A RESOLUTION FAVORING
CLARIFICATION OF MILITARY LEAVE
OF ABSENCE FOR MUNICIPAL EMPLOYEES
WHEREAS, Article 1565 of the Texas Statutes allows municipal
employees a leave of absence with pay for fifteen (15) days to
attend military training; and,
WHEREAS, the Attorney General has interpreted Article 1565
to mean fifteen (15) working days and not two (2) calendar weeks;
and,
WHEREAS, military organizations normally require two (2)
calendar weeks of summer camp; and,
low WHEREAS, the Legislature probably did not intend to allow
more than two (2) calendar weeks; and,
WHEREAS, more than two (2) calendar weeks of paid military
leave works an undue hardship on the City; and,
WHEREAS, Article 625-4a provides that an employee of a
municipality who leaves his position and joins the service shall
be entitled to his former position upon discharge, regardless of
when the discharge occurs; and,
WHEREAS, municipal employees not interested in a military
career should be afforded some ,job protection; and,
WHEREAS, requiring a municipality to re-employ an individual
who has made the military a career for up to twenty years also
works an undue hardship on the City;
NOW THEREFORE LET IT BE RESOLVED by the City Council of the
City of Fort Worth that the City of Fort Worth endorses an amendment
v� to Article 1565 to allow municipal personnel sufficient leave to
attend military training for 15 consecutive days, once each year;
BE IT FURTHER RESOLVED that the City of Fort Worth endorses
an amendment to 6252-4a placing a time limit of five years on the
period during which an employee who joined the armed services may
reclaim his former job.
