WHEREAS, the City of Fort Worth (City) and Halff Associates, Inc, (Engineer) made and entered into City Secretary Contract No0 41750, (the contract) which was authorized by the City Council by M&C C=24862 on the twelfth day of April, 2011; and WHEREAS, the Contract involves engineering services for the following projoct Marine Creek Park Corridor Improvements, P ro j oc t Mo s o , 01576 (Rodeo Park), 01577 (Marine Creek Linear Park), 0150.E (Buck Sansom Park) , 01586 (Lincoln Park) . WHEREAS, it has become necessary to execute Amendment Noo 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal let.ter dated September 12, 2011, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $33,200.00. 2© Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $372,166.00. David Buchanan Email: dbuchanan@halff.com VIA: Email Date: September 12, 2011 AVO: 28179 Project: Marine Creek Corridor Park Improvements As per your request Halff Associates is pleased to submit this fee proposal for $33,200 to assist in the preparation of a Cultural Resources Survey and an H&H Hydraulic Study for Marine Creek Corridor Park Improvements in Ft. Worth Texas. Per our understanding of your requirements, the specific items are identified as follows: 1. Cultural Resources Survey ($12,900): a. Archeological Background Study: A records review will be conducted utilizing the records at the Texas Archeological Research Laboratory and the Texas Historical Commission's (THC) online Restricted Archeological Sites Atlas, to identify recorded archeological or historic sites within and in the vicinity of park corridor. Federal and State lists of recorded historic properties such as the National Register of Historic Places (NRHP), State Archeological Landmarks (SAL), and Official Texas Historic Markers will also be reviewed. b. Antiquities Permit Application: It is anticipated that an archeological field survey would be required by the THC. A research design will be prepared in order to obtain a Texas Antiquities Permit for the cultural resource survey. c. Archeological Field Survey: The survey would include visual inspection and shovel testing within all portions of the APE with potential archeological resources, as defined in the background study. As part of the survey, archeologists would excavate sufficient shovel tests within the area of potential effects (APE) to characterize the soils, determine whether archeological resources are present and, if so assess those resources. Shovel testing will meet or exceed the Council of Texas Archeologists minimum standards for surveys in Texas. Backhoe trenching is not anticipated as being necessary and is not included as part of the proposed survey. Reporting: The results of the survey will be included in a professional report which makes recommendations with respect to archeological resources with regard to potential for NRHP and SAL eligibility and submit a single draft report of findings that meet the CTA reporting guidelines to the City of Fort Worth. Once comments are addressed and approved by the City of Fort Worth, a final draft report will be submitted to the THC. Following the required 30-day period of review all agency comments will be addressed, in consultation with the City of Fort Worth, and a final report will be submitted. Hydraulic Impact: Quantify the hydraulic impacts of the proposed concept masterplan improvements and provide recommendations to design team to lessen or mitigate impacts. Quantify the hydraulic impacts of the 60% and 90% proposed improvements and provide recommendations to design team to lessen or mitigate impacts. Attend two (02) meetings with the City of Fort Worth to discuss the impacts. b. Hydraulic Modeling: Update the existing Marine Creek hydraulic models developed by Halff Associates for TRWD in 2010 with the conceptual plan proposed improvements including trails, streambank stabilization, erosion control measures fill, excavations, and other park related facilities. Revise the hydraulic models to reflect the 60%, 90% and 100% construction document phases of the proposed improvements. c. Reporting: Prepare a draft memo documenting the hydraulic impacts of the final proposed improvements. Address draft memo comments and deliver final memo to City of Fort Worth along with supporting hydraulic models on CD. d. ((e (p It is recommended that the City Council authorize the City Manager to execute an engineering agreement with Halff Associates Inc. in the amount of $338,966.00 for the design and engineering of park improvements in the Marine Creek Park Corridor including Rodeo Park, Lincoln Park, Marine Creek Linear Park, Marine Creek Linear Park North and Buck Sansom Park. DISCUSSION: The purpose of this M&C is to authorize the City Manager to execute an engineering agreement with Halff Associates, Inc. in the amount of $338,966.00 to master plan, design and prepare construction documents for park improvements in the Marine Creek Park Corridor to include Rodeo Park, Lincoln Park Marine Creek Linear Park, Marine Creek Linear Park North and Buck Sansom Park. Staff considers this fee to be fair and reasonable for the scope of services proposed. Improvements will include replacement and construction of new multi -use trails, road and parking improvements, playground replacement, athletic field lighting, athletic field restoration and other park improvements. P roject funding is comprised of 2004 Capital Improvement Program (CIP) funds, gas lease bonus funds, donations and Texas Parks and Wildlife Department Urban Outdoor Grant funds. On February 9, 2010 (M&C G-16845) the City Council authorized the grant application to the Texas Parks and Wildlife Department (TPWD) Urban Outdoor Recreation Grant program using 2004 CIP funds, gas funds and donations from Streams & Valleys Inc and the Trinity River Vision Authority for a total of $2,109,747 67, as local match for the TPWD $1,000,000.00 grant. On August 26, 2010, the City of Fort Worth was awarded the $1,000,000.00 TPWD Urban Outdoor Recreation Grant, thus increasing the total project funding amount to $3,364,533.67. M/WBE - Halff Associates, Inc. is in compliance with the City M/WBE Ordiance by committing 14 percent M/WBE participation. The City's goal on this project was 14 percent. Rodeo Park, Lincoln Park, Marine Creek Linear Park, Marine Creek Linear Park North and Buck Sansom Park are located in COUNCIL DISTRICT 2.
