HomeMy WebLinkAboutContract 52947-A2 Date Received: Jul 15,2020 City Secretary Time Received: 12:02pm Number: 52947-A2 SECOND AMENDMENT TO CITY SECRETARY CONTRACT NO.52947, EASEMENT ENCROACHMENT LICENSE AGREEMENT This SECOND AMENDMENT TO CITY SECRETARY CONTRACT NO.52947, EASEMENT ENCROACHMENT LICENSE AGREEMENT is made and entered into by and between the CITY OF FORT WORTH,a home rule municipal corporation of Tarrant County,Texas ("City'),acting herein by and through its duly authorized City Manager,Assistant City Manager,or Development Services Department Director,and Cook Children's Medical Center,a nonprofit corporation("Licensee"),acting herein by and through its duly authorized Vice President of Construction and Real Estate. RECITALS WHEREAS,City and Licensee made and entered into City Secretary Contract No.52947 on October 17,2019(the"Agreement")to authorize the use of the City's easement for the purpose of installing soldier piers,and City Secretary Contract No.52947-Al on May 11,2020(first amendment)t¢ include installation of private storm,a grate inlet and curb inlet;and WHEREAS,the parties wish to amend the Agreement to include approximately 151 LF of 1" conduit,4 private pedestrian street lights,8 bollards,and 91 SY of colored concrete pavement;and WHEREAS,it is the mutual desire of City and Licensee to execute this Amendment to the Agreement to revise"Exhibit A"in the Agreement to depict the revised encroachment area. NOW,THEREFORE,City and Licensee,acting herein by and through their duly authorized representatives,enter into the following that amends the Agreement: 1. "Exhibit A"in the Agreement is hereby replaced with the attached revised description of the encroachment area, labeled as"Revised Exhibit A."
