("COUNTY"), and the
City of Fort Worth ("Fort Worth") acting through its duly authorized Assistant City
Manager, Fernando Costa.
Sections 791.001 — 791.029 of the Texas Government Code provide legal
authority for this Agreement;
During the performance of the governmental functions and the payment for the
performance of those governmental functions the parties will make the performance and
payment from current revenues legally available to that party; and
The Commissioners Court of the COUNTY and the City Council find:
a. This Agreement serves the common interest of all parties;
b. This Agreement will benefit the public;
c. The division of costs fairly compensates all parties to this Agreement; and
d. All parties have authorized their representative to sign this Agreement.
The Parties therefore agree as follows:
TERMS AND CONDITIONS
1. COUNTY RESPONSIBILITY
1.1 The COUNTY will furnish the labor and equipment necessary for the
reconstruction and resurfacing of Shelby Road from Race Street to 1,585' East
of Rendon Road; being that section exclusively within the City of Fort
Worth's jurisdiction.

1.2 The project will reclaim the existing asphalt pavement, stabilize with 5%
cement, re -grade the roadbed, and resurface with a four inch (4") HMAC
binder course and a two inch (2") HMAC surface.
1.3 The COUNTY will furnish the labor equipment necessary to reconstruct
Shelby Road as described above.
1.4 The COUNTY will coordinate the utility line locations before construction
begins by utilizing Dig Tess or a similar service.

1.5 The COUNTY will monitor and coordinate the maintenance of the Stonii
Water Pollution Prevention Plan.
2. CITY RESPONSIBILITY
2.1 The CITIES agrees to pay one-half of the total cost of the materials for
Shelby Road reconstruction at an estimated cost not to exceed
$168,332.40.
2.2 The CITIES will pay for one-half of the total cost of traffic controls during
the construction phase of the projects at an estimated cost not to exceed
$3,000.00.
2.3 If the Storni Water Pollution Prevention Plan is required, the CITY will
pay for all cost (including subcontractor materials, labor and equipment)
associated with the implementation and maintenance of the Plan at an
estimated cost not to exceed $2,000.
2.4 If required, the CITY of Fort Worth and the CITY of Everman will furnish
all right of way plans, engineering drawings, and specifications to the
COUNTY.
2.5 The CITY of Fort Worth and the CITY of Evennan will coordinate,
negotiate and pay for applicable utility relocation costs if required.
2.6 The CITY will pay the total cost for 2 inches (2") of Type D HMAC and 2
inches (2") of Type B HMAC for the reconstruction of the 1,585 feet East
of Rendon Road creating a total cost of $59, 332.00 for this section.
3. PROCEDURES DURING PROJECT
COUNTY retains the right to inspect and reject all materials provided for this project.
If CITY has a complaint regarding the construction of the project, the CITY must
complain in writing to the COUNTY within 30 days of project completion Upon
expiration of 30 days after project completion the CITY becomes responsible for
maintenance of the project within their respective jurisdiction.
4. NO WAIVER OF IMMUNITY
This agreement does not waive COUNTY rights under a legal theory of sovereign
immunity. This agreement does not waive either City's rights under a legal theory of
sovereign immunity.
5. OPTIONAL SERVICES
5.1 If necessary, COUNTY may furnish flag persons
6. TIME PERIOD FOR COMPLETION
CITY will give the COUNTY notice to proceed at the appropriate time. However,
COUNTY is under no duty to commence construction at any particular time.

Please be advised that Tarrant County Precinct 1 has agreed to limit the cost allocated to the City
of Fort Worth for the reconstruction of Shelby Road. to $179,503.00. This will be the cities total
cost for the project.

RECOMMENDATION:
It is recommended that the City Council authorize the City
Manager to execute an Interlocal Agreement with Tarrant County
for Reconstruction of Shelby Road from Race Street South to
1,585 feet east of Rendon Road with City participation in the
amount of $184,503.00 which includes furnishing necessary
materials, traffic control and other incidentals.
DISCUSSION:
In the Fiscal Year 2010-2011 Contract Major Maintenance
Program, various types of street maintenance techniques are
grouped into specific contract packages including interlocal
agreements with other governmental entities.
At the request of City staff, Tarrant County has agreed to enter into
an Interlocal Agreement for the reconstruction of Shelby Road
from Race Street South to 1,585 feet east of Rendon Road and will
be funded from the Contract Street Maintenance Fund.
Shelby Road is a border street between Fort Worth and City of
Everman. Under the Agreement, Tarrant County will provide all
necessary labor and equipment to perform this work and each City
agrees to pay their share for the cost of materials, traffic controls
and other incidentals. Additionally, the City agrees to closing of
the road to through traffic for the duration of the project or as
deemed necessary by Tarrant County.
This project is located in COUNCIL DISTRICT 8.
FISCAL INFORMATION:
The Financial Management Services Director certifies that funds
are available in the current capital budget, as appropriated, of the
Contract Street Maintenance Fund.
