This Supplement adds to the Contract attached hereto as Exhibit A. To the extent of any conflict, this Supplement amends and controls over the provisions of the Contract attached hereto. 1. On January 30, 2020, the Director of the World Health Organization declared the outbreak of COVID-19 a Public Health Emergency of International Concern. On March 13. 2020, the President of the United States declared the COVID-19 pandemic an emergency for all the states; the Governor of Texas declared a State of Disaster: and the Tarrant County Judge issued a Declaration of Local Disaster Due to Public Health Emergency.Thereafter, there have been declarations and orders from various levels of government and from public health officials that impact Tarrant County,Texas. 2. Because of the pandemic, voting in Tarrant County has been impacted. The Primary Run-off Elections that would have been held on Tuesday, May 26, 2020, and the municipal, independent school district, and other entity elections that would have been held on Saturday, May 2,2020, have been postponed and rescheduled. Some of these elections are now scheduled to be held on Tuesday, July 14, 2020. 3. A supplement mirroring this one will be executed by each political party having a primary run-off election and by each entity that seeks to have the Tarrant County Elections Administrator handle their election on the same date. 4. To the extent that any expenses were previously incurred by the Elections Administrator relating to the Election before it was postponed, those expenses shall be bome by the Entity Holding Election, which entity shall promptly reimburse the Tarrant County Elections Administrator. The expenses incurred prior to the postponement are in addition to the expenses generated by the July 14, 2020,election. 5. Because the Election will be held on a date alongside other elections, the Entity Holding Election agrees that: a. Polling locations will be shared. All agree to utilize polling sites selected by the political parties having primary run-off elections. As to sites that are outside the geopolitical boundaries of the Entity Holding Election, said Entity will not be required to share the costs attributable to that site. However, Entity's voters may vote at such site. Elections Administrator may arrange each polling location in a way that permits a qualified voter to choose to vote in either Primary Run-Off Election and to vote in the election of the Entity Holding Election. No voter will be permitted to obtain a ballot for an election in which that voter is not qualified to vote. A voter who does not qualify to or does not wish to vote in a Primary Run-Off Election will be permitted to obtain a non-partisan ballot at the polling location and will not be considered to have voted in either political party's Primary Run-Off Election.Appropriate written material and/or signage will be available and on display at the polling sites explaining this. Elections Administrator shall word and cause to be made available to the public the written information. b. To the extent required by law,and when permitted by law and deemed appropriate in the sole discretion of the Elections Administrator, voting and early voting will run the same days, for the same times, and in the same manners as the law, including any Orders from Courts with jurisdiction, permits or requires elections to be held for any of the other entities holding w an election or primary run-off election in Tarrant County on the day of the contracted election. The purposes of this provision are to make the voting process less confusing and less cumbersome to the voters,to make the logistics of running multiple elections side by side as smooth as possible, and to minimize costs where possible. 1. This provision will NOT be read to require the Political Parties holding Primary Run- off elections to have a joint Primary Run-off election with another Political Party in the absence of the agreement by both Political Parties to do so. 6. Because the change in election dates and the continued prevalence of COVID-19 have created a situation where the availability of polling sites and election workers for the date of the election are unknown, the Entity Holding Election authorizes Elections Administrator to take such steps as in his sole discretion are necessary to protect the right to vote and the integrity of the vote. This includes combining polling locations and moving or adding election workers as needed. To the extent possible, the Elections Administrator will notify the Entity Holding Election and attempt to follow the usual protocols in carrying out these changes. By their signatures below, the Elections.Administrator and the Entity Holding Election warrant and represent that they are authorized to enter into this Contract.
