WHEREAS, it has become necessary to execute Amendment No. 2 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFOT, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated October 10, 2012, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $7,750.00. 2. Justification After Preliminary Design of the two (2) sanitary sewer rehabilitation projects associated with Amendment No. 1 we determined that a different alignment was necessary. See the attached project location map. Changes to the project Scope of Work is as follows: Burgess & Niple will design the reroute of M-169 from STA 13+73 at the intersection of Calmont Avenue & Clover Lane to STA. 0+59.51. Rather than going along I-30, it will be rerouted along Clover Lane and Birchman Avenue. This will avoid the two conflicts with the 72" arch storm drain. The main will be resized to allow for some flow that cannot be rerouted. This Amendment No. 2 is needed for Conceptual Design and Preliminary Design only. Effort already in Amendment No. 1 for Final Design and Construction Administration will be utilized for this new alignment. Based upon this scope of work, the additional design cost proposed for Amendment No. 2 is $7.750.00. See the attached Level of Effort Spreadsheet.
