A RESOLUTION FAVOR LENGTHENING THE LIMITATION PERIOD FOR A SUSPENSION FROM A FIRE OR POLICE DEPARTMENT WHEREAS, Section 16 of Article 1269m, of the Revised Civil Statutes of Texas, does not permit a fire or police chief to discipline any officer or employee under his supervision for any offense which did not happen or occur within six (6) months immediately preceding the date of suspension; and, WHEREAS, an alleged offense may not become known within six (6) months after it was committed; and, WHEREAS, an alleged offense may be discovered at such time as to prohibit a full investigation before the six (6) month period elapses; and, WHEREAS, Section 16 of Article 1269m serves to protect employees against unreasonable and arbitrary action by a fire or police chief but should not serve to deprive the fire or police chief of his right and/or authority to discipline employees who have violated department rules and regulations, civil service rules and regulations, or laws of the State of Texas; NOW TBEREFORE LET IT BE RESOLVED by the City Council of the City of Fort Worth that the City of Fort Worth endorses legislation which proposes to amend Section 16 of Article 1269m, of the Revised Civil Statutes of Texas, to permit the fire or police chief to bring disciplinary action against an employee within twelve (12) months of discovery of the alleged offense or within twelve (12) months after the fire or police chief should have reasonably discovered the alleged offense.
