HomeMy WebLinkAboutOrdinance 17705-08-2007Ordinance No. 17705-OS-2007 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE FORT WORTH HOUSING FINANCE CORPORATION FUND IN THE AMOUNT OF $4,400,000 FROM AVAILABLE FUNDS FOR TTIE PURPOSE OF ESTABLISHING A LOAN FUND BENEFITING LOW TO MODERATE INCOME POPULATIONS CONSISTENT WITH TIC POLICIES, GUIDELINES, AND PURPOSE OF THE FORT WORTH HOUSING TRUST FUND; MAI~TG THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY TTIE CITY COUNCIL OF TTY CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2006-2007 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Fort Worth Housing Finance Corporation Fund in the amount of $4,400,000 from available funds for the purpose of establishing a loan fund benefiting low to moderate income populations consistent with the policies, guidelines, and purpose of the Fort Worth Housing Trust Fund. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 17142 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the transfer of $2,000,000 from the General Fund to the Fort Worth Housing Finance Corporation (FWHFC) for the purpose of establishing a loan fund benefiting low to moderate income populations consistent with the policies, guidelines, and purpose of the Fort Worth Housing Trust Fund (Housing Trust Fund); 2. Authorize a grant of $1,750,000 in HOME funds to the FWHFC to establish a loan fund to provide loans, grants and guaranties benefiting low to moderate income populations consistent with the policies, guidelines, and purpose of the Housing Trust Fund; 3. Authorize termination of Contract No. 29725 dated April 4, 2004, which established the Housing Development Fund, re-allocation of the remaining HOME grant funds from the Housing Development Fund administered by the FWHFC under City Contract No. 29725 for inclusion with the allocation of HOME grant funds establishing the FUVTHF, and transfer the servicing of outstanding loans of the Housing Development Fund to the FWHFC; 4. Authorize termination of Contract No. 33369 with Fort Worth Central Community Development Corporation and authorize a grant of $650,000 in Community Development Block Grant (CDBG) funds to the Housing Trust Fund to provide loans and grants low to moderate income populations consistent with the policies, guidelines, and purpose of the FWHTF; 5. Approve and adopt the Policies and Program Guidelines for the FWHTF; 6. Authorize the City Manager to execute a contract with the FWHFC to allocate, invest, administer, and expend the funds consistent with the policies, guidelines, and purpose of the FWHTF; 7. Authorize the City Manager to amend the contract as needed, provided the amendment is consistent with applicable laws and regulations and with the goals of providing support to the FWHTF and its loan fund; and 8. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Fort Worth Housing Finance Corporation Fund in the amount of $4,400,000 from available funds. Logname: OSHSNG TRST FND Page 1 of 4 DISCUSSION: At the April 10th, 2007 Pre-Council meeting, the Mayor's Advisory Task Force on Quality Affordable Housing presented its recommendations for the purpose, eligible uses and administration of the Housing Trust Fund. The Housing Trust Fund will identify a permanent and annually renewable source of revenue to meet, in part, the needs of the City's very low, low and moderate income households through a combination of funds. The Housing Trust Fund will foster a mix of family incomes in projects assisted in the Fund and disperse affordable housing projects. It will preserve and maintain ownership and renter housing units which are affordable to very low, low and moderate income households. It will foster and encourage the private sector to join with the public sector to leverage the City's funds. In the evaluation of development proposals, the leveraging of funds will be a determining factor. Source of Funds An initial investment of $2.0 million in General Funds will be leveraged with federal HOME grant funds and CDBG funds. When General Funds are utilized, they will be enhanced through interest bearing loans and leveraging from the private sector. In particular, they will be utilized to address populations and uses that federal grant funds are unable to address, including households earning between 81 percent and 120 percent of Area Median Income (AMI) to achieve mixed-income objectives. The 120 percent AMI is a cap, not a target. First-year sources are: SOURCES AMOUNT FWHFC Endowment (restricted) $4,000,000.00 Loan Funds: General Funds $2,000,000.00 HOME Grant Funds $1,750,000.00 CDBG $650,000.00 Total Loan Funds: $4,400,000.00 The HOME Grant Funds of $1.750 million include the re-allocation of $642,218 in un-disbursed loan funds from the Fort Worth Housing Development Fund (FWHDF). These funds were originally allocated on April 2, 2004 by Contract No. 29725 with the FWHFC, the administering agency, for the purpose of making loans to housing developers for the construction of qualified housing development projects. The CDBG funds consist of the re-allocation of $650,000 originally allocated by City Contract No. 33369 dated April 3, 2006, with the Fort Worth Central Community Development Corporation to establish a loan loss reserve for loan guaranties and to provide subsidies for low to moderate income homeowners seeking a home rehabilitation loan. The designation and allocation of $4,000,000 from the FWHFC endowment fund will establish a permanent corpus for the Housing Trust Fund. Interest earned from investment of the endowment fund and lending activities utilizing General Funds will generate additional lending capital. Leveraging of the City's investment is a priority for the Housing Trust Fund, especially a sustainable and dedicated source to address the estimated $1.8 billion need for affordable housing identified by the Mayor's Advisory Task Force on Quality Affordable Housing. In addition, private sector lending will further leverage the gap financing provided by Housing Trust Fund loans to homeowners and housing developers and builders. Use of Funds The Housing Trust Fund will address the preservation of housing units for homeowners and for renters and encourage new construction that promotes mixed-income communities. Permanent supportive housing and transitional housing for homeless populations with special needs are included in the priority uses. Allocations will be in the form of loans, grants, or guaranties. The targets for allocation by household income are: Households earning less than 30 percent AMI - 25 percent; households earning between 30 percent and 50 percent AMI - 20 percent, and; households earning 50 percent to 80 percent AMI - 50 percent. The FWHFC Board of Directors is the governing body. The FWHTC will adopt an Annual Plan describing the funding and lending activities for the Housing Trust Fund's upcoming year based on the recommendation of the Central City Revitalization and Community Development Committee (CORED) of the City Council which will serve as advisory committee. Quarterly reports will describe the progress in leveraging and lending against performance goals of the Housing Trust Fund, including populations served. The Housing Trust Fund will be staffed by the Housing Department. No more than ten percent of its annual budget will be expended on administrative costs. The contract can be terminated at the parties' discretion. The Housing Trust Fund will be available IN ALL COUNCIL DISTRICTS. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that upon approval and adoption of the attached appropriation ordinance of the above recommendation, funds will be available in the current budget, as appropriated for the Fort Worth Housing Finance Corporation Fund.
