RECITALS WHEREAS, City made and entered into an Encroachment Agreement, City Secretary Contract No. 41660 (the "1ii;ncroachrnen t Agreement") with Grantee, the owner of certain real property located adjacent to or near the City's right-of-way, to authorize the use of a portion of City's public right-of-way for the construction of security improvements including various security bollards along Taylor Street and 1011' Street, an automated access gate and card readers. The encroachments are more particularly described in 1#4:xhibit " &" of the Encroachment Agreement and are sometimes called therein and herein the "Improvement"); WHERE S, the Encroachment Agreement was filed on August 2, 2011 in the Real Property Records of Tarrant County, Texas as Instrument No. D211184507; WHEREAS, Grantee wishes to remove the existing access gate arm and card readers and install four surface mounted bollards; and WHEREAS, it is the mutual desire of City and Grantee to amend the Encroachment Agreement to revise Exhibit 66A" to accurately depict the location of the Improvement after the changes. IN OW THEREFORE, City and Licensee hereby agree to amend the Encroachment Agreement as follows: 1. Exhibit 66A" attached to the Contract is revised as described and depicted in the attached Exhibit "A" Revised 07/2015, an updated and revised description of a portion of the Improvement, incorporated herein by reference in the Encroachment Agreement for all purposes. In other words, Exhibit "A" is only revised to provide for the removal of the existing access gate arm and card readers and the installation of four surface mounted bollards (as depicted in Exhibit 66A99 Revised 07/2015), and all other uses and encroachments shall continue to be authorized as stated in the Encroachment Agreement and Exhibit "A" of the Encroachment Agreement. 2. This Amendment is effective as the date of its execution by the City Secretary.
