§ Renewal and Amendment of Interlocal Agreement Court

COUNTY OF TARRANT § Project: Harley
BACKGROUND
1. Tarrant County ("COUNTY") and the City of Fort Worth ("CITY") entered
into an Agreement approved by Tarrant County Commissioners Court
Order No. 110472, for the cooperative funding of improvements to Harley
Street ("Project") as described in the 2006 Tarrant County Bond Program.
2. The Project is not complete and the COUNTY and the CITY desire to
renew the Agreement for the 2013 Fiscal Year.
Therefore, the COUNTY and CITY agree to the following
1. The COUNTY and the CITY renew the Agreement for the COUNTY's 2013
Fiscal Year with the Agreement to expire September 30, 2013 or the
>- completion of the Project as determined by the COUNTY, whichever
c occurs sooner.

W2, The COUNTY and CITY agree to amend the costs as shown in the revised
v 40 payment schedules.
o c3 3. All terms and conditions of the original Agreement as amended remain in
effect except to the extent modified by this Renewal.

* COUNTY payments by completed phase are contingent upon the COUNTY'S
reasonable determination that the work regarding the project phase for which payment
is expected is successfully completed, as determined by the COUNTY. COUNTY
plans to issue debt for all phases of this project, therefore payment remains contingent
on debt issuance in accordance with applicable law.
Once Construction commences, COUNTY payment shall be made by fiscal quarter
prorated over the life of the construction but contingent upon reasonable progress in
construction as may be determined by the COUNTY.

Authorize Renewal of Three Interlocal Agreements with Tarrant County for the Widening of
Golden Triangle Boulevard Between IH-35W and US 377 in the Amount Up to
$7,300,000.00, for Construction Costs to Realign Harley Avenue Between University Drive
and Montgomery Street in a Revised Amount of $3 213,653 50, and for the Construction of
Summer Creek Drive in the Amount of $500,000.00 (COUNCIL DISTRICTS 2, 6 and 7)
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the renewal of the Interlocal Agreement with Tarrant County, Texas for the widening of
Golden Triangle Boulevard between IH-35W and US 377 in the amount up to $7,300 000.00;
2. Authorize the renewal of the Interlocal Agreement with Tarrant County, Texas for the construction
project to realign Harley Avenue from University Drive to Montgomery Street in a revised amount of
$3,213,653.50; and
3 Authorize the renewal of the Interlocal Agreement with Tarrant County, Texas for the construction
of Summer Creek Drive in the amount of $500,000.00.
DISCUSSION:
The renewal of these Interlocal Agreements are required to maintain Tarrant County's funding
obligation in the new Fiscal Year.
GOLDEN TRIANGLE BOULEVARD
On September 30, 2008, (M&C C-23104, City Secretary Contract No. 38089) the City Council
authorized an Interlocal Agreement with Tarrant County for cost participation, and accepted Tarrant
County's contribution in the amount up to $7,300 000 00 for use towards the widening of Golden
Triangle Boulevard from Interstate Highway 35W to US 377. This renewal adjusts the timing of the
payments to better coincide with actual project delivery.
HARLEY AVENUE
On March 22, 2011, (M&C C 24801, City Secretary Contract No. 41877) the City Council authorized
an Interlocal Agreement with Tarrant County for County funding participation in an amount not to
exceed $4,500,000.00 for construction. This value of $4,500,000.00 was based on an as -built cost
estimate before advertisement for construction.
In 2012, Staff revised the project cost based on construction bids. The revised Tarrant County
funding participation for construction of Harley Avenue in the amount of $3 213,653.50. The City will
own and maintain the roadway after construction is complete. This renewal adjusts the amount and
timing of the payments to better coincide with actual project delivery.
SUMMER CREEK DRIVE
On April 17, 2012, (M&C C-25564, City Secretary Contract No. 43321) the City Council authorized an
Interlocal Agreement with Tarrant County for cost participation, and accepted Tarrant County's

contribution in the amount of $500,000.00 to partner in funding the project. This renewal adjusts the
timing of the payments to better coincide with actual project delivery.
The City will own and maintain these roadways after construction is complete.
These projects are located in COUNCIL DISTRICTS 2, 6 and 7.
FISCAL INFORMATION/CERTIFICATION:
The Financial Management Services Director certifies that renewal of the Interlocal Agreements will
have no additional material effect on City funds.
