WHEREAS, the City of Fort Worth (City) and Pulte Homes of Texas, L.P. (Developer) entered into a Community Facilities Agreement, City Secretary Contract No.41854 ("CFA"); and WHEREAS, it has become necessary to execute Amendment No. 1 to the CFA to allow City participation up to an amount of $91,482.72 for the City's portion of costs associated with construction of Horseman Road contemplated by the CFA; and WHEREAS, the City Council authorized execution of Amendment No. 1 to the CFA on the 12th day of June, 2012 via M&C C-25646. The City's participation shall be in an amount up to $91,482.72 but the Participation is not a lump sum amount and may be less depending upon actual quantities and costs. The final cost to Developer and City shall be based upon Unit prices contained in City of Fort Worth Ordinance No. 14552; 2. All other provisions of the CFA, which are not expressly amended herein, shall remain in full force and effect. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the Special Assessments Fund in the amount of $91,482.72; 2. Authorize the transfer in the amount of $91,482.72 from Future Improvements of the Special Assessments Fund to the New Development Fund; 3. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the New Development Fund in the amount of $91,482.72 from available funds; and 4. Authorize execution of Amendment No. 1 to Community Facilities Agreement, City Contract No. 41854, with Pulte Homes of Texas, L.P., in the amount of $91,482.72 for construction of Horseman Road from the north property line of Pulte Homes to White Feather Lane. DISCUSSION: On June 10 2011, Pulte Homes of Texas, L.P. (Developer), executed a Community Facilities Agreement (CFA), City Contract No 41854, with the City of Fort Worth to develop the West Fork Ranch Phase I development. Staff recommends City funding participation of the project to extend Horseman Road approximately 160 linear feet beyond the West Fork Ranch Phase I development to White Feather Lane to provide an additional point of access. The Developer will construct the extension for Horseman Road. Based on construction, inspection and material testing costs, funding in the amount of $91,482.72 is requested for City's participation to extend Horseman Road. Future improvement funds for Horseman Road were paid under the Lasater Addition Phase 1, Section 4 (CFA #2002137). These future improvement funds will be used for City participation. City participation is limited to costs as determined under the Unit Price Ordinance and is within the legal threshold for participation in developer projects. Upon City Council's approval, Staff will execute Amendment No. 1 to CFA, City Contract No. 41854 with Pulte Homes of Texas, L.P., for City of Fort Worth participation. This project is located in COUNCIL DISTRICT 2, Mapsco 35J.
