HomeMy WebLinkAboutOrdinance 17727-08-2007ORDINANCE NO. 17727-08-2007 AN ORDINANCE ADJUSTING THE TOTAL NUMBER OF AUTHORIZED CIVIL SERVICE POSITIONS IN THE POLICE DEPARTMENT; ADDING TI3REE SERGEANT POSITIONS AND TWENTY-FIVE POLICE OFFICER POSITIONS; PROVIDING A STATEMENT OF PURPOSE AND INTENT FOR THE ADOPTION AND IMPLEMENTATION OF THIS ORDINANCE; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR ENGROSSMENT AND ENROLLMENT OF THIS ORDINANCE; AND PROVIDING AN EFFECTIVE DATE. BE IT HEREBY KNOWN: WHEREAS, the Police Chief has requested the City Council to readjust and thereafter specify the total number of authorized civil service positions at the police officer rank in the Police Deparhnent into conformity with the proposed changes as set forth immediately below in order to effect efficient economy of the operations of the Police Department; and WI~REAS, on July 31, 2007, the City Council approved the most recent ordinance concerning the authorized positions for the Police Department. In that Ordinance, the Council adjusted the Police Deparhnent's civil service staffing, effective July 1st, 2007, as follows: Deputy Chief 5 Captain 13 Lieutenant 46 Sergeant 151 Corporal/Detective 181 Police Officer 1,055 Total 1,451 WHEREAS, in the budget plan approved for fiscal year 2007, funds were approved for three sergeants andtwenty-four officer positions in the General Fund and one officer position in the Grants Fund effective September 1, 2007; and WHEREAS, pursuant to Chapter 143.021 (a), Texas Local Government Code, the City Council may prescribe the authorized number of positions in each classification (rank) and the correct number of civil service positions by ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF TIIE CITY OF FORT WORTH, TEXAS: SECTION 1. That, effective upon the formal adoption of this ordinance, the following positions shall be the only civil service positions in each classification (rank) authorized in the City of Fort Worth Police Department for the remainder of the fiscal year 2006-2007 or until modified by subsequent ordinance: Deputy Chief 5 Captain 13 Lieutenant 46 Sergeant 154 CorporaUDetective 181 Police Officer 1,080 Total 1,479 SECTION 2. The "Mayor and Council Communication" memorandum, which is presented contemporaneously with this ordinance, is hereby expressly incorporated herein by reference for further clarification and explanation of the purpose and intent of the Council in their adoption as well as the Department's implementation of this ordinance. SECTION 3. This ordinance shall be cumulative of all provisions of previous ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of prior civil service staffing ordinances for the Police Department and such Code, in which event conflicting provisions of such ordinances and such code provisions are hereby repealed and this ordinance shall be controlling. SECTION 4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of these ordinances are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. This ordinance shall take effect and be in full force and effect from and after its passage, and it is so ordained. No. 17727-08-2007 DATE: Tuesday, August 28, 2007 LOG NAME: 35STAFFING REFERENCE NO.: **G-15843 SUBJECT: Adopt Civil Service Staffing Ordinance Increasing Authorized Strength in the Police Department by 25 Police Officers and 3 Sergeants RECOMMENDATION: It is recommended that the City Council adopt the attached Ordinance specifying the authorized positions in the Police Department, increasing the number of authorized positions by 25 Police Officers and three Sergeants, including 24 officers and three sergeants in the General Fund and by one Police Officer in the Grants Fund. DISCUSSION: During the FY2006-2007 General Fund Budget process, the following sworn assignments were approved for the Police Department with one month's funding: Police Officers: 25 Patrol Officers Sergeant: 3 Patrol Sergeants In addition, the City Council authorized the City Manager to apply for and accept a grant (M&C C-21508) in the amount of $450,000 from the Office for Victims of Crime for the purpose of supporting law enforcement initiatives to identify and rescue victims of human trafficking. This grant allows the City to establish a Fort Worth Police Department Anti-Trafficking Program in collaboration with the U.S. Attorney for the Northern District of Texas, the Department of Homeland Security, Immigration and Customs Enforcement, and Mosaic Family Services Inc. The grant has since been awarded and includes salary and benefits for one law enforcement officer and one public education program coordinator. The Police Department's authorized civil service strength is 1,451. Upon approval of the attached ordinance, the assignment of civil service positions authorized for the Police Department will result in the addition of 25 Police Officers (including one grant funded officer) and three Sergeants. The addition of the positions referred to above would result in the following changes in the authorized strength of the Police Department effective September 1, 2007. (See table below.)
