TO CITY SECRETARY CONTRACT Moo 42085
WHEREAS, the City of Fort Worth (CITY) and CDM Smith Inc . ,
(ENGINEER) made and entered into City Secretary Contract No. 42085, (the
CONTRACT) which was authorized by M&C C-24988 on the 12 day of July, 2011
in the amount of $ 293,525.00; and
WHEREAS, the CONTRACT involves engineering services for the
following project:
Hubbard Heights Storm Drainage Improvements Project; and
WHEREAS, it has become necessary to execute Amendment No. 1 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly author i zed representatives,

Article I of the CONTRACT is amended to include the additional
engineering services specified in a proposal dated December 04, 2012, a
copy of which is attached hereto and incorporated herein.: The cost to
City for the additional design services to be performed by Engineer
totals $88,200.00. (See Attached Funding Breakdown Sheet, Page -3-)

Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $381L,725.00.

All other provisions of the Contract, which are not expressly
amended herein, shall remain in full force and effect.

Engineering Services Scope and Fee Amendment Proposal
Dear Mr. Pandey:
Following submission of the 30% design drawings and report, the City of Fort Worth
suggested that CDM Smith consider changes to the extent of the project limits. The goals of
the changes were to optimize the capture of stormwater runoff by extending the proposed
storm drain improvements. CDM Smith considered the changes to the existing improvements
and prepared a memorandum with recommendations for changes to meet the City's goals.
This memorandum outlined the potential improvements of the revised alignment, and also
documented additional survey, easements and SUE needs if the City decided to pursue the
modified project extents.
CDM Smith met with the City to discuss the recommendations, and the City requested that
CDM Smith proceed with the work. At the meeting the City also requested that CDM Smith
perform an analysis to determine the houses that will be protected from flooding by the
proposed storm drain improvements. This will require analysis beyond what CDM Smith is
under contract to perform to size the proposed improvements.
CDM Smith has worked with Marshall Lancaster and Associates (MLA) and The Rios Group
to develop a scope and fee proposal for the additional survey, easements and SUE work that
are required for the increased project area. These items are further discussed below:
Level of Service Analysis. The original engineering was fee based on performing hydrology and
hydraulic analysis to size the storm drain improvements. The project team completed this
analysis of the original 30% design alignment, and then modified the calculations to reflect
the recommended revised alignment. Performing a level of service analysis requires
engineering effort beyond what was scoped in the original contract. CDM Srnith proposes to

include three subtasks to the 3.7 Preliminary Design (60%) task to incorporate this work into
the contract.
Right-of-Way/Easements. MLA established right-of-way boundaries based on the original 30%
design alignment. Extending the project boundary will require that MLA establish additional
right-of-way boundaries along James Street, Cantrell Street, Fuller Avenue, Felix Street,
Boyce Avenue and Spurgeon Street. MLA will require additional temporary right of entry
coordination to complete the survey, since the recommended improvements will cross several
private properties. It is also anticipated that additional permanent and temporary easements
will be required. CDM Smith proposes to modify Task 7.2 and 7.3 to incorporate this work
into the contract.
Survey. Increasing the boundary of the project area will require approximately 4,460 linear
feet of additional street and adjacent property survey along James Street, Gambrell Street,
Fuller Avenue, Felix Street, Boyce Avenue and Spurgeon Street. CDM Smith proposes to
modify Task 8 to incorporate this work into the contract.
Additional Services. The original contract included three subtasks for meeting with property
owners and stakeholders, facilitating additional meetings as requested by the City, and
preparing exhibits and sketches. During the 30% design work, the design team was asked to
coordinate with the Federal agency owning the property to the south of Fuller Avenue. The
City directed CDM Smith to utilize the Task 10 budget for these meetings and for any other
meetings needed to coordinate improvements on the federally -owned property. CDM Smith
proposes to modify this task to include two meetings with the Fort Worth Federal Center and
one meeting with the TCEQ.
Additional Engineering Fee Request
We project the following additional work required to complete the design of the revised
storm drain alignment.
1. Preliminary Design (60-Percent). As previously discussed, additional effort beyond what
is needed to size the pipes will be required to perform the hydrologic and hydraulic
analysis to determine the level of service provided by the storm drain improvements.
This effort is divided into three subtasks and the labor costs are as follows:

2. Right Of Way/Easement Services. As previously discussed, additional right-of-way
documentation, right of entry coordination and additional easements will be needed
along James Street, Ganlbrell Street, Fuller Avenue, Felix Street, Boyce Avenue and
Spurgeon Street. This effort would amend the existing 7.2 and 7.3 subtasks as follows:

3. Survey. Additional topographic and SUE survey will be needed along James Street,
Gambrel! Street, Fuller Avenue, Felix Street, Boyce Avenue and Spurgeon Street to
accommodate the revised alignment. This effort would amend the existing 8.1 subtask as
follows:

4. Additional Services. As previously discussed, CDM Smith has agreed to provide
additional meetings with the Fort Worth Federal Center and the TCEQ. This effort would
amend the existing 10.1 subtask as follows:
Task 10.1 Coordination w/State & Federal Agencies $ 6,760
Total $ 6,760
The total engineering costs associated with the services described above is $88,200. Therefore,
we request an amendment to our contract to increase the upper limit by $88,200 to $381,725.
As part of this amendment, CDM Smith commits to an additional M/WBE participation of
$40,600, which equals 46% of the total amendment amount.

It is recommended that the City Council authorize Amendment No. 1 to City Secretary Contract No.
42085, an Engineering Agreement with CDM Smith Inc., in the amount of $88,200.00 for additional
engineering analyses for the Hubbard Heights Storm Drainage Improvements Project, bringing the
total contract amount to $381,725.00.
DISCUSSION:
The engineering services recommended by this Mayor and Council Communication will provide for
additional design, survey, subsurface utility engineering and easement documents needed for the
Hubbard Heights Storm Drainage Improvements Project. After the initial drainage study, it was
determined that the project limits should be extended, resulting in the need for additional
analyses. The original engineering Agreement with CDM, now known as CDM Smith Inc., (City
Secretary Contract No. 42085) was approved by Council on July 12, 2011, in the amount of
$293,525.00. This amendment will bring the total contract amount to $381,725.00.
CDM Smith, Inc., proposes to perform the above services for a lump sum fee of $88,200.00. Staff
considers the fee to be fair and reasonable for the scope of services proposed.
Funding for this project is being provided from revenue bonds in the Stormwater Capital Projects
Bond Fund.
CDM Smith, Inc., is in compliance with the City's M/WBE Ordinance by committing to 32 percent
M/WBE participation on this Amendment No. 1. The City's M/WBE goal on this amendment is 32
p
ercent.
This project is located in COUNCIL DISTRICT 9, Mapsco 90L and 90M.
FISCAL INFORMATION/CERTIFICATION:
The Financial Management Services Director certifies that funds are available in the current capital
budget, as appropriated, of the Stormwater Capital Projects Bond Fund.
