HomeMy WebLinkAboutContract 44195 (2)eirt SECRETARY The North Central Texas Fusion Center (NCTFCI CONTRACT AID_ ,L-I (--4 I .._ Memorandum of Agreement Memorandum of Agreement Concerning the North Central Texas Fusion Center Between the Undersigned Agencies THIS MEMORANDUM OF AGREEMENT (MOA) entered into between the undersigned agencies, sets forth guidelines regarding the Advisory Board of the North Central Texas Fusion Center and shall become effective upon signature. 1. PURPOSE 1.1. Provide a framework and working mechanism for the North Central Texas Fusion Center to address issues that are common to participating agencies and assure the success of the North Central Texas Fusion Center through the achievement of coordination and cooperation. 1.2. Define the working relationships of the parties adhering to this MOA. 1.3. Outline the intent of the parties regarding the operation and administration of the North Central Texas Fusion Center. 1.4. Identify objectives to seek funding for the North Central Texas Fusion Center. 2. SCOPE AND OBJECTIVE 2.1. Since September 11, 2001 local, state, and federal law enforcement officials have been working hard to restore order and confidence to the public and to identify those responsible for the terrorist attacks committed against the United States of America. These officials have also been working to find ways to prevent or mitigate future terrorist acts, which has led to the development of a number of strategies and programs designed to strengthen domestic security. 1 OFFICIAL, IRECOIdn CITY SECRETpRS7 G u� WORTH, i� �' The North Central Texas Fusion Center (NCTFC) Memorandum of Agreement 2.2. These strategies focus on improving communication and coordination between local, state, and federal and tribal agencies and developing ways to combine relevant information from disparate databases, in order to maximize the usefulness of available information. 2.3. For state and local law enforcement agencies to be true partners in homeland security, public health, and emergency management, improvements must be made in communication and information sharing between local, state, and federal and tribal law enforcement agencies. The establishment of the North Central Texas Fusion Center combines the intelhgence efforts of all participating agencies and will greatly enhance the ability of law enforcement agencies to prevent and respond to unlawful activity and terrorist threats to our community. 3. ORGANIZATION AND MANAGEMENT 3.1. The Executive Board will be comprised of one representative from the following agencies: -Allen Police Department Chief -Carrollton Pohce Department Chief -Collin County District Attorney -Collin County Judge -Collin County Sheriff -Collin County Health Authority -Frisco Police Department Chief -Garland Police Department Chief -McKinney Police Department Chief -Plano Police Department Chief -President of Collin County Fire Chief's Association -Richardson Police Department chief -Texas Department of Public Safety -Wylie Fire Department Chief -Wylie Police Department Chief Members will have an equal vote on all matters before the Board In addition, representatives fiom local, regional, state, and federal agencies may serve as Ex Officio members in a non -voting capacity, subject to approval by the Advisory Board. 3.1.1. Members of the Executive Board shall be familiar with the policy governing the establishment of the Board, its governance and structure as redacted by the North Texas Fusion Center. 2 The North Central Texas Fusion Center (NCTFC) Memorandum of Agreement 3.1.2. The Executive Boaid will adopt a set of bylaws to govern the conduct of the Board. 3.1.3. The Executive Board will provide quarterly reports on the activities of the Center to the participating agency head. 3.1.4. The Collin County Auditor will provide the Executive Board the giant expenditures, annually to review and comment. 3.2. The Executive Board may appoint committees, working groups, and other entities to assist in the management and development of the Center. 4. DISTRIBUTION OF WORK 4.1. Each participating agency has the power and authority to commit its respective agency's resources and personnel to the North Central Texas Fusion Center. 4.1.1 Additional members may be assigned by the Executive Board based on workload and the needs of the Center. 4.2. Participating agencies agree to conduct investigative follow-up to leads developed by the Center and forwarded to the agency 5. FINANCIAL 5.1. Participating law enforcement agency employees will carry out designated functions at their own agency's expense, including salaries, benefits and local transportation 6. SECURITY 6.1. The Director of the Center shall be responsible for establishing appropriate security measures to ensure the integrity of the operations of the Center. 6.1.1. All members will require a Secret Clearance 6.1.2. The Director shall report on security measures at each meeting of the Executive Board. 3 The North Central Texas Fusion Center (NCTFC) Memorandum of Agreement 6.1.3. Any breech of security shall immediately be reported to the members of the Executive Board 6.2. Each participating agency shall be responsible for ensuring that appropriate background checks have been made on each member assigned to the Center and each member who is authorized to receive information fiom the Center. 6.3. The Executive Director shall have the discretionary authority to deny the assignment of an individual to the Centel and/or deny access to any mfotivation of the facility itself for security reasons 6.4. The Center shall utilize the "Third Agency Rule" and not disclose an agency's information without the approval of that agency. 7. PRIVACY 7.1. In addition to other policies promulgated, the Executive Board shall establish a Privacy Policy to ensure that the rights of citizens are not abridged by the operations of the Center and each participating agency shall agree to abide by it when using the North Central Texas Fusion System data or resources. 7.2. If the Center utilizes federal funding to support its operations, the Center shall adhere to the rules of intelligence sharing as articulated in Section 28 of the Code of Federal Regulations Part 23. 7.3. Information made available to the Board shall be given all necessary security protection in accordance with applicable laws and regulations Each member of the Board and each of the Board's consultants shall execute an agreement of non -disclosure. 8. DISPUTE RESOLUTION 8.1. Any dispute concerning the operations of the Center that may arise between the participating agencies shall be referred to the Executive Board for resolution 8.2. This Memorandum of Agreement is an ad honorem document and not a legally binding agreement and may not be referred to an arbitrator or be the subject of any legal proceeding. 4 The North Central Texas Fusion Center (NCTFC1 Memorandum of Agreement 9. AMENDMENTS 9.1. Amendments to this MOA shall be proposed upon a majority vote of the Executive Board and must be approved by all signatures on this MOA. 9.2. The acceptance of additional participating agencies shall be considered an amendment to this MOA and shall not cause the need for a new MOA. 10. DURATION AND TERMINATION 10.1. The terms of this MOA shall remain in situ until such time a participating agency withdraws from the agreement 10.2. Any agency may withdraw from this agreement upon the receipt of a written notice. Such notice shall be provided to the Board by the outgoing agency within 30 days. IN FURTHERANCE OF their respective goals, objectives, and missions, the parties jointly agree to abide by the provisions of this MOA. IN WITNESS WHEREOF, the parties hereto have caused this MOA to be duly executed. 5 The North Central Texas Fusion Center (NCTFCI Memorandum of Agreement Executive Advisory Board Date: 2012-10-31 AMENDMENT 1 Acceptance of additional participating agencies.
