HomeMy WebLinkAboutContract 53044-A1 CSC NO. 53044-A1 AMENDMENT NO.#1 TO CITY SECRETARY CONTRACT NO. 53044 VENDOR SERVICES AGREEMENT This Amendment is entered into by and between the City of Fort Worth (hereafter "City"), a home rule municipal corporation organized under the laws of the State of Texas, with its principal place of business at 1000 Throckmorton Street, Fort Worth, Texas, and Cindy Dickason d/b/a PSYCHSCREENING (hereafter"Vendor"), a sole proprietorship. WHEREAS, the parties have previously entered into City of Fort Worth City Secretary Contract No. 53044 (the "Contract"), which was executed on November 11, 2019; and WHEREAS, it is the collective desire of City and Vendor to amend the Contract to include the annual price for renewal period. WHEREAS, it is the collective desire of City and Vendor to amend the Contract to include Exhibit B, Appendix A-1, Appendix 13-1, Appendix C-1, attached to this Amendment; WHEREAS, it is the collective desire of City and Vendor to amend the Contract to redefine Vendor as"Cindy Dickason d/b/a PSYCHSCREENING"; and NOW, THEREFORE, City and Vendor, acting herein by the through their duly authorized representatives, enter into the following agreement to amend the Contract: 1. That the annual renewal price for this Term shall not exceed$40,000.00. 2. That the Detailed Scope of Services, Relevant Laws, Job Description, TCOLE Form, attached to this Amendment, is hereby included with the Agreement Documents of the Contract; 3.Vendor, as defined in the Contract, is redefined as follows: "Cindy Dickason d/b/a PSYCHSCREENING." WORTH, TX EXHIBIT B Scope of Work The City desires to engage the services of a psychologist or a psychiatrist as an independent consultant to perform pre-employment psychological evaluations to applicants desiring to become a police officer, as required by state law and the Texas Commission on Law Enforcement ("TCOLE") and in accordance with the Professional Services Agreement to which this Exhibit B is attached(the "Agreement"). Consultant affirms that Consultant employs psychologists licensed to practice in Texas by the State Board of Examiners of Psychologists or the Texas Medical Board, and desires to render professional services for City pursuant to the terms and conditions provided in the Agreement. Anthony Bean, PhD, Carol Holiday Bean, PsyD, and Alexandra Marks, PhD have been appointed by the Fort Worth Civil Service Commission to administer pre-employment psychological evaluations; they are familiar with the duties of police officers employed by the City of Fort Worth; have specialized knowledge in the use of psycho diagnostic and personality tests for employment selection decisions; have a working knowledge of and will abide by the laws related to the civil service employment screening process in Texas, including those attached to this Exhibit as Appendix A-1; and will abide by the Americans with Disabilities Act, as amended, and all other laws relevant to the Agreement and the scope of work to be performed. Consultant affirms and agrees that only the licensed psychologists appointed by the Fort Worth Civil Service Commission shall perform the services described in this Exhibit. THEREFORE, by this Exhibit B and the Agreement, and based upon Consultant's affirmations, City retains the services of Consultant, and in consideration of the mutual promises contained herein and in the Agreement, the parties agree as follows: I. SERVICES TO BE PROVIDED BY AND RESPONSIBILITIES OF CONSULTANT A. Licensed psychologists employed by Consultant shall administer pre-employment psychological examinations to applicants seeking to become police officers in the City of Fort Worth (hereinafter referred to as "Applicants") as may be required from time to time on a scheduled basis. B. All examination processes must be conducted pursuant to professionally recognized standards and methods. C. The examination process for each Applicant must consist of a review of the current job description for police officers employed by the City of Fort Worth (an example of which is attached hereto as Appendix B-1); review of the Applicant's personal history statements and background documents, or a summary of such documents, which will be provided by police department staff to the Consultant at or near the time of the Consultant's interview of the Applicant; scoring and review of at least two instruments, one which measures personality traits and one which measures psychopathology; and a face-to-face interview conducted after the instruments have been scored. Exhibit B-Scope of Work 1 D. The licensed psychologists employed by Consultant shall determine which two instruments to utilize in order to measure the Applicants' personality traits and psychopathology, although all Applicants for a particular academy class should be given the same two tests. The parties to the Agreement will determine whether the tests should be administered at the police training academy or in some other City- owned facility. The tests will be administered by the Consultant and/or his or her staff. E. The licensed psychologists employed by Consultant will conduct the individual interviews of the Applicants at the police training academy or other city-owned facility. The Fort Worth Police Department ("FWPD") will schedule the interviews after conferring with the Consultant regarding availability. The face-to-face interview of each Applicant should entail a meaningful discussion that, along with the review of the relevant test scores and personal history statements and background information, would enable the licensed psychologist employed by Consultant to determine whether the Applicant is in satisfactory psychological and emotional health to serve as a police officer. F. The licensed psychologists employed by Consultant shall complete and submit to the City his or her determination as to whether an Applicant can fulfill the essential job functions of a Fort Worth police officer on a form provided by FWPD and promulgated by TCOLE for that purpose. The most current version of that form as of the effective date of this Agreement can be found at www.tcole.texas.gov, an example of which is attached hereto as Appendix C-1. G. The licensed psychologists employed by Consultant shall also draft a report regarding each Applicant. The written reports shall include an assessment of each Applicant, including a clear and definitive determination as to whether the Applicant can perform the essential job functions of a Fort Worth police officer. Narrative reports shall be confined to job-related reasons that the Applicant should or should not be hired, and should avoid clinical diagnostic labels or terms that would not be understood by laymen. Any recommendation of disqualification shall be based on an applicant's inability to perform the essential psychological functions of a police officer's duties. Such reports should be maintained by Consultant for no less than three (3)years from the date of the relevant evaluation. H. The licensed psychologists employed by Consultant shall prepare and submit to the FWPD his or her final determination on the appropriate TCOLE-promulgated form within 7 calendar days of the face-to-face evaluation. I. All questions regarding the testing procedures, scheduling or other issues or concerns related to the Scope of Work of this Agreement should be directed to the Sergeant over the Backgrounds Unit of the FWPD, or his or her designee. All completed TCOLE forms regarding applicants should also be provided to this sergeant, or his or her designee. The licensed psychologists employed by Consultant may be required to provide testimony regarding the validity of the psychological screening process and the tests conducted. Consultant shall maintain at his or her place of business complete and accurate records of all examinations of Applicants and employees to support his or her testimony. K. Consultant and the licensed psychologists employed by Consultant shall provide written proof that they are licensed to practice in the state of Texas by the State Board of Examiners of Psychologists or the Texas Medical Board, and shall notify City if their licensure is suspended or terminated while the Agreement is in effect. L. Consultant shall provide written proof that he or she holds the insurance required by the terms of the Agreement. II. DUTIES AND RESPONSIBILITIES OF CITY A. City shall provide access to facilities for the written examinations and face-to-face interviews of the Applicants. B. City, through the FWPD, shall coordinate with the Consultant to schedule the testing and face-to-face interviews. C. City, through the FWPD, shall provide relevant documents, including the Applicants' personal history statements and background documents, or a summary of those documents, to the Consultant for review. D. City shall pay the Consultant for his or her services as outlined in the Agreement. Exhibit B-Scope of Work 3 APPENDIX A-1 RELEVANT LAWS TEXAS LOCAL GOVERNMENT CODE TITLE 5. MATTERS AFFECTING PUBLIC OFFICERS AND EMPLOYEES SUBTITLE A. MUNICIPAL OFFICERS AND EMPLOYEES CHAPTER 143. MUNICIPAL CIVIL SERVICE FOR FIREFIGHTERS AND POLICE OFFICERS Sec. 143.022. PHYSICAL REQUIREMENTS AND EXAMINATIONS. (a) The commission shall set the age and physical requirements for applicants for beginning and promotional positions in accordance with this chapter. The requirements must be the same for all applicants. (b) The commission shall require each applicant for a beginning or a promotional position to take an appropriate physical examination. The commission may require each applicant for a beginning position to take a mental examination. The examination shall be administered by a physician, psychiatrist, or psychologist, as appropriate, appointed by the commission. The municipality shall pay for each examination. (c) If an applicant is rejected by the physician, psychiatrist, or psychologist, as appropriate, the applicant may request another examination by a board of three physicians, psychiatrists, or psychologists, as appropriate, appointed by the commission. The applicant must pay for the board examination. The board's decision is final. Acts 1987, 70th Leg., ch. 149, Sec. 1, eff. Sept. 1, 1987. Amended by Acts 1989, 71st Leg., ch. 1, Sec. 26(b), eff. TEXAS ADMINISTRATIVE CODE TITLE 37 PUBLIC SAFETY AND CORRECTIONS PART 7 TEXAS COMMISSION ON LAW ENFORCEMENT CHAPTER 217 LICENSING REQUIREMENTS RULE §217.1 Minimum Standards for Initial Licensure (a) The commission shall issue a license to an applicant who meets the following standards: Appendix A-Relevant Laws Page 2 (12) [has been] examined by a psychologist, selected by the appointing, employing agency, or the academy, who is licensed by the Texas State Board of Examiners of Psychologists. This examination may also be conducted by a psychiatrist licensed by the Texas Medical Board. The psychologist or psychiatrist must be familiar with the duties appropriate to the type of license sought. The individual must be declared by that professional, on a form prescribed by the commission, to be in satisfactory psychological and emotional health to serve as the type of officer for which the license is sought. The examination must be conducted pursuant to professionally recognized standards and methods. The examination process must consist of a review of a job description for the position sought; review of any personal history statements; review of any background documents; at least two instruments, one which measures personality traits and one which measures psychopathology; and a face to face interview conducted after the instruments have been scored. The appointee must be declared by that professional, on a form prescribed by the commission, within 180 days before the date of the appointment by the agency; FORT WORTH POLICE AND FIRE CIVIL SERVICE COMMISSION RULES Chapter 5: Minimum Standards for Entry-Level Positions in the Police Department 5.08 Psychological Standard: Within 180 days before the date of employment, each applicant must be examined by a licensed psychologist or psychiatrist and be declared in writing by that professional to be in satisfactory psychological and emotional health for licensing as a peace officer. The examination must be conducted pursuant to professionally recognized standards and methods and must be administered by an experienced professional who is a: Licensed psychologist or psychiatrist, appointed by the Commission; or Qualified psychologist exempt under licensure by the Psychologist Certification and Licensing Act, Section 22, who is recognized under exceptional circumstances, and appointed by the Commission. MINIMUM QUALIFICATIONS EDUCATION Possess a high school diploma (be a graduate from high school); OR possess a high school equivalency certificate and must have completed 12 hours at an institution of higher education with a grade point average of 2.0 on a 4.0 scale. EXPERIENCE No work experience is required. Must successfully complete training curriculum as specified in the Fort Worth Police Training Academy for Police Trainee.
