HomeMy WebLinkAboutContract 44022-R1 (2)FIRST RENEWAL AND AMENDMENT OF CITY SCRETARY CONTRACT NO. 44022 — INTERLOCAL AGREEMENT BETWEEN FORT WORTH INDEPENDENT SCHOOL DISTRICT AND THE CITY OF FORT WORTH THIS FIRST RENEWAL AND AMENDMENT OF CITY SECRETARY CONTRACT 44022, AN INTERLOCAL AGREEMENT BETWEEN THE FORT WORTH INDEPNDENT SCHOOL DISTRICT AND THE CITY OF FORT WORTH ("First Renewal and Amendment"), by and between the CITY OF FORT WORTH, a home -rule municipal corporation of the State of Texas, ("City") and the BOARD OF TRUSTEES of the FORT WORTH INDEPENDENT SCHOOL DISTRICT, a political subdivision of the State of Texas and a legally constituted Independent School District ("FWISD"). This First Renewal and Amendment is made under the authority granted to the City and the FWISD by and pursuant to Chapter 791 of the Texas Government Code, known as the Interlocal Cooperation Act. WHEREAS, teachers, students, parents, and community members have identified increased academic and cultural enrichment activities outside the school day as a major need; WHEREAS, on October 19, 2012, the Fort Worth City Council approved . M&C C-25915, authorizing the City Manager to execute an agreement with the FWISD to provide after school programming at specified district schools (Fort Worth City Secretary Contract No. 44022) ("Agreement"); options; WHEREAS, the Agreement provides for an initial one-year term with two, one-year renewal WHEREAS, the initial term of the Agreement expires on July 31, 2013; WHEREAS, on September 17, 2013, the Fort Worth City Council approved M&C C-26440, authorizing the City to extend the term of the Agreement for one additional year effective from August 1, 2013 through July 31, 2014 and revise the funding amount from $106,300.00 to $85,020.00; follows: NOW, THEREFORE, the City and FWISD hereby agree to renew and amend the Agreement as I. Renewal The City and FWISD agree to renew and extend the Agreement for a first renewal term of one year, beginning on August 1, 2013 and ending on July 31, 2014 ("First Renewal Term"). II. Amendment The parties wish to amend Section 2.A. of the Agreement titled "FUNDING" to revise the amount of funding that the City receives under the Agreement for the operation of the CLC Program at both Rosemont Middle School and Daggett Middle School as it pertains to the First Renewal Term and any subsequent renewal term (unless modified further by written agreement of the parties). FWISD and the City agree that these amounts fairly compensate the City for the operation of the CLC Programs." III. Miscellaneous 1. All other terms and provisions of the Agreement between the City and the FWISD shall remain in full force and effect except as specifically amended or set forth herein. 2. All terms in this First Renewal and Amendment that are capitalized but not defined shall have the meanings assigned to them in the Agreement. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund in the amount of $85,020.00. DISCUSSION. DISCUSSION: On August 8 2000 (M&C C-18183), September 21, 2004 (M&C C-20287) and October 20, 2009 (M&C C-23869) the City Council approved Interlocal Agreements with the Fort Worth Independent S chool District (FWISD) to provide after -school programming at Rosemont and Daggett Middle S chools. The purpose of this Mayor and Council Communication is to allow the City of Fort Worth (City) to continue providing this after -school programing at Rosemont and Daggett Middle Schools.
