HomeMy WebLinkAboutResolution 428 r'iESOLUTIOIv' FILE NO. `� � - A ResOlutton WHEREAS, the City of Fort Worth is in agreement with the declaration of policy of the Texas Legislature as expressed in Article 6252-17a which reads in part as follows: "The people, in delegating authority, do not give their public servants the right to decide what is good for the people to know and what is not good for them to know. The people insist on remaining informed so that they may retain control over the instruments they have created." WHEREAS, S.B. 44 and H.B. 114 attempt to reverse by legislation the opinion of the Texas Supreme Court in Industrial Foundation of the South vs. Texas Industrial Accident Board, wherein the Court, in effect, held such records to be open under the Open Records Act save and except those which, if revealed, would invade the privacy of the party reflected in such records, and WHEREAS, for reasons of promoting good hiring practices and properly defending questionable workmen's compensation claims and lawsuits, such records should remain open and available, and WHEREAS, the City of Fort Worth has a duty to its Citizens and taxpayers to discover any questionable or fraudulent workmen's compen- sation claims or lawsuits, THEREFORE, BE IT RESOLVED, that the City Council of the City of Fort Worth opposes enactment of S.B. 44 or H.B. 114 or any other law privileging the records of the Industrial Accident Board from disclosure to and inspection by the general public as previously directed by the Open Records Law (as interpreted by the Texas Supreme Court in its opinion relative to the application of this statute to the records of the Industrial Accident Board.)
