WHEREAS, the City of Fort Worth (CITY) and Criado & Associates, Inc (ENGINEER) made and entered into City Secretary Contract No. 44162, (the CONTRACT) which was authorized on the day of February 2013 in the amount of $38, 995. 00; WHEREAS, the CONTRACT involves engineering services for the following project: SILVER CREEK ROAD Preliminary Alignment, City Project#: xxxxx, Unit/Section: Brewer Drive to Live Oak Bridge, F/A/C: xxxxxxxx; and WHEREAS, it has become necessary to execute Amendment No. 1 to the CONTRACT to include an increased scope of work and revised fee. NOW HPREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1e Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated May 21, 2013, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $2 9, 610. 00 (See Attached Funding Breakdown Sheet, Page -3 ) 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $68,605.00. (CRIADO) is pleased to present this Amendment No.1 to the Engineering Services Contract for City Secretary Contract No. 44162 "Silver Creek Road Preliminary Alignment from Brewer Drive to Live Oak Bridge". This amendment includes three separate parts, as described below: PHASE 2A: ENGINEERING SERVICES FOR PRELIMINARY ALIGNMENT CRIADO will prepare a preliminary alignment with typical sections for the 1.3 miles of Silver Creek Road from Live Oak Bridge to Watercress Drive. Two bridges will be encountered in this section of the roadway, Silver Creek Bridge and Silver Creek Relief Bridge. The Silver Creek Bridge will be designed and replaced under a separate contract conducted by TxDOT North Tarrant County Area Office. CRIADO will coordinate the proposed roadway design with the proposed Silver Creek Bridge and with the existing Silver Creek Relief. Three 1" = 50' scale 60- inches long strip maps will be prepared as part of this phase showing the alignment of Silver Creek Road from Live Oak Bridge to Watercress Drive. This work will be based on LIDAR data to be provided by TxDOT and as calibrated/corroborated by CRIADO's survey field work. The estimated effort required to complete Phase 2A is $11,835. PHASE 2H: SURVEYING SEVICES FOR PRELIMINARY GEOMETRIC SCHEMATIC CRIADO will perform land surveying services as required to calibrate/corroborate LIDAR data provided to be provided by TxDOT. The main characteristics of existing Silver Creek Road roadway: centerline, edge of pavement, existing fences, ditches, culverts, etc. will be surveyed averaging 500-foot spacing for preparation of proposed cross sections. Existing improvements encountered between cross sections will be surveyed to accurately identify and locate the existing roadway elements that may impact proposed design. CRIADO will prepare proposed cross sections at intervals of 500-feet, including additional cross sections as required in areas critical to roadway design. The estimated effort required to complete PHASE 2B is $9,345. PHASE 2C: ENGINEERING SERVICES FOR PRELIMINARY GEOMETRIC SCHEMATIC CRIADO will prepare a preliminary geometric schematic for this section of the roadway. Plan and profile geometry will be coordinated with the two proposed replacement bridges (at Live Oak and at Silver Creek) and with the existing bridge at Silver Creek Relief Bridge (to remain). Three 1" = 50' horizontal scale & 1" = 5' vertical scale 60-inches long strip map schematics will be prepared as part of this phase showing the alignment and the profile of Silver Creek Road from Live Oak Bridge to Watercress Drive. This work will be based on LIDAR data to be provided by TxDOT and as calibrated/corroborated by CRIADO's survey filed work. Both the CITY and ENGINEER have attempted to clearly define the work to be performed and address the needs of the Project. OBJECTIVE The preparation of a preliminary aligment for Silver Creek Road from Live Oak Bridge to Watercress Drive (approximately 1.3 Miles). WORK TO BE PERFORMED Phase 2 — Silver Creek Road Preliminary Alignment from Live Oak Bridge to Watercress Drive (approximately 1.3 Miles): Phase 2a — Engineering Services for Preliminary Alignment Design: 1) Kickoff Meeting for Alignment Design with City Project Manager; 2) Collect existing project data and perform field reconnaissance, request and obtain TxDOT LIDAR file for project area; 3) Prepare Exhibit of Silver Creek Road Preliminary Alignment with existing and proposed paving for discussion of conceptual design options with City of Fort Worth. Alignments to be based on TxDOT provided LIDAR file, calibrated with cross sectional field data spaced at 500-ft 4) Coordinate alignment with Public Works for Future Alignment under current Master Thoroughfare Plan' 5) Coordinate with TxDOT roadway approaches to Live Oak Bridge, currently under design by TxDOT 6) Coordinate with City for connection to recently constructed pavement sections at Brewer Drive; 7) Coordinate with Planning for Future/Anticipated development projects; 8) Determine with City roadway typical sections: 2 lane undivided asphalt roadway with shoulder open drainage; 9) Recommend alignment modifications to improve design speed as well as intersection modifications (as possible); and 10) Prepare Letter Report with summary of findings, identifying apparent Right -of - Way acquisition areas for proposed roadway alignment, preparing preliminary cost estimate. Phase 2b — Surveying Services for Preliminary Geometric Schematic Design: 1) Research existing control points/city benchmarks; 2) Field search/recover found control points/city benchmarks; 3) Field establish horizontal/vertical control for site; 4) Data Collection/Topographic survey of existing roadway: a. Post process all field collected data* and b. Provide roadway cross -sections with 500' spacing. City of Fort Worth, Texas Attachment A PMO Release Date: 07.23.2012 Page 1 of 2 Phase 2c — Engineering Services for Preliminary Geometric Schematic Design: 1) Coordination Meeting for Schematic Design with City Project Manager 2) Prepare preliminary geometric paving plan and profile schematic of proposed alignment at 1"=50' H and 1"=5'V (approximately 1.5 miles of roadway 3 strip maps of 60-inches in length), based on TxDOT provided LIDAR file; 3) Prepare roadway cross sections with 500-foot spacing (from fence to fence, approximately 20 cross sections); 4) Obtain from City/TxDOT existing soil borings available along alignment 5) Determine preliminary earthwork quantities for project length from 500-ft spaced cross sections (average end method); and 6) Prepare Engineers estimate of probable construction cost. ADDITIONAL SERVICES NOT INCLUDED IN THE EXISTING SCOPE OF SERVICES Additional Services not included in the existing Scone of Services — CITY and ENGINEER agree that the following services are beyond the Scope of Services described in the tasks above. However, ENGINEER can provide these services if needed, upon the CITY's written request Any additional amounts paid to the ENGINEER as a result of any material change to the Scope of the Project shall be agreed upon in writing by both parties before the services are performed. These additional services include the following: • • • • • • • • • Negotiation of easements or property acquisition. Services related to development of the CITY's project financing and/or budget. Services related to disputes over pre -qualification, bid protests, bid rejection and re -bidding of the contract for construction. Construction management and inspection services Performance of materials testing or specialty testing services. Services necessary due to the default of the Contractor. Services related to damages caused by fire, flood earthquake or other acts of God. Services related to warranty claims, enforcement and inspection after final completion. Services to support, prepare, document, bring, defend, or assist in litigation undertaken or defended by the CITY. Performance of miscellaneous and supplemental services related to the project as requested by the CITY. Compensation A. The ENGINEER shall be compensated a total lump sum fee of $ 29,610.00 as summarized in Exhibit B-1 — Engineer Invoice and Section IV — Summary of Total Project Fees. The total lump sum fee shall be considered full compensation for the services described in Attachment A including all labor materials, supplies, and equipment necessary to deliver the services The ENGINEER shall be paid monthly payments as described in Section II - Method of Payment. II. Method of Payment A. Partial payment shall be made to the ENGINEER monthly upon City's approval of an invoice prepared and submitted by the ENGINEER in the format and including content as presented in Exhibit B-1, Progress Reports as required in item III. of this Attachment B, and Schedule as required in Attachment D to this Agreement. B. The estimated current physical percent complete as required on the invoice shall be calculated from the progress schedule as required in Attachment D to this Standard Agreement and according to the current version of the City of Fort Worth's Schedule Guidance Document. C. The cumulative sum of such monthly partial fee payments shall not exceed the total current project budget including all approved Amendments. D. Each invoice shall be verified as to its accuracy and compliance with the terms of this Agreement by an officer of the ENGINEER III. Progress Reports A. The ENGINEER shall prepare and submit to the designated representative of the Transportation and Public Works Department monthly progress reports and schedules in the format required by the City.
