CITY SECRETARY CONTRACT No 0 41721 WHEREAS, the City of Fort Worth (CITY) and CUM Smith, Inc . , (ENGINEER) made and entered into City Secretary Contract No. 41721, (the CONTRACT) which was authorized by M&C C-24859 on the 12th day of April, 2011 in the amount of $ 294, 699 . 00; and WHEREAS, the CONTRACT involves engineering services for the following project: Construction Management Services for the Village Creek Water Reclamation Facility Bar Screen Building 3 Modifications and Junction Box Rehabilitation; and WHEREAS, it has become necessary to execute Amendment No. 1 to the CONTRACT to include an increased scope of work and revised fee. NOW THKR'EFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives which amends the CONTRACT: enter 1. The cost to City for the additional design services to be performed by Engineer totals $27,834.00. (See Attached Funding Breakdown Sheet, Page -3-) 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $316,533.00. 3. All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. EXECUTED and EFFECTIVE as of the date last written by a signatory, below. The Contractor's schedule has been extended to November 1, 2012 (201 days) due to change orders related to the replacement of approximately 7721inear foot of 96-inch pipe from junction Box 4B to Bar Screen Building 3 and the purchase and installation of three Vapex odor control units for Box 4B, Box C, and Bar Screen Building 3. The additional services included herein includes work related to project coordination/project management, extension of project meetings and site visits, review of additional contractor's payment applications, and additional time related to the change orders listed above. Work under this attachment includes additional Construction Management Services associated with the construction of the Village Cieek Water Reclamation Facility (VCWRF) Modifications to Bai Screen Building No. 3 Project (Bar Screen 3 Project) and the Junction Box Rehabilitation Project (Junction Box Rehab Project). Basic Services 1. Construction Administration/Project Management Engineer will administer the construction by maintaming project files, recording submittals, RFIs, and contract changes. Engineer will coordinate shutdowns with Contractor and plant staff Engineer will perform project management duties throughout the construction period. Engineer will coordinate with City's on -site inspection staff weekly to report progress and address construction related questions or issues. Deliverables: monthly invoices and project status reports, monthly M/WBE Reports. Assume 6 additional months. 2. Construction Phase Meetings and Periodic Site Visits Engineer will conduct monthly construction progress meetings with City and Contractor. Engineer will provide, on average, one person per meeting over the additional 6-month construction period It is assumed that these meetings will last two hours, including site visits foi Engineers observation of progress of work. Assume six monthly progress meetings and three impromptu field meetings for each project. Deliverables: Monthly Construction Progress Meeting Minutes. 3. Contractor's Payment Request Engineer will review Contractor's monthly payment request for accuracy of progress and recommend to the City for approval. Deliverables: Letter of recommendation for approval of payment request. 4. Change Management Engineer will administer all Change Orders and will review, comment on, and initiate all Change Order requests when appropriate.
