HomeMy WebLinkAboutOrdinance 17741-09-2007Ordinance No. 17741-09-2007 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIALLY FUNDED CAPITAL PROJECTS FUND IN THE AMOUNT OF $1,700.00 SUBJECT TO RECEIPT OF PLEDGED DONATIONS FOR THE PURPOSE OF FUNDING MAINTENANCE OF A GRANITE SEATING INSTALLATION AT THE FORT WORTH BOTANIC GARDEN; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2006-2007 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Specially Funded Capital Projects Fund in the amount of $1,700.00 subject to receipt of pledged donations for the purpose of funding maintenance of a granite seating installation at the Fort Worth Botanic Garden. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 17142 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. No. 17741-09-2007 DATE: Tuesday, September 04, 2007 LOG NAME: 80PUt_~ENBENCH REFERENCE NO.: G-15856 SUBJECT: Acceptance of a Gift of an Artist Designed Granite Seating Installation from the Family and Friends of Marie Dulaney Pullen at the Fort Worth Botanic Garden for Acquisition into the Fort Worth Public Art Collection (FWPA), Acceptance of Donations for Maintenance and Adoption of Attached Appropriation Ordinance __«__ RECOMMENDATION: It is recommended that the City Council: 1. Accept a sculptural gift, valued at $30,000, from the Family and Friends of Marie Dulaney Pullen, for acquisition into the Fort Worth Public Art Collection, to be sited at the Fort Worth Botanic Garden; 2. Authorize the City Manager to accept donations, in an amount up to $1,700, for maintenance of the sculpture, once completed; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations, in an amount up to $1,700 in the Specially Funded Capital Projects Fund, subject to receipt of the pledged donations for sculpture conservation. DISCUSSION: Marie Delaney Pullen was an ardent community volunteer and activist for the arts. She was instrumental in raising funds in support of the Imagination Celebration Program to provide art and cultural experiences for Fort Worth Independent School District students. She was particularly devoted to programs working with hearing impaired children. Fort Worth artist Alice Bateman has been commissioned by the Family and Friends of Ms. Pullen to design and create a memorial installation comprised of two interlocking benches and integrated sidewalk created from Texas Red Granite. The intended site lies in the south vista area of the Botanic Garden. Cut from polished granite, the benches are to be shaped in a curvilinear pattern following the natural plant line of the site. The thermal-finished granite sidewalk features inlays of polished granite, which replicate the shadow pattern created from light filtering through overhanging trees. At its October 25, 2006 meeting, the Parks and Community Services Advisory Board approved recommending to the City Council the acceptance of this generous donation. On November 22, 2006, the Fort Worth Art Commission's Gifts and Loans Review Panel endorsed the proposal for this artwork with the panel commenting on the appropriateness for the site and elegance of the design. The design was unanimously approved by all panels. On December 4, 2006, in accordance with the Fort Worth Public Art Master Plan (M&C G-14087, Approved by the City Council on September 30, 2003), the Fort Worth Art Commission unanimously voted to recommend this artwork for acquisition and stated that all funds needed to be secured prior to this project being considered by the City Council for approval. On May 22, 2007, the Logname: 80PULLENBENCH Page 1 of 2 FWPA was notified that all funds had been received for this project. The Family and Friends of Marie Dulaney Pullen are providing funding to fabricate and install this artwork. In addition, the donors have secured $1,700 in pledges to the FWPA Conservation Fund to maintain this artwork. The City's FY2006-07 Professional Services Agreement with the Arts Council of Fort Worth and Tarrant County (Contract #34139, M&C C-21683) provides for administrative oversight for this artwork. As a member of the FWPA collection, this artwork will receive periodic appraisals, condition assessments, annual maintenance and conservation treatment through the annual Conservation Action Plan with funds from the Public Art Conservation Fund, which was established in FY2005-06 using a portion of the Water Department`s annual contribution for public art. The Botanic Garden is a citywide special use facility and serves ALL COUNCIL DISTRICTS. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that, upon approval of the above recommendations, adoption of the attached appropriation ordinance and receipt of the pledged donations, funds will be available in the current operating budget, as appropriated, of the Specially Funded Capital Projects Fund.
