AN ORDINANCE PROVIDING THAT THE ALLEY BETWEEN
LOTS 4,5 & 6 BLOCK 42 JEl?NINGS SOUTH ADDITION
TO THE CITY dF FORT TO$TH, TARF&TT COUNTY TEXAS,
BE ABANDONED VACATED AND CLOSED AND EXCEPTING
THE RIGHTS 6P ALL PUBLIC UTILITIES HERETOFORE AC-
QUIRED IN SAID ALLEY AND CONVEYING THE FEE IN
SAID LUTD TO THE ABUTTING PROPERTY 07TERS.
71HEREAS, it appearing to the City Council of the
City of Fort 7orth, Texas, that the alley hereinafter de-
scribed, although a duly dedicated and accepted alley for
use by the public, has in fact never been used by the pub-
lic and that it is to the best interest to the public that
said alley be closed, abandoned and vacated as a public
thoroughfare and the fee to the land in said alley convey-
ed to the abutting property owners.
NON, THEREFORE,
BE IT OBDAINED BY THE CITY COMCIL OF THE CITY OF
FORT UCRTH:
SECTION I.
That an alley twenty feet in width commencing at
twe t
Lake Street and extending east One hundred flet (12u) being
locatea and abutting on the north of Lots 4 8 5, Block 42,
Jennings South Addit ion and abutt ing on the south side of
Lot 6, Block 42, Jennings South Addition to the City of Fort
Worth, Tarrant County, Texas, be and the same is hereby vacat-
ed, closed and permanently abandoned as an alley or public
thoroughfare of any kind or character whatever.
SECTION II.
That the rights of all public utilities heretofore
acquired by said utilities for the purpose of constructing
and maintaining service lines shall not be disturbed, de-
stroyed, revoked or abrogated by any of the provisions of
this ordinance but said rights as above set out shall re-
main in full force and effect.
SECTION III.
That the fee to the land in said alley be hereby
released and conveyed in equal parts to the abutting prop-
erty owners on said alley.
SECT IOTT IV.
That all ordinances or parts of ordinances in
conflict herewith are hereby repealed.
SECTION V.
That this ordinance shall take effect and be in
full force and effect from and after the date of its
passage.
