AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE
KELLER HICKS ROAD PROJECT FROM LAUREN WAY TO US 377 IN THE AMOUNT OF
$1,476.87, FROM AVAILABLE FUNDS IN THE TRANSPORTATION IMPACT FEE
CAPITAL LEGACY FUND; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS
ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES
IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2019-2020 in the
Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Keller
Hicks Road Project from Lauren Way to US 377 in the amount of $1,476.87, from available funds in the
Transportation Impact Fee Capital Legacy Fund.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion orjudgment shall in no way impair
the remaining portions, sections, or parts of sections of this ordinance,which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 23835-09-2019 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

(CD 7)Adopt Appropriation Ordinances to Provide Additional Funding for the Keller Hicks Road Project from Lauren Way to US 377 in the
Amount of 3,000,000.00 and Update the FY 2020-2024 Capital Improvement Plan(2018 Bond Program)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached appropriation ordinance adjusting the receipts and appropriations in the Transportation Impact Fee Capital Legacy fund
by increasing receipts and appropriations in the Keller Hicks Project(City Project No. 100146)from Lauren Way to US 377 in the amount of
$1,476.87 and by decreasing receipts in the REVENUE-Service Area D-Transportation Impact Fees(City Project No. UN9914)project by
the same amount;and
2. Adopt the attached appropriation ordinance adjusting the receipts and appropriations in the Transportation Impact Fee Capital fund by
increasing receipts and appropriations in the Keller Hicks Project from Lauren Way to US 377 project for the amount of$2,998,523.13 and
by decreasing receipts in the REVENUE-Service Area D-Transportation Impact Fees project by the same amount.
DISCUSSION:
The purpose of this Mayor and Council Communication(M&C)is to adopt the attached appropriation ordinances to supplement existing funding in
the Keller Hicks Rd project from Lauren Way to US 377 (City Project No. 100146)and to update the FY 2020-2024 Capital Improvement Plan
(CIP).
Keller Hicks,within this projects limits,is approximately 2,000 feet in length and is identified in the City's Master Thoroughfare Plan as a 3-lane
commercial connector.The proposed project will replace the existing two-lane asphalt road with a three-lane concrete street with travel lanes in
each direction, including a mutual left-turn lane,drainage,street lights,ten-foot sidewalks and ADA facilities. The construction of Keller Hicks Rd
will be completed as a joint project between the City of Fort Worth,the City of Keller,and the adjacent developer, D. R. Horton. Agreements
between those parties are being negotiated.
The total project cost estimate for the joint project is$4,400,000.00. Previously appropriated funds total$2,510,000.00.Keller Hicks Rd from Park
Vista Rd to Katy Rd was identified as an impact fee eligible project in Service Area D of the adopted 2017 Transportation impact Fee Study. The
section of Keller Hicks Rd between Katy Rd and US 377 is not impact fee eligible and must be funded from another source within the project. This
additional impact fee funding will cover the current funding gap in the project's eligible segments and provide contingency funds. After final
payment on the construction contract and completion of the project,any residual impact fee funds will be returned to the Service Area D fund.
Funding for this project was included in the FY 2020-2024 Capital Improvement Plan in the amount of$2,510,000,00.The project has been
underfunded to date and the new amount has changed to$5,510,000.00 to bridge the funding gap and to provide for contingencies.The action in
this M&C will update the FY2020-2024 Capital Improvement Plan.

The Keller Hicks Road project is in COUNCIL DISTRICT 7.
A Form 1295 is not required because:This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that funds are currently available in the REVENUE-SA D-Transp Imp Fees project within the Transportation
Impact Fee Cap and Trans Impact Fee Cap Legacy funds and upon approval of the above recommendations and adoption of the attached
appropriation ordinances,funds will be available in the Transportation Impact Fee Cap and Trans Impact Fee Cap Legacy funds for the Keller
Hicks Road(Lauren Way to US377)project to support the approval of the above recommendations. Prior to an expenditure being incurred,the
Transportation&Public Works Department has the responsibility of verifying the availability of funds.
