HomeMy WebLinkAboutResolution 5254-07-2020 A Resolution NO. 5254-07-2020 CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE ELECTION HELD ON TUESDAY, JULY 14, 2020, ON THE CONTINUATION OF THE FORT WORTH CRIME CONTROL AND PREVENTION DISTRICT FOR TEN (10) YEARS AND THE CONTINUATION OF THE DISTRICT'S ONE-HALF CENT SALES TAX FOR TEN (10) YEARS. WHEREAS,the Crime Control and Prevention District is governed by Chapter 363 of the Texas Local Government Code; and WHEREAS, on November 12, 2019, the Board of Directors of the Fort Worth Crime Control and Prevention District adopted a Resolution calling for an election to be held on Saturday, May 2, 2020, on the continuation of the Fort Worth Crime Control and Prevention District (the "District") for ten (10) years and the continuation of the District's one-half cent sales tax for ten(10)years; and WHEREAS, in response to concerns regarding holding the election during shutdowns and stay-at-home orders associated with the novel coronavirus known as COVID-1, a petition was made to the Governor of the State of Texas to allow the date and time of the election to be changed; and WHEREAS, in accordance with an April 2, 2020 proclamation of the Governor of the State of Texas authorizing a non-uniform election date for the District continuation election, the Board of Directors on April 7 adopted two resolutions —one cancelling the election called for Saturday, May 2, 2020, and a second calling an election for Tuesday, July 14, 2020, on the continuation of the Fort Worth Crime Control and Prevention District(the "District") for ten(10)years and the continuation of the District's one-half cent sales tax for tenl(10) years in accordance with the Governor's April 2, 2020, proclamation authorizing such an election and WHEREAS, on July 14, 2020, the duly called and ordered election to consider continuation of the District and its one-half cent sales tax was held, at which election the qualified voters of the District had the opportunity to vote for or against the proposition authorizing the continuation of the District and its one=half cent sales tax; and WHEREAS, on July 24, 2020, the Board of Directors of the Fort Worth Crime Control and Prevention District adopted a Resolution canvassing the votes and making certain findings concerning the results of said election, a copy of which Resolution and the findings therein, is attached hereto and made a part hereof, and WHEREAS, under Chapter 363 of the Texas Local Government Code, a voter approved sales and use tax for a municipally created district is imposed under Section 323,108 of the Texas Tax Code for financing the operations of the district; and WHEREAS, pursuant to Section 321.405 of the Texas Tax Code, the City Council of the City of Fort Worth is required to declare by resolution the results of said election. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OFFORT WORTH,TEXAS: Section 1. That the matters and facts set forth in the Preamble of this Resolution are hereby found D be true and correct. Section 2. That the City Council hereby finds and declares that the election to continue the District and its one-half cent sales tax for ten (10)years was held on Tuesday,July 14, 2020. Section 3. That the City Council further finds and declares that at said election, the qualified voters of the District were permitted to vote for or against the following Proposition: "WHETHER THE FORT WORTH CRIME CONTROL AND PREVENTION DISTRICT SHOULD BE CONTINUED FOR TEN (10) YEARS AND THE CRIME CONTROL AND PREVENTION DISTRICT SALES TAX OF ONE-HALF CENT SHOULD BE CONTINUED FOR TEN(10)YEARS." Section 4. That the City Council further finds and declares that the total votes cast at said election by the qualified voters of the District for and against the proposition were as follows: Tarrant County Denton County Parker County Total For 35,581 418 46 36,045 Against 19,751 161 18 19,930 Section 5. That the City Council further finds and declares the result of the election to be that the Proposition so submitted received a favorable majority vote in all respects and was approved by a margin of 16,115 votes; that pursuant to Chapter 363 of the Texas Local Government Code,the Fort Worth Crime Control and Prevention District is authorized to continue operating within the prescribed boundaries of the District fbr an additional ten years; that accordingly, a local sales tax of one-half of one percent has been authorized to continue for an additional ten years; that said tax may continue to be levied and collected as voted and provided by law to assist in funding the continuation of the District and the carrying out of the District's crime control and prevention plan; and it is so ordered. Section 6. That it is hereby officially found and determined that the meeting of the Fort Worth City Council at which this Resolution was adopted was open to the public and that public notice of the time, place and purpose of said meeting was given, all as required by Chapter 551 of the Texas Government Code, as amended, and as temporarily modified by orders of the Texas Governor issued in connection with the disaster declaration of March 13, 2020. Section 7. That this Resolution shall take effect and be in full force and effect from and after the date of its adoption, said date being the 241h day of July, 2020. That the matters and facts set forth in the Preamble of this Resolution are her by found to be true and correct. Section 2. That the Board of Directors of the District finds and determines that the continuation election of the District and of its one-half cent sales tax, was duly ordered; that proper notice of said election was given; that said election was duly held, wherein only qualified voters of the District voted in the continuation election; and that due return of the results for said election have been made and delivered to the Board of Directors of the District, all in accordance with the Resolution ordering and calling said election and with state law. Section 3. That the Board of Directors of the District further finds and determines that such returns are correct, and adopts them as the returns of the election held on July 14, 2020, together with the tabulation of the total number of votes received in each precinct. Attached hereto as Exhibit "A" and incorporated herein are the cumulative election results of Tarrant Co ty. Attached hereto as Exhibit `B" and incorporated herein are the cumulative election result3 of Denton County. Attached hereto as Exhibit "C" and incorporated herein are the cumulative election results of Parker County. Section 4. That the Board of Directors of the District officially finds and declares that the following votes were cast at said election on the submitted Proposition by the qualified voters of the District voting at said election: PROPOSITION "WHETHER THE FORT WORTH CRIME CONTROL AND PREVENTION DISTRICT SHOULD BE CONTINUED FOR TEN (10) YEARS AND THE CRIME CONTROL AND PREVENTION DISTRICT SALES TAX OF ONE-HALF CENT SHOULD BE CONTINUED FOR TEN (10) YEARS" Tarrant County Denton County Parker County Total For 35,581 418 46 36,045 Against 19,751 161 18 19„930 Section 5.
