The National Insurance Crime Bureau ("NICB") does hereby donate to the City of Fort Worth SWAT Unit (the
"Agency") the equipment described as:
Shipping Container PIN IVMSKU87 3200
This equipment will be used by the Agency for furtherance of the purposes of the Agency, including, if the
Agency so determines the sale of some or all of the equipment to generate funds for the use of the Agency.
This agreement is subject to the following conditions:
1 The Agency accepts from the NICB, the above -described equipment for one dollar ($1.00) and other
valuable considerations for use in pursuit of its lawful purpose. The Agency shall accept said
equipment in "as is" condition and tho NICB makes no representations or warranties as to the condition
of any of the equipment.
2. In the ovent that any injury or property damage results from the above described equipment, either
after the Agency shall take possession of the equipment from the NICB or subsequently, then the
Age; icy shall assume all liability and will defend and indemnify the NICB against any and all liability
including reasonable attorney's fees..
3. The Agency does hereby release the NICB from any and all claims arising from its use of the
equipment.
4 The Agency agrees and warrants that it shall, if applicable, provide insurance coverage (self -insured
agency) for the above -described equipment in the normal course of its businoss.
5. The effective date of this agreement shall be the date the equipment is delivered into the custody of
the Agency.

RECOMMENDATION:
It is recommended that the City Council authorize the execution of an equipment donation Agreement
with the National Insurance Crime Bureau for the acceptance of two forty -foot shipping containers to
store equipment in preparation for the new training/Administration facility.
DISCUSSION:
On Fort Worth Police Department Theft Report No. 10-81839, two forty -foot shipping containers
valued in the amount of $3,000.00 each, were stolen and subsequently recovered. At the time of the
recovery, the containers were owned by One Beacon Insurance Company. The containers are
currently being stored at the auto pound One Beacon Insurance Company, rather than retrieving the
containers from the auto pound and paying the towing and storage fees, decided to donate the
containers to the National Insurance Crime Bureau (NICB). In turn, NICB is donating the containers to
the Fort Worth Police Department for the use of storing equipment in preparation for the new
training/administration facility. The cost, if any, of moving the containers will be the responsibility of
the Police Department.
FISCAL INFORMATION/CERTIFICATION:
The Financial Management Services Director certifies that this action will have no material effect on
City funds. The Police Department is responsible for accepting the delivery of this property.
