I�u I O► Uk2I OLE Y TO CITY SECRETARY CONTRACT N0.41903 EASEMENT ENCROACHMENT LICENSE AGREEMENT This AMENDMENT TO CITY SECRETARY CONTRACT NO. 41903, EASEMENT ENCROACHMENT LICENSE AGREEMENT is made and entered into by and between the CITY OF FORT WORTH, a municipal corporation of Tarrant County, Texas, acting herein by and through its duly authorized City Manager or duly designated Assistant City Manager, hereinafter referred to as the "City", and RACE STREET LOFTS, LTD, a Texas limited partnership, acting herein by and through its duly authorized representative, hereinafter referred to as "Licensee". RECITALS WHEREAS, City and Licensee made and entered into City Secretary Contract No. 41903 he "Agreement") on June 22, 2011 to authorize an encroachment onto a proposed City sanitary sewer easement; WHEREAS, the Agreement contains Exhibits A-1 and A-2 that depict the encroachment ("Encroachment") and the City's proposed easement ("Easement"); WHEREAS, it necessary to amend the Agreement to add Exhibits A-3 and A-4 to depict a retaining wall and a fence as part of the Encroachment. NOW THEREFORE, City and Licensee, acting herein by and through their duly authorized representatives, enter into the following that amends the Agreement: 1. Exhibits A-3 and A-4 are attached hereto and incorporated herein for all purposes into the Agreement. 2. All other provisions of the Agreement which are not expressly amended herein shall remain in full force and effect.
