HomeMy WebLinkAboutContract 49559-A4 AMENDMENT NO. 4 TO AGREEMENT STANDARD AGREEMENT FOR PROFESSIONAL SERVICES OLD HEMPHILL ROAD DROP-OFF STATION ADDITION STATE OF TEXAS CITY SECRETARY CONTRACT No.49559-A4 COUNTY OF TARRANT WHEREAS, The City of Fort Worth and Elements of Architecture, Inc., (Consultant) made and entered into City Secretary Contract No. 49559 (The Contract) which was authorized by the City Council by M&C Reference No.: C-28324, the 15th day of August, 2017, for Old Hemphill Road Drop-Off Station Addition; and Amendments No. 1, No. 2, & No. 3 were administratively executed in the amount of $46,781.00 for revisions to the PD site plan; and for additional signage design services, security modifications to existing site surveillance, and additional construction administration services due to changes in the construction sequence; and design services agreement for additional site lighting and provision for additional security cameras including photometric study to confirm light coverage to enhance security, respectively; and WHEREAS, further amendment is necessary to reimburse the Consultant as part of the design services agreement for revisions to the existing scrap metal yard including site modifications. This additional request is directed by the Code Compliance Department. NOW THEREFORE, City and Consultant, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I — Scope of Services, Paragraph (2) shall be added to read as follows: (2) Provide additional design, Architectural & Engineering, for the Drop-Off Station. The cost of this additional service is $17,680.00 without additional reimbursable expenses. The scope of services is described more fully in Elements of Architecture, Inc. Letter dated July 14, 2020, subject: "Proposal for Hemphill Drop-Off Center— Additional Services 04, Changes at Scrap Metal Yard. 2. Article II — Compensation, first paragraph, is amended as follows: "Consultant shall be compensated in accordance with the Fee Schedule shown in Attachment "E". Payment shall be considered full compensation for all labor, materials, supplies, and equipment necessary to complete the services described in Attachment "E". However the total fee paid by the City shall not exceed a total of $163,277.00 including $6,900.00 in reimbursable expenses unless the City and the Consultant mutually agree upon a fee amount for additional services and amend this Agreement accordingly." We understand that this includes regarding of the area, new retaining walls, etc. as previously discussed. See proposals attached for civil and structural services defined. TOTAL PROPOSED FEE Labor We propose to provide our services as identified in this proposal as follows: Architectural Services $ 5,800 Structural Engineering (4,000 x 1.1) $ 4,400 Civil Engineering (6,800 x 1.1) 7,480 TOTAL ADDITIONAL SERVICES $17,680 Fees listed above are for labor only. We have not included any expenses as we believe we can cover any within our existing remain expense balance. PROJECT TEAM The design team remains the same with Carrillo, RLWA and Elements providing services for this change to the scope. All firms are SBE certified. If this proposal meets with your approval, we would anticipate an amendment to our contract for services identified within this proposal. Sincerely, Debbie Fulwiler, AIA President AMENDMENT NUMBER 4 TO THE AGREEMENT BETWEEN THE CLIENT AND CARRILLO ENGINEERING, LLC AMENDMENT NUMBER 4 DATED July 9, 2020 to the agreements between Elements of Architecture, Inc. ("Client") and Carrillo Engineering, LLC ("Consultant") dated November 21, 2016 ("the Agreement") concerning the City of Fort Worth Old Hemphill Drop-off Center (the "Project"). The Consultant has entered into the Agreement with the Client for the furnishing of professional services, and the parties now desire to amend the Agreement. Therefore, it is mutually agreed that the Agreement is amended to include Additional Services to be performed by Consultant and provisions for additional compensation by the Client to the Consultant, all as set forth in Exhibit A hereto. The parties ratify the terms and conditions of the Agreement not inconsistent with this Amendment, all of which are incorporated by reference. CLIENT: ELEMENTS OF ARCHITECTURE, INC. CARRILLO ENGINEERING, LLC By: By: Title: Title: Managing Member Exhibit A to Amendment Number 4 dated July 9, 2020 Carrillo Engineering, LLC shall perform the following Additional Services: Task 1 —Additional Topographic Survey $2,300(Lump Sum) The Consultant will add to the previously prepared ground topographic survey around the concrete pad/scrap metal drop-off area. The additional topographic survey will not include the entire site, only the concrete pad/scrap metal drop-off area The survey will be used for civil design purposes for services under Task 2 below and will: A. Show existing visible topographic features including edge of concrete pad; B. Show visible existing utilities immediately adjacent to and on the site based on visible indications of the features; and C. Show site topography at 1-foot intervals based on an approximately 50'by 50' grid for the site to be used in preparing the civil engineering documents. The topographic survey will show spot elevations and contours for the site. The topographic survey will be established on NAD83 Texas State Plane Coordinate System, and NAVD88 North American Vertical Datum. The trees on site will not be individually surveyed or tagged. Task 2—Civil Engineering Plan Revisions $4,500(Lump Sum) As part of this task and at the request of the City of Fort Worth("City"),the Consultant will revise the site, paving, grading and drainage plans to incorporate the requested site revisions including grading for a new retaining wall; revisions to plans for access to the scrap metal drop-off area; and a new trench drain in front of the current metal drop of area. It is our understanding the landscape and irrigation plans will not need to be revised and any changes will be done in the field with the City's approval. Fort Worth, Texas Additional Services—Added Drop Off/Retaining Wall Dear Ms. Fulwiler: R L Woods & Associates, LLC is pleased to provide this proposal for addition services for additional Drop Off/Retaining Walls at the above referenced facility. We understand that the effort will consist of the following: • Supplemental structural review and detailing for added Drop Off/Retaining Walls • Provide 1 Added Site Visit for the new wall location. I. SCOPE 1. Provide Updated Construction Documents for item identified above. 2. Provide limited CA services to include response to RFI's, review of shop drawings and periodic construction observation (1 added site visit included in scope). II. LIMITATION OF SCOPE Our scope of services includes only those services specifically included above. III. PROPOSAL ASSUMPTIONS: 1. We plan to perform our services between 8:00 am and 5:00 pm on weekdays. IV. COMPENSATION: We propose to perform these services for a stipulated sum of$4,000. Additional site visits, beyond the one extra included visit, will be additional services and will be billed at$690 per visit.
