AMENDMENT NO. 1 TO FUNDING AGREEMENT
IH-30 INTERCHANGE AT WALSH RANCH PARKWAY
CSJ: 1068-05-009 & 0008-03-105, TARRANT AND PARKER COUNTIES, TEXAS
This Amendment No. 1 to Funding Agreement for the IH-30 Interchange at Walsh Ranch
Parkway is executed by the City of Fort Worth (the "City") and Walsh Ranches Limited
Partnership, a Texas limited partnership ("Walsh"), effective Setatier L( , 2012.

WHEREAS, the City and Walsh entered into the certain Funding Agreement for IH-30
Interchange at Walsh Ranch Parkway effective September 25, 2012 (Mayor and Council
Communication C-25879, City Secretary Contract No. Li 3 €i E 7- ) (the "Funding
Agreement"), whereby Walsh agreed to reimburse the City for certain costs related to the
interchange at Walsh Ranch Parkway and IH-30 described in that certain Local Transportation
Project Advance Funding Agreement (the LPAFA") between the Texas Department of
Transportation (the "State") and the City (Mayor and Council Communication C-25879, City
Secretary Contract No. on Lj ), and
WHEREAS, the City and the State have entered into that certain Local Project Funding
Agreement for Voluntary Local Government Contributions to ,Transportation Improvement
Projects With No Required Match (On -System) effective bc Lc/ ) , 2012, providing for the
City to fund the installation of six (6) decorative poles on the interchange at Walsh Ranch
Parkway and IH-30 at an estimated cost of $39,000 (the "Decorative Poles"); and
WHEREAS, Walsh is willing to reimburse the City for the cost of the Decorative Poles;
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS: For and in
consideration of the covenants and conditions contained herein, the City and Walsh agree as
follows:
1. The Funding Agreement is hereby amended by redefining "Construction Funding
Shortfall" to include the cost of the Decorative Poles. All other provisions of the
Funding Agreement shall remain in full force and effect.
2. The City shall be responsible, at the City's cost, for maintenance of the safety lighting
system, consisting of the Decorative Poles, including the maintenance and replacement of
all hardware for the Decorative Poles (light fixtures, mast arms, ballast, conductors,
cables, conduit, fuses, etc.), providing and funding for materials, equipment, labor, tools
and incidentals necessary to provide a functional lighting system, after construction is
complete and the system is operational.
