AMENDMENT No. 1 (0E-CRETARYntql am ©cot TO CITY SNCRETARY CONTRACT WHEREAS, the City of Fort Worth (CITY) and Michael Baker Jr., Inc., (ENGINEER) made and entered into City Secretary Contract No. 41782, (the CONTRACT) which was authorized by M&C C-24852 on the 12th day of April, 2011 in the amount of $167,290.00; and WHEREAS, the CONTRACT involves engineering services for the following project: Westlake Drainage Improvements, Project No. 01073; and WHEREAS, it has become necessary to execute Amendment No. 1 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated December 19, 2011, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $48, 949 . 00 . 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $216,239.00. 3. All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. Worth, TX 76102 RE: Project 01073, Westlake Dr. Drainage Improvements Amendment 1 Dear Mr. Owen: Baker appreciates this opportunity to submit a proposal for professional design services for Amendment 1 regarding the Westlake Drainage Improvements Project. Amendment 1 proposes additional conceptual design services that include the itemized services listed below from Baker and our sub-consultant-Gorrondona & Associates. The primary focus of the amendment is to maximize the capacity of existing drainage systems in the project area, and add up to three new storm systems including smaller systems on South Drive, Barwick St. and Westlake Dr. Baker proposes to focus the new Westlake System on the area from South Drive to an outfall to Stream CF-3A south of Avoca St. The additional work includes analysis and conceptual design for providing overflow capacity on Westlake Finally, the proposal includes adding additional analysis of the South Drive intersections from Westhaven to Westlake, with concentration on the impact of drainage areas west of Channel CF-3A on the proposed downstream storm systems. Storm Water Design Services 1- Provide additional Drainage Analysis and Conceptual Plans for the following systems. Maximize the capacity of existing systems on South Drive at Stieam CF- 3A(including Segura Ct. South), at Gorman Dr, the system rtiming from Belden to South into the easement near Westlake Dr, and the Harlan St. at Westlake System. 2- Redesign a new Barwick System that collects storm water from flows that run north on South Drive to the Westlake Intersection. Design a Westlake System that starts at the South Dr. Intersection running north to an outfall to Stream CF-3A just south of Avoca Street(Lot 8, Block 105). 3- Provide additional analysis and conceptual design for storm water overflows on Westlake to the north. The overflow analysis will study the feasibility of modifying existing street grades on Westlake between Harlan St and Comita St. and then design the direction of the overflows to the Stream or other acceptable outfall. Michael Owen January 18, 2012 4- Provide additional concentrated flow analysis of the intersections on South Drive from Westhaven Dr. to Westlake Dr. This analysis will focus on determining the impact of' drainage areas to the west of Stream CF-3A on the design of the Barwick and Westlake Storm Systems The secondary focus will be proposed intersection work to make sure the field conditions at the intersections are consistent with the drainage design assumptions. This analysis may result in proposed intersection improvements. Subsurface Utility Engineering-OL "B" 1- Provide Level B Subsurface Utility Engineering (SUE) for Westlake from IH 20 to Harlan Avenue, storm sewer system at Gorman and South Drive, and the Stettin Sewer System at Segura Ct. South and South Drive. Additional ROW/Easement Services 1- The attached letter from Gorrondona & Associates provides detailed description of this additional work. The primary products produced include right of way research, 2 new drainage easements, and temporary right of entry documents( 2 estimated). Additional Survey 1- New design survey is needed on Westlake Dr. from Harlan St., and on Lots 7 & 8, Block 105 to provide data to complete conceptual analysis and design. Complete Right of Entry tasks as described in the proposed scope, Baker proposes the above mentioned professional Design, SUE, ROW/Easement, and Survey Service fees as Amendment 1 to the Westlake Project, Project 01073. The Ft. Worth contract number is 41782. Baker proposes adding 10 days to complete the survey work, 40 additional work days to the contract to complete the design work, 15 days for CITY review, and 5 days to schedule the design review meeting Original Fee Amount for Contract 41782- $ 167,290 Proposed Amendment 1 Amount- $ 48,949 Total Proposed Contract Amount- $ 216,239 To meet the WMBE requirements, Baker is providing SUE, Survey and Easement/ROW services through Gorrondona & Associates for a total of $16,440. This is approximately 33 6% of the proposed Amendment #1 total, which exceeds the minimum recommended percentage. Attachment A -Scope for Amendment I Attachment B-Level of Effort Supplement for Amendment 1 ATTACHMENT "A" Scope for Engineering Design Related Services for Amendment 1,Storm Water Improvements Proiects The scope set forth herein defines the work to be performed by the ENGINEER in completing the Amendment 1 work Both the CITY and ENGINEER have attempted to clearly define the work to be performed and address the needs of the Project Amendment. Under this scope, "ENGINEER" is expanded to include any sub -consultant, including surveyor, employed or contracted by the ENGINEER OBJECTIVE An existing storm drain system located in Belden, South Drive, and Westlake does not meet current design standards, sending excess runoff down Westlake Drive causing street and home flooding. The purpose of Amendment.#1 is to complete additional conceptual analysis to maximize the four existing storm systems on South Drive and the one system on Westlake, study adding new storm sewer pipe systems at Barwick and Segura Ct. South, and complete a conceptual analysis of routing a Westlake Storm System from the intersection with South Drive to a point between Comita and Avoca where it would connect to Stream CF-3A through a permanent easement. This amendment involves field survey, right of way/easement services, SUE, data acquisition hydrologic and hydraulic analyses„ construction cost estimating, and preparation of conceptual design documents. CONCEPTUAL DESIGN (30 PERCENT) The additional Conceptual Design shall be submitted to CITY per the approved Project Schedule. The purpose of the conceptual design is for the ENGINEER to identify, develop, communicate through the defined deliverables, and recommend the design concept that successfully addresses the design problem and to obtain the CITY's endorsement of this concept. ENGINEER will develop the conceptual design of the infrastructure as follows. 2.1. Data Collection • In addition to data obtained from the CITY, ENGINEER will research and make efforts to obtain pertinent information to aid in coordination of the proposed improvements with any planned future improvements that may influence the project. ENGINEER will also identify and seek to obtain data for existing conditions that may impact the project including; utilities, agencies (such as TxDOT and railroads), CITY Master Plans, CITY drainage complaint files, existing applicable drainage studies, FEMA floodplain and floodway maps, existing models of project area (if any) and property ownership as available from the Tax Assessor's office. Coordinate with the CITY by utilizing the Design Report from S & B Infrastructure dated July 2010 to obtain the starting Water Surface Elevation for the existing storm sewer systems and the three potential new storm sewer system outfalls to Stream CF-3A. The CITY may provide updated technical information related to Stream CF-3A before the task starts if available. 2.2. Drainage Computations • ENGINEER will delineate the watershed based on contour data and field verification and document existing street, right-of-way and storm drain capacities for the subject site. A drainage area map will be drawn at maximum 1" = 200 scale from available 2-foot contour data with the contours labeled Data source has already been provided by the CITY. Calculations regarding street and right- of-way capacities and design discharges (5-year and 100-year frequencies) at selected critical locations will be provided Capacities of existing storm drain were calculated in the study. The existing systems that outfall to Stream CF-3A at Westhaven & South Dr, at Segura Ct. South at South Drive, at Gorman & South Drive at Belden and South Dr System, and at Harlan at Westlake will be studied and one conceptual design prepared for each existing storm sewer system to improve the capacity of the existing systems for CITY review and approval. The focus of this work is to maximize the effectiveness of the existing storm sewer systems by proposing pipe capacity improvements, inlet improvements, or in the Segura Ct South area, study the potential for providing an an additional pipe system running from the intersection to Stream CF-3A. New storm systems will be conceptually designed for Barwick(South Dr. to CF- 3A), and Westlake(South Dr. to outfall to Stream CF-3A between Comita and Avoca..Ail systems will be compared to current or proposed SUE data to determine utility conflicts with proposed systems. All calculations shall conform to CITY criteria delineated in the CITY's Storm Water Management Design City of Fort Worth, Texas Attachment A PM0 Retease Date: 08/27/2010 Page 3 of 8 Manual, All locations in the project area where 100-year runoff exceeds available storm drain and right -away capacities shall be clearly identified. • The conceptual analysis will also include one conceptual design (no alternates) to modify the current street grades on Westlake between South Drive and Comita, so that some positive overflow can occur to the north on Westlake towards IH 20. The outfall design will be one of two design options; to connect to the existing channel while consider design requirements to be compatible with a new detention pond design if completed in a future separate contract. The proposed storm sewer outfall is currently proposed for Lot 8 , Block 105. The overflow for Westlake Dr. will be directed over the pipe orr some percentage or all of the overflow drainage may be directed to IH 20. The overflow capacity of Westlake will impact the design of the proposed storm sewer proposed for Westlake Dr. The overflow design will add one new paving sheet This proposal requires that the overflow analysis be completed prior to starting the design of the Westlake System to properly coordinate the storm sewer flows with the overflow capacity of Westlake Dr. • Engineer shall evaluate the current intersection designs for South Dr. at Barwick, South Dr. at Westlake, and South Drive from south of Westhaven Dr to Segura Ct. South. Engineer shall complete one conceptual design of improvements(no alternatives) to each of the above intersections to improve the directional flow to match the proposal conceptual design. The Gorman at South Dr intersection is on grade without low points so no analysis will be completed for street improvements. The street improvements proposed may include curb and pavement grades, revised inlet locations and valley gutters to improve the routing of storm water to the design locations as approved by the CITY. • The Engineer will provide alignment, pipe sizing, design of the storm sewer systems and to maximize the capacity of existing systems as described above design of all outfall connections to Stream CF-3A, and an estimated construction cost. • The Engineer will review existing street grades and determine if the flows coming into the Westhaven at South Drive intersection flow down Westhaven to the north or if the design for this project should integrate the capacity of the two existing storm sewer systems and then determine the storm water impact from west of the Stream CF-3A crossing on this project design. The Engineer will evaluate the existing street and pipe capacities and also determine if any remaining flows may be captured with the proposed Barwick System at South Dr or if they add additional flows that impact the design of the Westlake System. 2.3. Subsurface Utility Engineering P rovide Subsurface Utility Engineering (SUE) up to Quality Level B for the section of Westlake between Harlan and IH 20. The existing contract contains up to 12 Level A S UE investigations as directed by the City of Ft. Worth and the work shall be performed in accordance with Cl/ASCE 38-02 No additional level A SUE is proposed The additional SUE work shall conform to the requirements in the original contract. The Additional Conceptual Design Package shall include the following: • Cover sheet • Drainage area map with supporting drainage computations in the CITY's standard tabular format. • SUE Plan sheets sealed by a licensed professional engineer registered in the State of Texas. • Horizontal alignment (excluding profiles) of proposed storm water improvements, including existing lot layout, streets, street right-of-way, proposed easements, and existing utilities gathered during the SUE within the project limits. • Engineer will provide proposed street improvements including intersection designs where applicable and approved by the CITY at the previously mentioned intersections to support the design calculations. The street modifications to provide the Westlake overflow improvements are also included in this task • At this time, no anticipated water or sanitary sewer improvements are proposed. The Street improvements will consist of Pulverize and Overlay reconstruction of the streets impacted by the proposed storm sewer improvements. Documentation of key design decisions (Project Decision Log). • • Estimates of probable construction cost. ASSUMPTIONS Assumptions for Amendment 1 are the same as for the original contract except for the following items. This includes the design of water, sewer and street improvements • A written summary of alternative design concepts will not be prepared. This additional conceptual study will evaluate potential solutions as described above and complete conceptual plans and cost estimates for one solution for the project area as described in the scope of work above Engineer will utilize • the S & B Infrastructure Systems report dated July 2011 to obtain the starting Water Surface Elevations for the existing and proposed Storm Sewer Systems. • Additional required D-holes will be added by amendment if required All other SUE investigations will be Level B. The original contract provides for all necessary Level A SUE investigations for Amendment #1 based on current known conditions.. • Coordination with TxDOT, Railroads, TDLR, or FEMA are not required per discussions with the CITY during preparation of the scope for Amendment 1.. ADD1TONAL ROW/EASEMENT SERVICES. ENGINEER will support and perform activities related to ROW and easements as outlined below, per scoping direction and guidance from the CITY's Project Manager. 3.1. Right -of -Way Research • The ENGINEER shall determine rights -of -way and easement needs for construction of the project. Required temporary and permanent easements will be identified based on available information and recommendations will be made for approval by the CITY. 3.2 Right-of-Way/Easement Preparation and Submittal. • The ENGINEER shall prepare documents to be used to obtain right-of-way and permanent and/or temporary easements required to construct the improvements. • The documentation shall be provided in conformance with the checklists and templates available on the CITY's Buzzsaw site. 3.3 Temporary Right of Entry Preparation and Submittal • Prior to construction, the ENGINEER shall prepare, mail and obtain Temporary Right of Entries from landowners. It is assumed that letters will only be required for land owners adjacent to temporary construction easements or who are directly affected by the project(impacted physically) and no permanent easement is required to enter their property. • The documentation shall be provided in conformance with the checklists and templates available on the CITY's Buzzsaw site. ASSUMPTIONS • Right -of -Way research includes review of property/right-of-way records based on current Internet based Tarrant Appraisal District (TAD) information available at the start of the project and available on -ground property information (Le. iron rods, fences, stakes etc.) It does not include effort for chain of title research, parent track research, additional research for easements not included in the TAD, right-of-way takings, easement vacations and abandonments, right-of-way vacations and street closures. The following work products are estimated • Two permanent easements are estimated for the outfall of the system from Westlake to stream CF-3A..for the two Tots are described as Lots 7 & 8, Block 15 in the Westcliff Addition of the J. Howard Survey(A-693), • Two temporary Right of Entry letters are estimated at this time. • CITY will provide appropriate forms and checklists for easements and Right of Entry letters. Temporary Right of Entry Letters TASK 4. ADDITONAL SURVEY. ENGINEER will provide survey support as follows. 4.1 Design Survey -New survey is needed on Westlake from Harlan to IH 20 and on Lots 7 & 8 for the outfall to stream CF-3A. New survey is also proposed to determine design flows impacted by flows through the intersections located on South Drive from Westhaven to Segura Ct. South. ENGINEER will perform field surveys to collect horizontal and vertical elevations and other information needed by ENGINEER in design and preparation of plans for the project Information gathered during the survey shall include topographic data, utilities as required by the SUE, structures, trees (measure caliper, identify overall canopy, and have qualified arborist identify species of trees), and other features relevant to the final plan sheets. Existing drainage at intersections will be verified by field surveys. • The minimum survey information to be provided on the plans shall include the following: A Project Control Sheet showing ALL Control Points, used or set while gathering data. Generally on a scale of not less than 1:400 The following information about each Control Point; a. Identified (Existing. CITY Monument #8901, PK Nail, 5/8" Iron Rod) b. X, Y and Z Coordinates, in an identified coordinate system, and a referred bearing base. Z coordinate on CITY Datum only. c. Descriptive Location (Ex. Set in the centerline of the inlet in the South curb line of North Side Drive at the East end of radius at the Southeast corner of North Side Drive and North Main Street). d, Benchmarks are to be set outside construction area. 4.2. Temporary Right of Entry Preparation and Submittal • Prior to entering property for field survey, the ENGINEER shall prepare, mail and obtain Temporary Right of Entry from landowners. • The documentation shall be provided in conformance with the checklists and templates available on the CITY's Buzzsaw site. (G&AI) is pleased to submit this proposal for professional land surveying services for the above referenced project. The following itemized surveying services are to be provided by G&AI: DESIGN SURVEY 1.) Research property owners and obtain copies of subdivision plats and ownership deeds 2.) Locate property corners and establish property lines and existing right- of-way lines. Prepare a right-of-way map of the existing right-of-way showing lots numbers, ownership with recording information and all of the parcels of land affected by the project. Deliverables include a property map to overlay onto the topographic survey prepared in an AutoCAD file format, along with copies of deeds, subdivision plats and tax ownership information. 3.) Establish vertical control for the project from existing City of Fort Worth control Establish benchmarks at a maximum of every 500' for construction. The horizontal control shall be NAD83, North Central zone with a detailed description being given for each control point. The control points shall be spaced as such to have two control points per plan sheet Provide horizontal and vertical control plan sheets to the City of Fort Worth s standards. The horizontal and vertical control plan sheets shall be signed and sealed by a Registered Professional Land Surveyor, licensed in the state of Texas. 4.) Provide a topographic survey of the proposed drainage project with the limits for the project being as described in an e-mail from engineer 7524 Jack Newell Blvd. So. • Fort Worth, Texas 76;18.817.496.1424 • Fax 817.496.1768 • www.ga•inc net dated 9/14/2011 and being approximately 800 linear feet along Westlake Drive (from Harlan to 1-20 frontage road, approximately 550 linear feet along Westhaven South and S. Segura Streets approximately 190 linear feet across the property on 4708 Westlake drive The topographic survey shall include 50-foot cross -sections extending from right-of-way to right-of-way and at all grade breaks along the existing street centerline. Where the alignment extends through the side lot line the topographic survey shall be 15 feet left and right of the lot line The topographic survey shall include, but not limited to locating all existing features such as water valves, water meters curb & gutter asphalt, sidewalks medians, fences, driveways, storm & sewer manholes, curb inlets, trees 6' and larger tops and toes of slope, power poles, mailboxes, signs, telephone risers and other visible features Cross -sections shall be provided where the proposal storm drain system ties into the channel. 5.) Deliverables shall include an AutoCAD drawing file showing all of the features located, ground elevations, a Digital Terrain Model along with one -foot interval contours. Provide copies of the survey field notes, a hardcopy of the coordinates and an ASCIi file of the coordinates for the points located a. Westlake Drive from Harlan Street to Avoca Street = $2,100.00 b. Westlake Drive from Avoca Street to 1-20 = $2,100.00 c. South Drive, Westhaven and S Segura Streets = $2 790.00 d. Property at 4761 Westlake = $1,000 00 6.) SUBSURFACE UTILITY ENGINEERING QL"B" — G&Ai will perform this work in general accordance with the recommended practices and procedures described in ASCE Publication Cl/ASCE 38-02 (Standard Guideline for the Collection and Depiction of Existing Subsurface Utility Data). G&AI will utilize geophysical prospecting equipment to designate the horizontal position of existing underground utilities, including existing storm drain lines, which are within the existing ROW. This level of work includes acquiring ' as -built" documentation from utility companies and making the initial contact with their representatives. QL ' B" will be furnished where indicated on Exhibits provided by Baker This proposal includes the following areas: a. Westlake Drive from IH20 to Harlan Avenue; b. Storm sewer system at the intersection of Gorman Drive and South Drives c. Storm sewer system at the intersection of Segura Court South and South Drive.
