CITY SECRETARY CONTRACT NO. 1)30 / THE STATE OF TEXAS COUNTIES OF TARRANT, KNOW ALL BY T1=IESE PRESENT D E N T O N AND WISE MEMORANDUM OF UNDERSTANDING BFTWEEN THE CITIES OF FORT WORTH, ARLINGTON, BEDFORD, HALTOM CITY, HURST, NORTH RICHLAND HILLS, AND COUNTY OF TARRANT, TEXAS 2012 BYRNE JUSTICE ASSISTANCE GRANT (JAG) FORMULA PROGRAM AWARD This Agreement is made and entered into this day of (UtTt) 2012, by and between the COUNTY of TARRANT, acting by and through its duly authorized representative, hereinafter referred to as COUNTY, the CITY of FORT WORTH, acting by and through its duly authorized representative, hereinafter referred to as CITY, and the Cities of Arlington, Bedford, Haltom City, Hurst, North Richland Hills, acting by and through their duly authorized representatives, and hereinafter collectively referred to as SUBRECIPIENT or individually by name, located entirely within the State of Texas, witnesseth: WHEREAS, each governing body finds that the performance of this Agreement is in the best interests of all parties, that the undertaking will benefit the public, and that the division of costs fairly compensates the performing party for the services or functions under this Agreement; and WHEREAS, under the 2012 Byrne Justice Assistance Grant (JAG), the Department of Justice (DOJ) has awarded a total of $561,566.00 to be distributed to the parties to this Agreement, hereafter referred to as JAG award; and WHEREAS, the CITY has agreed to serve as the fiscal agent for the JAG award, and distribute all such funds between the cooperating parties; and WHEREAS, the CITY, COUNTY and SUBRECIPIENTS believe it to be in their best interests to reallocate the JAG award as set forth herein. NOW THEREFORE, the CITY, COUNTY, and SUBRECIPIENTS agree as follows: Section 1. CITY agrees to provide the COUNTY $53,620 00 from the JAG award. ARLINGTON agrees to provide the COUNTY $26,553.00 from the JAG award. BEDFORD agrees to provide the COUNTY $2,632.00 from the JAG award. HALTOM CITY agrees to provide the COUNTY $2,049.00 from the JAG award. HURST agrees to provide the COUNTY $2,241.00 from the JAG award. NORTH RICHLAND HILLS agrees to provide the COUNTY $2,754.00 from the JAG award Section 2. CITY agrees to reimburse SUBRECIPIENT BEDFORD a total of $13,819.00 from the JAG award. CITY agrees to reimburse SUBRECIPIENT HALTOM CITY a total of $ 10,760.00 from the JAG award. CITY agrees to reimburse SUBRECIPIENT HURST a total of $11,765.00 from the JAG award. The above parties agree to utilize their jurisdiction's individual award as outlined in a separate Memorandum of Understanding between CITY and the individual SUBRECIPIENTS or COUNTY. Section 4. It is expressly understood and agreed that, in the execution of this Agreement, no party waives, nor shall be deemed hereby to waive, any immunity or defense that would otherwise be available to it against claims arising in the exercise of governmental powers and functions. Section 5. Each party to this Agreement will be responsible for its own actions in providing services under this Agreement and shall not be liable for any civil liability that may arise from the furnishing of the services by any other party. Section 6. This Agreement creates no rights in any third party. Section 7. As to each individual party, this Agreement incorporates by reference the terms and conditions contained in the following three additional documents, as if set forth at length herein: (1) the Memorandum of Understanding between' CITY and the individual SUBRECIPIENTS or COUNTY; (2) the applicable Grant Award Agreement and (3) the individual SUBRECIPIENT'S budget submitted in connection with this grant award With the exception of those aforementioned agreements and/or documents, this Agreement contains all commitments and agreements of the parties, and no oral or written commitments have any force or effect to alter any term or condition of this Agreement, unless in writing and signed by authorized representatives of all parties. Authorize the use of anticipated interest in the amount of $10,000.00 in accordance with the grant; and 5. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund in the amount of $571 566.00, subject to receipt of the grant. DISCUSSION: The Fiscal Year 2012 Edward Byrne Memorial Justice Assistance Grant (JAG) Formula Program allows local governments to support a broad range of activities to prevent crime and to improve the criminal justice system. The City of Fort Worth along with the cities of Arlington, Bedford, Haltom City Hurst and North Richland Hills are required to negotiate with Tarrant County to develop a program budget and strategy. The cities included in this Application have worked on collaborative projects for the past 20 years including intelligence sharing, crime analysis, juvenile and adult drug treatment and the 2005-2011 Justice Assistance Grant (JAG) Formula and Recovery Act JAG Programs Following the announcement of the Fiscal Year 2012 JAG, representatives from the below listed agencies agreed that the City of Fort Worth should again serve as the cognizant agency for the Fiscal Year 2012 JAG Formula Program. A total in the amount of $561,566.00 is available to be shared among the jurisdictions listed below and will be distributed in the following manner: JURISDICTIONS City of Fort Worth [Tarrant County Arlington (Bedford Haltom City Hurst PURPOSE AREA Digital Audio Recorder System for the Police Department Communications Division Adult Drug Court and Mental Health Liaison Supplement Mobile Video Devices and Supporting Equipment 'Police Equipment [Police Equipment 'Police Equipment North Richland HilisIPolice Equipment AMOUNT $281,506.00 $ 89,849.00 I$139,406.00 1$13,819.00 1$ 10,760.00 1$ 11,765.00 1$ 14,461.00 No matching funds are required. The City of Fort Worth was responsible for submitting the full grant application and will upon receipt of the grant funds, distribute funding to the other jurisdictions, as agreed among the above entities. The City of Fort Worth's funding will provide for an updated digital recording system. This system would replace the current Communications Division s failing recording system which has been in place since 2003. The current recording system has experienced several outages due to equipment failure that have caused loss in both radio and telephone recordings that must be achieved and kept for a minimum of one year to meet the standards of the records retention schedule and to supply both investigative and open records request recordings of both radio and telephone transmissions. As the project scope of the radio system does not include audio recording equipment for 9-1-1 telephone transmissions, the Communications Division is requesting additional equipment and recording packages necessary to meet both quality measurement and audio logging requirements. The digital audio recording system would allow for quality assessment, the coaching package, screen recording and the analytics package. FISCAL INFORMATION: The Financial Management Services Director certifies that upon approval of the above recommendations, receipt of the grant, and adoption of the attached appropriation ordinance funds will be available in the current operating budget, as appropriated of the Grants Fund.
