TO CITY SECRETARY CONTRACT No. 50024
WHEREAS, the City of Fort Worth (CITY) and Fort Worth Zoological
Association, (ZOO) made and entered into City Secretary Contract No.
50024, (the CONTRACT) which was authorized by M&C C-28408 on the 26th day
of September, 2017 in the amount of $309, 169 . 06; and
WHEREAS, the CONTRACT provides for the City to fund utility work
services for the following project:
Shop and Warehouse Project; and
WHEREAS, it has become necessary to execute Amendment No. 1 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ZOO, acting herein by and through their duly
authorized representatives, enter into the following agreement, which
amends the CONTRACT:

The CONTRACT is amended to include the additional work described in
Attachment A and incorporated herein. The cost to City for the
additional utility work to be performed by ZOO totals $282, 869. 49, so
that the total fee paid by the City for all work and services shall be an
amount of $592, 038 .55 .
2 .
All other provisions of the Contract, which are not expressly
amended herein, shall remain in full force and effect.

HEARING:
SUBJECT: Authorize Execution of Amendment No. 1, in the Amount of$282,869.49, to
an Infrastructure Construction Agreement with the Fort Worth Zoological Association for
the Shops and Warehouse Project for a Revised Amount of$592,038.55 (ALL COUNCIL
DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council: authorize the execution of Amendment No. 1, in the amount
of$282,869.49, to City Secretary Contract No. 50024, an Infrastructure Construction Agreement with
the Fort Worth Zoological Association for the construction of Shops and Warehouse for a revised
amount of$592,038.55.
DISCUSSION:
The purpose of this Mayor and Council Communication (M&C) is to authorize the execution of an
amendment to an Infrastructure Construction Agreement (ICA) with the Fort Worth Zoological
Association (FWZA) (M&C C-28408 CSC 50024) to provide for adjustments due to unforeseen
conditions and cost overruns for the utilities related to the FWZA Shops and Warehouse project under
the terms of the Management Agreement (CSC 40564 M&C C-24194).
The Shops and Warehouse ICA established a budget not to exceed $309,169.06. However, following
the bid advertisement and opening, a second stormwater line was discovered on site, necessitating
additional work by FWZA in the amount of$282,869.49. Additional funding for this work was approved
by Council on June 12, 2018, M&C G-19305.
This project will have no impact on the Park& Recreation Department's annual operating budget when
completed.
The Fort Worth Zoo is located in COUNCIL DISTRICT 9 and is classified as a Special-Use Facility
that serves a City-wide and regional basis.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that upon approval of this M&C, funds are available in the current
capital budget, as appropriated, of the General Capital Projects Fund for the Zoo Shops and
Warehouse Project. The Park & Recreation Department has the responsibility to validate the
availability of funds prior to the expenditure of funds.
