AGREEMENT FOR ACQUISITION SERVICES
CITY SECRETARY CONTRACT NO. 43200
WHEREAS, the City of Fort Worth (City) and O.R. Colan Associates of Illinois, LLC,
(Consultant) made and entered into City Secretary Contract No. 43200, (the Agreement) which was
authorized by the City Council by M&C C-25562 on the 17th day of April 2012; and
WHEREAS, the Agreement involves Land Acquisition Consulting Services for the City of
Fort Worth Aviation Department;
WHEREAS, it has become necessary to amend the Agreement to revise the maximum
amount of the compensation paid to Consultant.
NOW THEREFORE, City and Consultant, acting herein by and through their duly
authorized representatives, enter into the following agreement which amends the Agreement:
1.
The first sentence in Section 4 of Article 1, of the Agreement is amended to read:
The City shall pay Consultant an amount not to exceed $77,000.00 in accordance with the
provisions of this Agreement ("Consultant's Fee") for Task Order #1 shown as Exhibit "A".
2.
Task Order 1 is revised to include item number three which will increase compensation as
shown in the attached Exhibit "A", hereby incorporated for all purposes.
3.
All other provisions of the Agreement which are not expressly amended herein shall remain
in full force and effect.

Task Order #1
1. To conduct an Avigation Easement Valuation Study in order to determine the value of an
Avigation Easement in vicinity of AFW. Reference pages 9-43 & 44 of the December
2010 URS Study for the Fort Worth Alliance Airport Noise Compatibility Program.
2. To appraise four rural residential properties in Program areas 2, 3 and 4 for acquisition in
accordance with the Fort Worth Alliance Airport Noise Compatibility Program as
recommended in the December 2010 URS study.
3. Acquire title policies for four rural residential properties.
The fee for item one would be no more than $50,000, the fee for item two would be no more than $15,000 and the
fee for item 3 will be no more than $12,000. The total fee will be no more than $77,000.

SUBJECT: Authorize Use of Gas Lease Revenue in the Amount of $12,000.00 to Pay for Title Policies
for the Acquisition of Four Residential Rural Properties for the Alliance Noise Mitigation
Program and Adopt Appropriation Ordinances (COUNCIL DISTRICT 2)
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the use of gas lease revenue in the amount of $12,000.00 to pay for title policies for the
acquisition of four residential rural properties for the Alliance Noise Mitigation Program;
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
amount of $12,000.00 in the Airports Gas Lease Project Fund from available funds;
3. Authorize the transfer of funds from the Airports Gas Lease Project Fund to the Municipal Airports
Fund in the amount of $12,000.00; and
4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Municipal Airports Fund in the amount of $12,000.00 from available funds.
DISCUSSION:
On March 6, 2012 (M&C C 25482) the City Council authorized the application for and acceptance of
a grant, if awarded, from the Federal Aviation Administration (FAA) to acquire land in accordance with
the Part 150 Noise Mitigation Plan for Fort Worth Alliance Airport. It is the policy of the City of Fort
Worth (City) to purchase title policies when acquiring properties; however FAA grant funds cannot be
used to pay for title policies. These funds will enable O.R. Colan, the firm hired to perform real estate
consulting services for the Alliance Noise Mitigation Project, to order title policies for the four
residential properties that the City will be acquiring for the purpose of Noise Mitigation.
Fort Worth Alliance Airport is located in COUNCIL DISTRICT 2.
FISCAL INFORMATION/CERTIFICATION:
The Financial Management Services Director certifies that upon approval of the above
recommendations and adoption of the attached appropriation ordinance, funds will be available in the
current operating budget, as appropriated, of the Municipal Airports Fund
