Home My WebLink AboutOrdinance 17732-08-2007ORDINANCE NO. 17732-08-2007 AN ORDINANCE ORDERING A SPECIAL ELECTION TO BE HELD IN THE CITY OF FORT WORTH, TEXAS ON TUESDAY THE 6T" DAY OF NOVEMBER, 2007, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY THE QUESTION OF WHETHER THE CITY OF FORT WORTH SHOULD BE AUTHORIZED TO ESTABLISH COLLECTIVE BARGAINING FOR THE FIREFIGHTERS IF A MAJORITY OF THE AFFECTED EMPLOYEES FAVOR REPRESENTATION BY AN EMPLOYEES ASSOCIATION. WHEREAS, the City of Fort Worth has received a petition requesting that the question of whether to adopt Chapter 174 of the Texas Local Government Code relating to collective bargaining for firefighters be submitted to the voters of the City of Fort Worth; and WHEREAS, the City Secretary has determined that the petition meets the requirement of law; and WHEREAS, Chapter 174 requires that the City Council should order an election on the first uniform election day that allows sufficient time for compliance with any requirements established by law; and WHEREAS, the Texas Election Code establishes November 6, 2007 as a uniform election date; and WHEREAS, as authorized by Subchapter D of Chapter 31 of the Texas Election Code, the City of Fort Worth anticipates entering into a contract for election services with Tarrant County. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. ELECTION ORDERED In compliance with the Charter of the City of Fort Worth and in accordance with the Constitution and laws of the State of Texas, the City Council hereby orders that an election be held on Tuesday, November 6, 2007, for the purposes identified herein between the hours of 7 a.m. and 7 p.m. SECTION 2. PROPOSITION That at said election, the following proposition shall be submitted in accordance with Section 174.051 of the Texas Local Government Code: PROPOSITION 1. Adoption of the state law applicable to fire fighters that establishes collective bargaining if a majority of the affected employees favor representation by an employees association, preserves the prohibition against strikes and lockouts, and provides penalties for strikes and lockouts. SECTION 3. BALLOT That the official ballots to be used in such election shall be prepared in accordance with Sections 52.072 and 52.073 of the Texas Election Code, as amended. The ballots shall permit the electors to vote "For" or "Against" the aforesaid proposition and shall be set forth in substantially the following form: Adoption of the state law applicable to fire fighters that establishes collective ^ FOR bargaining if a majority of the affected employees favor representation by an employees association, preserves the ^ AGAINST prohibition against strikes and lockouts, and provides penalties for strikes and lockouts. SECTION 4. POLLING LOCATIONS The locations of the polling places for the election, except insofar as they may be changed by the City Council, are set forth on Exhibit "A" attached hereto and made a part hereof. 2 SECTION 5. EARLY VOTING (a) Early Voting Clerk. Steve Raborn, Tarrant County Elections Administrator, shall serve as the early voting clerk. Marty Hendrix, City Secretary of the City of Fort Worth, shall serve as chief deputy early voting clerk. (c) Applications for Ballot. Applications for ballots by mail shall be mailed to Steve Raborn at the address set out in subsection (a). Applications for ballot by mail must be delivered no earlier than September 7, 2007 and received no later than the close of business on October 30, 2007. Applications may be delivered in person to him not later than close of business on October 21, 2007. (d) Early Voting Tarrant County Residents. Early voting by personal appearance of Fort Worth residents that live in Tarrant County shall be conducted beginning October 22, 2007, and continuing through November 2, 2007. ADMINISTRATIVE MATTERS (a) The Office of the Tarrant County Elections Administrator, Tarrant County Elections Center, 2700 Premier, Fort Worth, Texas, is hereby established as the Central Counting Station for the ballots cast in said election. 7 (b) An individual, having knowledge and experience in the conduct of elections with the electronic voting system for which the Central Counting Station is established, and being a registered voter of the City of Fort Worth, shall be appointed by Tarrant County as the Manager of the Central Counting Station. The Manager shall be in charge of overall administration of the Central Counting Station and the general supervision of the personnel working at the Station. (c) Individuals trained in the operation of the automatic tabulating equipment installed at the Central Counting Station, shall be hereby appointed by Tarrant County as Tabulation Supervisors. The Tabulation Supervisors shall be in charge of the operation of the automatic tabulating equipment. (d) An individual shall be appointed by Tarrant County as Assistant to the Tabulation Supervisor. Such assistant shall assist the Tabulation Supervisor in the operation of the automatic tabulating equipment as directed by the Tabulation Supervisor. (e) An individual shall be appointed by Tarrant County as Presiding Judge of the Central Counting Station. He shall maintain order at the Central Counting Station and shall have such authority as may be prescribed by the Texas Election Code (f) The polling places, on election day, November 6, 2007, shall be kept open from 7:00 a.m. to 7:00 p.m., and that due return shall be made to the City Council showing the number of votes cast for and against Proposition 1. (g) That the Tarrant County Elections Administrator shall be responsible for conducting the election and shall furnish the election officials said ballots and 8 voting equipment, together with any other forms, blanks or instruction in accordance with the laws of the State of Texas, insofar as same are applicable, and with the provisions of this ordinance. SECTION 7. PUBLICATION That notice of said elections shall be given by: (1) publishing a copy of this ordinance, in English and in Spanish, at least once, not earlier than the 30t" day or later than the 10t" day before election day in a newspaper published in said City; and (2) not later than the 21St day before election day, posting a copy of this ordinance, in English and in Spanish, on the City's board used for posting notices of the meeting of the Fort Worth City Council. SECTION 8. NOTICE That the way and manner of holding said elections, the notice to be given therefore, the polling places, the personnel and the officers who are to hold same, and all details connected with the holding of the elections shall be provided for and arranged by the City Secretary; that the proper notice and publication of this notice, proclamation and ordinance shall be only cumulative of and in addition to the statutory notice of said elections as herein provided; and that any omission or irregularity in this notice or in the publication or posting of this notice, proclamation and ordinance, or in the signing of same, shall not in any way affect or invalidate such election. 9 SECTION 9. CONTROLLING LAW That in all respects, said elections shall be conducted in accordance with the Texas Election Code and the City Charter of the City of Fort Worth. SECTION 10. OPEN MEETING COMPLIANCE That it is hereby officially found and determined that the meeting at which this ordinance was adopted and said election was called was open to the public and public notice of the time, place and purpose of said meeting was given, all as required by Chapter 551 of the Texas Government Code. SECTION 11. That this ordinance, election order, proclamation and notice shall take effect upon adoption.
