WHEREAS, The City of Fort Worth and Dunaway Associates, L.P., a Texas Limited Partnership
(Engineer) made and entered into City Secretary Contract No. 42224 (The Contract) which was
administratively executed in the amount of $47,500.00 on the 2nd day of September, 2011; and
WHEREAS, further amendment is necessary for additional Engineer's construction administration &
construction staking services and reimbursable expenses for the Gendy Street Beautification Project at
the Will Rogers Memorial Center (WRMC).
NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized
representatives, enter into the following agreement which amends the Contract:

Article I, SCOPE OF SERVICES, of the Agreement is amended for additional services for construction
administration, construction staking and reimbursable expenses as specified in the letter from the
Engineer dated November 28, 2011, attached hereto as Attachment "A"; and made a part of this
Agreement.

Article II, COMPENSATION, of the Agreement is amended for the total Agreement price of $93,500.00 for
fees including not -to -exceed $1,000.00 for reimbursable expenses.

All other provisions of this Contract which are not expressly amended herein shall remain in full force and
effect.

Reference: Proposal for Professional Civil Engineering and Surveying Services
Gendy Street Beautification
Dear Dalton:
Dunaway Associates, L P. (Dunaway) is pleased to submit this proposal for professional civil
engineering and land surveying services for Gendy Street Beautification. Based on
conversations with you, we believe the following scope of services will meet your needs for this
project:
SCOPE OF WORK
1. Bid Phase Services — Dunaway will assist the City of Fort Worth with the bid process as
follows:
a. Dunaway will produce and deliver bid documents to the City of Fort Worth, assist
in responding to questions and interpreting the bid documents.
b. Dunaway will attend the contractor selection meeting and pre -bid and post -bid
meetings.
2. Construction Administration — Dunaway will provide construction administration services
as follows:
a. Review and respond on City of Fort Worth's behalf for shop drawing submittals
related to elements of the design for which Dunaway is responsible.
b. Review and respond to written Requests for Information from City of Fort Worth's
contractor regarding elements of the design for which Dunaway is responsible
c. Make occasional site visits during construction for a cursory review of progress of
construction. Please note that Dunaway does not provide construction inspection
services. We recommend that City of Fort Worth retain a geotechnical engineer
to provide inspection of private site improvements.
d. Bi-weekly construction meetings during construction phase.
e. Coordination with KH on water line (submittal, specifications, sequencing,
bidding).
f. Pre -construction meeting(s) for hardscape and water line (2 separate meetings).

3. Construction Staking for Hardscape — Dunaway will provide on a one-time basis the
following services:
a. Mark curb and sidewalk cuts for paving demolition.
b. Stake paving and sidewalks.
c. Stake storm drain.
d. Stake slotted drains.
4. Reimbursable Expenses
Only those services specifically mentioned in the Scope of Work section are offered as part of
this proposal.
FEE
Dunaway Associates, L.P. proposes to provide the above -described scope of work for a LUMP
SUM fee of $ 46,000. Please find attached to this proposal our Standard Terms & Conditions for
professional services, which is also part of this proposal.
Bid Phase Services - $5 000
Construction Administration - $15,000
Construction Staking - $25,000
Reimbursable Expenses - $1,000
ADDITIONAL SERVICES (not included in proposal)
The following is a list of some, but not necessarily all, of the services that can be useful or
required for a project of this type. The listed services have not been included in this proposal.
Dunaway can provide or sub -consult many of these services if desired by City of Fort Worth. If
City of Fort Worth determines any of these services is desired, Dunaway can either amend this
proposal to incorporate the desired service or services or recommend other actions to cover the
needs as expressed.
1. Flood studies for changes to FEMA flood maps.
2. Phase 1 and Phase 2 Environmental Site Assessments.
3. Wetlands delineations and Section 404 permitting through the US Army Corps of
Engineers.
4. Structural design of retaining walls.
5. Design of franchise utilities (gas, electric, telephone and cable TV) will be conducted by
the franchise utility companies. Usually, each franchise utility company will provide its
own design. If desired, Dunaway will show the conduit for each of these on our drawings
provided that the size, number and material for each conduit is provided to Dunaway by
the utility company.

6. Redesign efforts related to site plan or building footprint changes after significant design
efforts have begun are not included.
7. Boundary surveys and as -built surveys and/or easements by separate instrument.
8. Soil Investigation/Laboratory Testing: Dunaway recommends that City of Fort Worth
retain an independent laboratory for use in any testing required during the design phase,
i.e., for density approval in the street rights -of -way, and for any site excavation and
embankment that might be required for this project.
9. Construction inspection services are not included. Dunaway does not provide
construction inspection services. Normally, we recommend that City of Fort Worth retain
a geotechnical engineering consultant to provide construction inspection services for
private improvements.

SP Plus in the Amount of $1,766,535.59 and Authorize Amendment No. 1 to City

$46,000.00 with Dunaway Associates, LP, for the Landscaping, Paving, and Pedestrian
Enhancements to Serve the Gendy Street Phase II Project at Will Rogers Memorial
Center (COUNCIL DISTRICT 7)
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize execution of a construction contract with Standard Parking Corporation d/b/a SP Plus, in
the amount of $1,766,535.59 including $78,471.82 in allocation allowance; and
2. Authorize Amendment No. 1 to City Secretary Contract No. 42224 for construction administration
services in the amount of $46,000 00 with Dunaway Associates, LP, for the landscaping, paving and
Pedestrian Enhancements to serve the Gendy Street Phase II Project at Will Rogers Memorial
Center.
DISCUSSION:
This Mayor and Council Communication is to award the construction contract and to authorize
Amendment No. 1 for construction administration services for the Gendy Street Phase II Project with
funding from C200 the 2004 CIP Street Improvements Fund, and remaining funds in P249, the
Western Heritage Parking Garage Fund.
On September 2, 2011, a contract was administratively awarded to Dunaway Associates LP, in the
amount of $47,500 00 to revise and resubmit construction documents and submit Texas Department
of Licensing and Regulation Review for the Gendy Street Beautification at Will Rogers Memorial
Complex. This Amendment No. 1 is for construction administration services in the amount of
$46,000.00. City Staff considers this fee to be fair and reasonable for this scope of services
proposed
The Request for Competitive Sealed Proposals was advertised in the Fort Worth Star-Telearam on
October 13, 2011 and October 20, 2011 Eight firms submitted proposals on November 17, 2011 and
four of the eight firms submitted the required Post Bid -Pre Award documents on November 28, 2011.
The following four proposals (including add Alternate Nos. 1 and 2) were received:
