Because construction contracts were let by developer prior to finalizing the alignment of Horseman Rd north of future Bailey Boswell and prior to the City releasing for construction the final design of the section of Horseman Rd north of the Pulte Parr Tract property line, the contracts had to be reconciled by change order. It is recommended that the City Council: 1. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the Special Assessments Fund in the amount of $91,482.72; 2. Authorize the transfer in the amount of $91,482.72 from Future Improvements of the Special Assessments Fund to the New Development Fund; 3. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the New Development Fund in the amount of $91,482 72 from available funds; and 4. Authorize execution of Amendment No. 1 to Community Facilities Agreement, City Contract No. 41854, with Pulte Homes of Texas, L.P., in the amount of $91,482.72 for construction of Horseman Road from the north property line of Pulte Homes to White Feather Lane. DISCUSSION: On June 10 2011, Pulte Homes of Texas, L.P. (Developer), executed a Community Facilities Agreement (CFA), City Contract No. 41854, with the City of Fort Worth to develop the West Fork Ranch Phase I development. Staff recommends City funding participation of the project to extend Horseman Road approximately 160 linear feet beyond the West Fork Ranch Phase I development to White Feather Lane to provide an additional point of access. The Developer will construct the extension for Horseman Road. Based on construction, inspection and material testing costs, funding in the amount of $91 482.72 is requested for City's participation to extend Horseman Road. Future improvement funds for Horseman Road were paid under the Lasater Addition Phase 1, Section 4 (CFA #2002137). These future improvement funds will be used for City participation. City participation is limited to costs as determined under the Unit Price Ordinance and is within the legal threshold for participation in developer projects. U pon City Council's approval, Staff will execute Amendment No. 1 to CFA, City Contract No 41854 with P ulte Homes of Texas, L.P., for City of Fort Worth participation.
