REIMl� � Cc_ ikratiA ,T TO CITY SECRETARY CONTRACT No. 41750 WHEREAS, the City of Fort Worth (CITY) and Halff Associates, Inc., (ENGINEER) made and entered into City Secretary Contract No. 41750, (the CONTRACT) which was authorized by M&C C-24862 on the twelfth day of April, 2011 in the amount of $338, 966. 00; and WHEREAS, the Contract involves engineering services for the following project: Marine Creek Park Corridor Improvements, Project Nos., 01576 (Rodeo Park), 01577 (Marine Creek Linear Park), 01585 (Buck Sansom Park), 01586 (Lincoln Park) . WHEREAS, the CONTRACT was subsequently revised by: Amendment Number 1 in the amount of $33,200.00 which was administratively authorized on October 13, 2011; and Amendment Number 2 in the amount of $36,550.0O which was administratively authorized on April 24, 2012; and Amendment Number 3 in the amount of $4,300.00 which was administratively authorized on January 30, 2013; and WHEREAS, it has become necessary to execute Amendment No. 4 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated February 28, 2013, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $6,500.00. (See Attached Funding Breakdown Sheet, Page -3-) 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $419,516.00. David Buchanan Email: dbuchanan@halff.com VIA: Email Date: February 28, 2012 AVO: 28179 Project: Marine Creek Corridor Park Improvements As per your request, Halff Associates is pleased to submit this fee proposal for $6,500 for the preparation of a jurisdictional determination for the Marine Creek Corridor Park Improvements in Ft. Worth Texas. Per our understanding of your requirements, the specific items are identified as follows: 1. An on -the -ground jurisdictional determination will be performed to identify the limits of waters of the United States, including wetlands. The delineation will employ the use of GPS surveying techniques to map the limits of potential waters of the United States. Halff will prepare wetland data forms and on -site photography for representative sites. A jurisdictional determination report consistent with the USACE 'Procedures for Jurisdictional Determinations' (dated March 24, 2003) in addition to the "Regional Supplement to the Corps of Engineers Wetlands Delineation Manual: Great Plains Region (Version 2.0)" will be prepared describing the methodology and results of the investigation so that the report may satisfy the jurisdictional determination requirement for a pre -construction notification under Nationwide Permit 42. This scope is for requested items that are to be attached to a Pre -construction Notification (PCN) under Nationwide Permit 42 — Recreational Facilities for the Marine Creek Corridor. The scope does not assume preparation of the PCN. Reports prepared for this requirement should include the following: a. Purpose of the investigation, defining limits of the investigations; b. Methods, including: 1. A description of the approach used to delineate wetlands and other waters of the United States; and ii. A description of the conventions used to map the limits of waters of the United States. c. Results, including: A vicinity map or maps, (preferably USGS 7.5 minute or other smaller scale topographic maps) depicting the location of the site and showing the limits of the site investigated; ii. A narrative addressing the size of the site in square feet and/or acres; a description of any physical features; A characterization of hydrology addressing direction, source, frequency, and duration of on -site drainage; iv. Identification of any named waterways on or in the vicinity of the site; and other pertinent information on hydrology; v. A characterization of vegetative communities and dominant species occurring within each community type vi. A comparison of the soils, vegetative, and hydrologic conditions between wetland and upland areas, a description of riparian and other buffer features around water features; Preparation of wetland determination data forms; ix. Photographs taken from several locations throughout the project site; x. Current and historic aerial photographs; and xi. Any other relevant historic permit information or maps. d. Conclusions including: a. A description of, and map(s) depicting, potential waters of the United States (water features that have an ordinary high water mark or are wetlands) present in the study area, including: i. Wetland type(s), e.g. emergent, forested scrub -shrub, etc and ii. Other water type(s), e.g. perennial, intermittent, or ephemeral stream, reservoir, pond, etc. as appropriate.
